Abstract

Doctors need to consider all kinds of traits and risk factors about a person in a treatment situation, while antidiscrimination law puts significant restrictions on what an employer can consider about a person in hiring. These two contexts – health care and the antidiscrimination-governed workplace – seem to adopt entirely incompatible conceptions of how to regard the person, and hence, what rights she is considered to deserve. Therefore, how can we make sense of the claim by fat acceptance advocates that doctors discriminate against them based on their weight? Even when little or no formal rights exist for fat citizens in either sphere, there are nonetheless transformative discourses available that cross-pollinate each context. Revisiting rights by bringing these two discordant contexts together helps illuminate problems of injustice that must be confronted in the future as we move toward a more universal and equitable health care system in which conceptions of rights must have some place.

Abstract

Purpose

This chapter analyzes the influence of inclusion, equal opportunity and antidiscrimination policies on the strength of diversity in a foreign firm domiciled in a developing country.

Design/Approach

It used a questionnaire to collect fact from the depth of employees’ experiences of diversity management in practice to understand its implication for the strength of diversity in the workplace. It questioned the nature of the constructs on diversity in line with the effect of equal opportunity in the workplace.

Methodology

The component factor analysis extraction method obtained valuable constructs from the stated dimensions of items in the questionnaire. The regression technique was used to analyze the influence of these constructs on the strength of diversity in the workplace.

Findings

The results revealed that inclusiveness is necessary to intensify the strength of diversity in foreign organization in a developing nation, with the need to deepen alternative equal opportunity policy and diverse work culture awareness. Power relations strategies foster staff welfare, but weaken compensation by merit heighten employees’ sentiments.

Limitations

Data were only collected from the companies head office; its branches were not covered.

Implications

Employees detect biases in equal opportunity policies beyond the guises of control power relation. Thus, besides a policy for diversity and inclusion in the workplace, an alternative equal opportunity policy is essential to intensify diversity.

Originality

It empirically probes foreign organizations in a developing country staff response to changes in the workplace due to the cautious implementation of inclusion, equal opportunity and antidiscrimination policies to foster diversity.

Abstract

Purpose

Focusing on an international trainee- and internship programme, this paper aims to propose a new framework that links organisational strategies regarding ethnic diversity with career competencies of the programme participants.

Design/methodology/approach

The paper adopts a case study design. It examines the interplay of the perspectives of the organisation, which is an Austrian bank, and of the programme participants, who are university graduates from South-Eastern Europe. It draws on the typology of diversity strategies by Ortlieb and Sieben (2013) and the categorisation of individual career competencies by DeFillippi and Arthur (1994).

Findings

The bank benefits from the programme participants’ competencies with regard to South-Eastern Europe and increased legitimacy gained from the public. Programme participants acquire many knowing-how, knowing-why and knowing-whom competencies, especially if the bank pursues a so-called learning strategy towards ethnic diversity. On the other hand, individual knowing-how competency supports an organisation’s antidiscrimination strategy, whereas knowing-why and knowing-whom competencies benefit the organisational learning strategy.

Research limitations/implications

Although the paper builds on a single case study and the ability to generalise is limited, the findings imply that future human resource development concepts should jointly consider the perspectives of both organisations and individuals.

Practical implications

Owing to their high strategic relevance, organisations should look into the competencies of skilled migrants and evaluate the critical resources they offer. Both organisational learning and an organisation’s strategic development are key concerns. The proposed framework helps to effectively design trainee- and internship programmes and simultaneously anticipate organisational and individual consequences thereof at an early stage.

Originality/value

The proposed framework concerning the interplay between organisational and individual perspectives as well as the regional focus on South-Eastern Europe present novelties.

Abstract

Legal and philosophical scholarship on religious education typically focuses on religious schools that challenge core liberal values. Religious schools that offer their students quality secular education, and whose religious character is mild, do not raise these concerns and have therefore evaded scrutiny thus far. This chapter argues that the latter kind of religious schools, which I call “creaming religious schools,” may have a negative effect on educational equality and should therefore be subject to restrictive legal regulation. The negative effect on equality is caused by the fact that when successful, these schools appeal not only to members of the religious community but also to non-member high-achieving students who leave the public schools (a process called creaming) thus weakening them. The chapter argues that the harm caused to public schools cannot be redeemed by alluding to the right to religious education because the religious justification for creaming religious schools is relatively weak. The chapter then examines several potential legal measures for contending with creaming religious schools: the antidiscrimination doctrine, which the chapter rejects, showing that it actually aggravates creaming, locating schools in disadvantaged neighborhoods, restricting tuition, reflective enrollment policy, and finally, the total prohibition of establishing creaming religious schools.

Abstract

Purpose

There is substantial evidence of discrimination at work across countries and powerful evidence that antidiscrimination laws can make a difference. This study examines the extent of protections from discrimination at work in countries around the world and which groups were best covered.

Design/methodology/approach

This study assesses legal protections in hiring, pay, promotions/demotions, terminations and harassment for 13 different groups across 193 countries using a database the authors created based on analysis of labor codes, antidiscrimination legislation, equal opportunity legislation and penal codes. Differences in levels of protection were examined across social groups and areas of work, as well as by country income level using Chi-square tests.

Findings

Protection from gender and racial/ethnic discrimination at work was the most common, and protection across migrant status, foreign national origin, sexual orientation and gender identity was among the least. For all groups, discrimination was more often prohibited in hiring than in promotion/demotion. There was inconsistent protection from harassment and retaliation.

Research limitations/implications

Addressing discrimination at work will require a broad range of synergistic approaches including guaranteeing equal legal rights, implementation and enforcement of laws and norm change. This study highlights where legislative progress has been made and where major gaps remain.

Originality/value

This article presents findings from an original database containing the first data on laws to prevent discrimination in the workplace in all 193 countries around the world. The study analyzes legal protections for a wide range of groups and considers a full range of workplace protections.

Abstract

It has been argued that the workplace and the labor market in general, by processes of education, mobility and competition, have become the main forces behind the individualization and atomization in societies and in people’s lives. This paper inquires into the tensions between solidarity, identity, and individualism among workers in their efforts to organize collective struggles to improve their workplaces and their lives. Drawing on the dilemmas of increased diversity in the new workplace, the paper delineates three models of organized labor: (1) The Universalist-Individualist model of organized labor, peaking at the New Deal crisis and embedded in National Labor Relations Act, as an attempt to establish universal solidarity, which suppressed differences and presented a unified worker voice; (2) The Separatist model, which emerges as a reaction to intragroup exclusion and involves fragmentation of workers into identity groups, each representing the interests of its members; (3) The Coalitionist-Altruist model, envisioned in the paper as a middle ground between solidarity and self-interest, through interrelated moves: a move from totalizing universal solidarity to coalitionist solidarity through continuous dialogue and “rotation of centers” and a move from rights-based identity politics and the dominance of employment antidiscrimination claims to a fuller substantive theory for social reform.

Abstract

Purpose

This paper is dedicated to labor discrimination, the most challenging and acute problem of the modern higher education system, which is one of the primary global concerns of the 21st century in higher education. This study aims to analyze the causes of discrimination in the higher education system of Georgia, to determine the priority types and forms of discrimination in the process of career management of personnel employed in educational institutions and to develop specific recommendations based on the successful antidiscrimination experience of developed countries, which will contribute to the development of an effective mechanism for eliminating discrimination in the higher education system of Georgia.

Design/methodology/approach

The statistical software package was used to process the data obtained during the research process. Throughout the analysis, numerous statistical techniques were employed, such as conducting an interview, running Mann–Whitney test, hypothesis testing, ANOVA test and much more. It is important to emphasize that various important hypotheses were developed during the research process. Finally, we presented conclusions and recommendations.

Findings

The study found that personnel discrimination is a severe, urgent and pervasive problem in Georgia. As a result of research, hypotheses N1, N2, N4, N5 and N7 were confirmed. In particular, the respondents’ discrimination is influenced by their field of employment; employees with low- and medium-level job positions are the most frequently discriminated against in both the private and public sectors; discrimination in both sectors has an impact on a person's work performance, personal life and health; weakening oversight of discriminatory issues leads to increased discrimination in both sectors.

Research limitations/implications

One of the disadvantages of the mentioned study is that it was only conducted in several Georgian universities. The results of the study can be generalized only to the employees of the universities participating in the study. In the future, research is planned in all universities in Georgia, which will give us a unified picture. In addition, it would be ideal to do international research with foreign colleagues to compare the described findings by country.

Practical implications

The authors anticipate that the mentioned study’s findings will have theoretical and practical implications. Universities must consider the recommendations presented, as doing so will significantly reduce discrimination and employee stress levels. As a result, their performance and sense of belonging inside the organization will improve.

Originality/value

This study is a novelty in terms of Georgian reality, as the discrimination exploration has not been investigated in the higher education. Therefore, all the interested parties, such as policymakers, institutions, scholars and far more, will benefit from the findings.

Promoting a “Culture of Peace” has always been one of the ultimate goals in the provision of education around the world, including Thailand. The concept of Education for International Understanding (EIU) has thus been developed since the “Peace Movements” following the 20th century’s world wars. Initially, the field encompassed peace education, international education, human rights education, citizenship education, and development education. Gradually, it has become an interdisciplinary, and multidimensional field of study encompassing other related themes including disarmament education, nonviolence education, education for conflict resolution, antidiscrimination education, gender equity education, multicultural education, global education, education for international cooperation, education for dialogue of civilizations, education for interfaith dialogue, values education, environmental education, education for sustainable development, and education for inner or personal peace. Moreover EIU, which formerly focused on the “international” dimension, is now concerned just as much with issues and problems “within” (intra) societies. This chapter examines the development of the concept and the implementation of EIU-related themes in Thai policies and curriculum. Survey research was conducted before and after the major political crisis starting in 2008. Survey questions include ability to identify national policy relating to EIU, perceptions concerning the objectives in implementing EIU and values highlighted within an EIU framework, teaching methods, experiences in studying/participating in EIU-related courses/activities, and problems in studying/participating in EIU activities. Some results from the study in 2007 are presented and compared with findings from following studies in 2010, 2012, and 2014.

Abstract

This chapter uses critical race theory (CRT) and postcolonial lenses to critique the postrace concept and organizational power differentials mirroring an ethnically coded society. CRT reminds us that despite antidiscrimination laws around the globe, employers still normatively pursue workplace homogeneity; not necessarily a racist impulse, but in an effort to promote perceived organizational efficiency. Understanding how organizations have become hard-wired to perpetuate White privilege helps to dismantle systemic barriers which continue to stand between people of color and an ability to reach their full human potential at work.

Understanding of power and difference in organizations requires consistent diligence. Using ethnic diversity primarily as a means for advancing profit generation motives rather than as an opportunity to advance social justice, too many multinational corporations offer mere lip service to ethnic diversity. For example, organizations tend to imagine that they are more ethnically diverse than they really are and enable prejudice, racism and microagressions against people who constitute ethnic minorities. Among social researchers, attention to ethnic difference requires careful and consistent attention as well. Because skin color ranks among the most visible of social identity dimensions, diversity and ethnicity/race erroneously are considered synonymous and skin color becomes some default condition for diversity in social research studies. Chapter 5 explores these important subthemes: interrogating Whiteness and navigating diversity at work; exposing the “requisite variety” concept for its homophily thesis roots; examining effects of “othering,” liminal spaces and tokenism; racism and microaggressions have gone underground; and intersectionality of ethnicity with other social identity dimensions.

Abstract

Purpose

This chapter explores the development of organizational narratives of identities for embodying the qualified jobseeker with disabilities in the French job market.

Methods/Approach

While the concept of “organizational narratives of identities” has primarily been used to study the access to services to individuals with “troubled identities,” my study looks at how organizational narratives are shaped in labor market intermediation for the professional integration of workers with disabilities.

Findings

In this context, fitting the right formula story goes beyond embodying the morally “deserving” target population in order to encompasses corporate-related expectations, such as demonstrating resilience and grit, as well as disclosure-related expectations, that navigates the contradictory injunction of the French antidiscrimination system to both demonstrate a commitment to diversity and to remain indifferent to differences.

Implications/Value

This chapter highlights the ways in which the cultural narratives surrounding disabled identities, workers’ identities, and the French cultural ideology of “indifference to differences” were translated into specific recruitment advice on the job market, as well as into organizational changes that favored the creation of a disability-friendly buffer zone in corporations: the activist disability manager. The chapter also shows how widely circulating cultural narratives shape, and are shaped by, organizational policies and procedures that can in turn shape personal experiences in the workforce.
