Abstract

The aim of this paper was to explore commonalities between HIV/AIDS-related conditions, obesity and other disabling impairments as health-related barriers that limit opportunity and advancement in society and the workplace. Taking a number of examples from original fieldwork and European Union (EU) and United Kingdom (UK) law, we posited that ‘disability discrimination’ under EU law remains an indefinite, imprecise and incomplete area that requires greater alignment with the social model of disability. The principle attributes of societal discrimination towards people living with HIV and obese people are that these conditions are perceived to be primarily or in some instances, solely caused by controllable factors related often to behaviours and lifestyle choices. Strong beliefs that these conditions are controllable are perceived as a justification and in some instances encouragement for the creation of stigma and discriminative behaviours that are unjust and uninformed. The structure of the paper is as follows. First, this paper postulated how and why stigma exists towards both individuals with disabilities and also obese individuals and people living with HIV; second, reviewed the legal framework on disability discrimination in both UK and EU courts that are directly relevant to the concepts of obesity and HIV-AIDS; third, presented critical thoughts as to the extent to which emerging decisions of the Court of Justice of the EU concerning obesity and HIV-AIDS accord with the social model of disability and fourth, offered an analysis of the implications of the UK and European framework and suggested possible interventions in this area.

Abstract

Spirituality in the workplace is a concept that has been emphasized a lot in recent years. However, the relationship of this concept with gender and discrimination has not been adequately addressed. Individual and organizational positive outcomes of spirituality in the workplace cannot be obtained when discrimination is in question. This is because the concepts of spirituality and discrimination in the workplace are completely opposite to each other. In order to prevent discrimination based on gender, sexual orientation, race, age, religion, disability and to establish spirituality in the workplace, organizations should follow awareness and training programs to eliminate prejudices of their management and employees, give importance to differences, develop an understanding of democracy and justice within the organization and development egalitarian and anti-discrimination policies and application. In this direction, while the differences are managed correctly, spirituality will be established in the workplace.

Abstract

The European growth model set out by the European Commission is founded on a dual transition, to green and digital. Although the transition to the new growth model requires an in-depth analysis of the transformations that will affect industry in its main branches and the energy system in particular, the social and employment aspects must not be ignored, in order to ensure that the twin transitions are fair and inclusive and have a substantive contribution to strengthening the Union’s social resilience and the prosperity of all citizens. Taking as a starting point the fact that the green transition will have direct impacts on the labor market, affecting, as emphasized by the European institutions, primarily workers who already have a vulnerable status, this chapter aims to analyze the topic of employment gender gap, highlighting those aspects that could be aggravated during the green transition. The analysis was carried out on relevant statistical data for the Romanian labor market, which were projected on EU27 data.

Abstract

This chapter focuses on the case of migrant Filipina live-in domestic workers in Greece and how the frame of their work and employment in precarious, low-status/low-wage jobs and race discrimination at work, that is, the employers’ residences, affect their participation in secondary groups of solidarity and workers and their representation in them, that is, community, migrant labour associations and trade unions, during the economic crisis in Greece. According to the results of in-depth interviews Filipina migrants are entrapped in a frame of isolative and exploitative working conditions and racial discrimination at work, that is, personal services, care and domestic work. In this working context, most of the interviewed migrant Filipina live-in domestic workers appear to have developed individualistic perceptions, they act in an atomistic manner, form materialistic beliefs, are indifferent to collectivity and solidarity and are isolated from their compatriots and other workers. They have low self-perceptions and expectations for social advancement and deal with their social and labour-related problems individually, or completely resign from claiming them.

Abstract

This chapter discusses social responsibility taking into account the role of women as statutory auditors. Indeed, auditors are expected to confirm whether the financial statements are true and fair and, in accordance with the law, adopt a responsible attitude to the society. Methodologically, this research relied on a two-track approach. The first takes the form of an editorial review and argument which allows the authors to explore social responsibility literature along with implications for the role of women as statutory auditors. The second takes the form of a field research based on an exploratory longitudinal analysis, over the period 1973–2013, and support of the legal regime of Portugal, with public available sources of statistics and reports relating to the statutory auditors. The authors provided a glimpse of the role of women in this profession and, in the last years, the results show a weak increase of women on the statutory audit exercise.

In this chapter, we investigate race discrimination and race equality policies in the workplace at two interrelated levels of analysis in Cyprus. At the macro-national level, the effectiveness and implications of the present legal system is evaluated, and the chapter discusses whether it brought about the desirable results of safeguarding a fairer and efficient legal system, eliminating any kind of discrimination at the European Union (EU) level. At the meso-organizational level, the chapter refers to the results of research presenting a number of organizational policies and practices that safeguard or hinder the inclusion of migrants at the workplace.

Abstract

This chapter is partially based on an unpublished Organisation for Economic Co-operation and Development (OECD) background report, titled ‘OECD Research Project on Diversity in the Workplace: Country Report Germany’, which was written by the authors of this chapter. While the OECD country report illustrates how diversity policies and related diversity instruments targeting various diversity dimensions have developed in Germany over recent decades, this chapter focuses solely on the management of ethnic diversity and its related policies. Diversity policies are broadly understood as any policy that seeks to increase the representation of disadvantaged social groups such as migrants and ethnic minorities, women, disabled persons, older workers and lesbian, gay, bisexual, transgender/transsexual, intersex and queer/questioning (LGBTIQ) in the workplace, both in the public and in the private sector. The central idea of this chapter is to provide an overview of which policies and instruments have been implemented for migrants and ethnic minorities at the workplace and to evaluate their success or failure where possible. In doing so, this chapter also discusses obstacles, success factors and challenges for policy implementation for the past and for the future.

Abstract

The aim of this chapter is to take stock of the aspect of the social concertation in the framework of policies of diversity management. It rests in particular on the work of a commission created by the AFMD (French Association of Diversity Managers), in partnership with ORSE (a French Societal Observatory). The commission has involved several larges French companies and organised meetings between the representatives of the different employers’ and workers’ organisations. Another source is the numerous actions led by the Labour Unions in Belgium in the framework of the Consortium Diversité Wallonie, which exists since 2007. This study tries to remind some objectives of social concertation in regards to policies of diversity management, to take stock of the legal constraints on concertation in regards to particular targets, to show the multiple conceptions of this notion of diversity management among social partners, to give an overview of the content of the agreements, and to present the steps of a social concertation sensible to diversity.

Inclusion Europe, the European movement of people with intellectual disabilities and their families, shared what people with intellectual disabilities and their families faced during the COVID-19 crisis. Collecting information showed people with intellectual disabilities were segregated and discriminated against. The pandemic intensified and magnified the segregation and discrimination of people with intellectual disabilities, shedding light on their exclusion. Many human rights were violated. Therefore, such testimonies should encourage governments and institutions to urgently design a society that includes people with intellectual disabilities and their families.
