Abstract

This chapter begins with an examination of the complexities, challenges, and contradictions that are presented by policies and practices associated with the College Entrance Examination (CEE) and higher education admissions during the three decades of China's reform era. It then focuses on recent reform polices as outlined in the national education 2020 Blueprint (National Educational Reform and Development Plan, 2010–2020), which deepens the debate about the role of the CEE in shaping the mission of education and distributing opportunities and “talents” affecting social mobility, university autonomy, and national development. The CEE stands at the epicenter of educational reform, criticized for hamstringing institutional autonomy and innovation; reducing schooling to a soulless competition; and unfairly advantaging urban children with greater educational opportunities. This chapter explains the staying power of the CEE and concludes that China's examination culture will intensify in the short term, as the CEE is clung to as a last bastion of meritocracy and is reinforced by the state's desire to cultivate what the 2020 Blueprint labels elite “selected innovative” and “pragmatic” talents. Content and policy analysis is used to explain CEE reform since 1978 and provide a backdrop for discussion of pedagogical, market, and compensatory reform strategies that tinker at the CEE's margins. To take into account micro-institutional processes involved in the CEE's creation, maintenance, and resistance to change, we examine stakeholders' frames of common perception through 2010 interviews with exam candidates and their parents, and faculty and administrators from four Gansu Province universities. These interviews illustrate what the CEE means to diverse families and reveal how admission policies impact students, teachers, and university faculty and administrators at both elite and non-elite higher education institutions. The slow change of CEE reform discourse and practice as China inches from examination-based selection criteria to ability-based selection criteria has begun to redefine the trajectories of recognized “elites,” whose actions are motivated by and reflect the changing needs of society and economic development. Friction and resistance on the ground, therefore, point to the ways in which the changing needs of the labor market, the policy mandates of the national agenda, the meritocratic ideal and the educational desires of China's citizenry intertwine to shape, and be shaped by, CEE policies.

Abstract

There is an intersection between the global refugee crisis and higher education within the context of the United States. This chapter provides an overview of emerging trends in refugee migration and internal displacement, reviews the historical approach to refugee resettlement to the United States, and offers a discussion of the relationship between K-12 schools and the United States higher-education structure. Data suggest that the majority of the refugee population resettled to the United States is below the age of 35 years, and is therefore most likely to engage with higher education. In the context of this chapter, refugees and those who have previously held refugee status, and interact with the higher-education system, are referred to as “students from refugee backgrounds.” Students from refugee backgrounds are a diverse group in many ways, including but not limited to country of origin, culture, religious and/or spiritual affiliation, English language proficiency, migration history, and educational background. The combination of these factors poses a unique set of challenges to their transition to the United States and the higher-education environment. This chapter highlights some of these challenges and explores the growing role of colleges and universities in facilitating educational access and support.

Abstract

Purpose – This study tracks the legal control of the problem of substance abuse.

Methodology/Approach – The chapter explores the “natural history” of the evolution of the social construction of drug use and our collective response to it. Over the past 100 years, our understanding of drug use/abuse and the system for handling drug problems have gone through a series of changes. In the past 20 years or so, provision of treatment for drug offenders within the criminal justice system has rapidly expanded. California's recently enacted Proposition 36 (Prop 36) initiates for the first time on a mass basis the court-supervised drug treatment that began a decade earlier on a much smaller scale with the original drug courts. This chapter compares the Prop 36 program for diverting nonviolent drug offenders into court-supervised treatment with the original drug courts.

Findings – The research shows how court-supervised drug treatment has evolved from a personalized care program in the original drug courts to a mass processing operation under Prop 36. The research finds that the social problem solution of offering treatment to more drug defendants created its own unanticipated consequences and problems, including significant standardization in the operations of the court and a dilution of many useful features that defined the early drug courts.

Practical implications – “Farming out” drug defendants to probation and treatment makes case-processing and treatment potentially less effective therapeutically. The chapter raises questions about how social control can extend its domain without “breaking the bank” and what the consequences are for how social problems are handled.

Despite children’s academic excellence in East Asian countries, school education in this region faces a range of challenges to build inclusive and quality education for all. This chapter aims at examining how these challenges occur and what actions have been taken to deal with them. By focusing on China, Japan, and the Republic of Korea, the chapter first reviews reforms of school education since the 1990s in these countries. The subsequent sections then present educational disparity and a new mode of teaching and learning in these countries. It concludes by addressing that East Asian countries must explore more common ground for building a more collective sense and identity to share responsibility for building a resilient, inclusive and sustainable world through global citizenship education and education for sustainable development.

Abstract

Legal and philosophical scholarship on religious education typically focuses on religious schools that challenge core liberal values. Religious schools that offer their students quality secular education, and whose religious character is mild, do not raise these concerns and have therefore evaded scrutiny thus far. This chapter argues that the latter kind of religious schools, which I call “creaming religious schools,” may have a negative effect on educational equality and should therefore be subject to restrictive legal regulation. The negative effect on equality is caused by the fact that when successful, these schools appeal not only to members of the religious community but also to non-member high-achieving students who leave the public schools (a process called creaming) thus weakening them. The chapter argues that the harm caused to public schools cannot be redeemed by alluding to the right to religious education because the religious justification for creaming religious schools is relatively weak. The chapter then examines several potential legal measures for contending with creaming religious schools: the antidiscrimination doctrine, which the chapter rejects, showing that it actually aggravates creaming, locating schools in disadvantaged neighborhoods, restricting tuition, reflective enrollment policy, and finally, the total prohibition of establishing creaming religious schools.

Abstract

Iran, with its young and highly literate population, constitutes one of the main higher education markets in the Middle East region. Having now developed a highly comprehensive higher education sector, a result of the efforts to advance the higher education system following the Islamic Revolution in 1979, it is of no surprise that more than four million Iranians are currently enrolled in higher education institutions in Iran. Regardless of these developments, however, meeting the increasing demand for tertiary education has been a challenge leading to a large number of Iranians pursuing tertiary education opportunities overseas. This has created a vast and promising market for student importing countries, which has proved to be too difficult for international student recruiters to penetrate due to international sanctions imposed on Iran and local economic problems coupled with certain restrictions imposed internally by the ruling authorities. Despite the challenges of not being politically recognised as legitimate except by Turkey, North Cyprus has been one of the most popular destinations for Iranian students particularly in the last decade. Relative to its size, North Cyprus has proved to be one of the most internationalised higher education system in the world with more than 30,000 international students from more than 100 different countries and more significantly, Iranian students constitute one of the largest cohort. This chapter explores the student recruitment process from Iran with a specific focus on the external and internal challenges faced by the students as well as by the recruiters. North Cyprus is particularly evaluated as a case study to present how some challenges may have been overcome and student flow can be achieved even to a country that has been struggling against the externalities of international political non-recognition.

In this paper, we analyse how the national variety in professional organisation is affected by the current period of globalisation by reference to key features of the business law firm in the US, the UK and Germany. Our argument is that changes in law firms from these different countries are indeed intertwined with each other through a gradual process of legal globalisation but that they are not necessarily converging on a dominant US model. Rather we find evidence that new hybrid types of firms are arising in Europe out of a re-combination of elements of different national models.

This chapter develops a model of professionalism via a synthesis of three extant theories from the sociology of the professions literature. Nine components or conditions of the model are used to trace the historical development of public accountancy through an Early Era from 1850 to 1929 and a Modern Era from 1930 to the mid-1980s. The conclusion is that concerted efforts over an approximate 130 year period were needed for accountancy to achieve elite professional status in the eyes of the U.S. public. The question remaining is if accountants have forgotten the history lessons on what has been required to achieve and sustain elite professional status?

Abstract

Economic inequality in contemporary advanced societies is strongly tied to the variation in wages across occupations. We examine the extent to which this variation is captured by social class and occupational prestige and ask how the associations between class, prestige, and wages can be explained. On the basis of data from 11 countries in the European Social Survey (ESS) 2004, we find (a) that class and prestige account for a very large proportion of the occupational variation in wages; (b) that the tight links between class, prestige, and wages are strongly associated with the skill requirements of jobs but only weakly tied to other positional traits, including authority, autonomy, and scarcity; and (c) that these findings are highly similar in all countries examined. We conclude that the rank order of positions in the labor market is a social constant driven by efficiency requirements of work organizations rather than by the exercise of power. This iron law of labor market inequality clearly contradicts major class theoretical models, including Wright's and Goldthorpe's. In addition to empirically refuting contemporary class theory, we offer a number of more conceptual arguments to the same effect. At a macro level, however, power relations arguably affect the rate of economic inequality by determining the reward distance between positions in the constant rank order, as indicated by the large cross-national variation in wage dispersion.

Purpose: In this chapter, I critically examine how federal regulation and guidance impact gender policing and transgender inclusion within educational institutions.

Approach: I utilize feminist critical discourse analysis to examine the “Dear Colleague Letter on Transgender Students” and its underlying assumptions related to transgender inclusion and gender policing in institutions of education.

Findings: While the federal regulations and guidance currently in place protect some transgender individuals, they also re-stigmatize some transgender individuals by policing the acceptable ways of being transgender and reinforcing the gender binary.

Social Implications: I suggest other areas within the educational institution to address in order to achieve transgender inclusion.

Value of Paper: This chapter critically examines the logistics and effects of federal regulation on gender and transgender inclusion.
