Abstract

Purpose

The purpose of this paper is to critically review the process of urban land ownership reform in China. It seeks to illustrate how the detachment of the concept of land ownership from its significance in a planned socialist state has contributed to the development of a real estate sector, and how the concept of land ownership should now be regarded in the new era of marketization. In particular, it focuses on the widespread influences of political forces in these processes.

Design/methodology/approach

The paper analyses relevant legislation enacted within the People's Republic of China. This analysis is undertaken within the context of the social, political and economic changes that have occurred within the country during the period under consideration.

Findings

Two findings emerge from the study. First, an economic‐based notion of land ownership has evolved in China as a consequence of the economic and social changes accompanying the process of economic liberalisation. This reflects the elimination of political forces in defining land values in the new era. Second, however, the involvement of political power in the process of land asset distribution is shown to have led to market distortion. This may, in turn, lead to market failure and social conflict. For the development of a healthy real estate market, the influences of these political forces should, therefore, be restricted through a process of ongoing reforms.

Originality/value

The paper presents a detailed analysis of the impact of political forces on the changed patterns of land allocation in transitional China. The country's unique social background and system of land tenure have not previously been subjected to detailed scholarly attention. The research published in this paper suggests further possibilities for China's continuing system of land ownership reform and also contributes to a redefinition of the concept of land ownership in the new era of marketization and globalization.

Abstract

Is China′s “land use rights” legislation which distinguishes transferable “land use rights” and inalienable “land ownership”, a novel concept unknown to human kind before, or a pragmatic reversion to the private property rights system abolished by the communist revolution? Advocates the view that the latter is a more correct interpretation. As part of a “going capitalist” economic reform programme, such a reversion is manifested in the legal recognition of the leasehold tenure after the “responsibility system” in privatizing agricultural production had proved to be successful. As the development of private property rights is a prelude to market transactions, the Chinese land use rights reform should be conducive to the success of the economic liberalization policy of China, provided that there is a contemporaneous advance in the development of the rule of law and technical know‐how, such as valuation and land surveying.

Abstract

Purpose

This paper aims to explore the possible uses of economic instruments, other than water tariffs, to assist water management policy in Brazil. In particular, the paper focuses attention toward markets for use rights.

Design/methodology/approach

The research is based on water resources specialists’ opinions and perceptions, collected through surveys (Delphi method) and a focus group, to understand if such an instrument is desirable and which roles could it play within Brazilian water basins.

Findings

Results suggest there is room and utility for markets for water use rights, although mostly on a temporary basis, localized, predominantly dealing with scarcity events and in conjunction with the other instruments under Brazil’s National Water Policy.

Originality/value

Given the persistence of scarcity events in the country, the research represents a first step to understand if new instruments for water management are politically feasible and contribute to better delineate future investigations applied to specific water basins and their local conditions.

Abstract

This study challenges contentions that rights are limiting through an analysis of grassroots rights talk in the LGBTQ (Lesbian, Gay, Bisexual, Trans, and Queer) community in the 1980s. I argue that rights talk can be an important source of constructing community within local, nonmainstream, noninstitutional spaces through a discourse analysis of a forum for LGBTQ community-building in the past: the letters to the editor columns in Gay Community News. This study enhances law and social movement scholarship on the role of rights in social movements by exploring how rights discourse is employed by everyday people in a noninstitutional community-building venue rarely addressed in contemporary research.

Purpose

The purpose of this paper is to examine the feasibility of adopting a market‐based land use model, Transfer of Development Rights (TDR), which is very popular in America and other countries as a positive land use control mechanism for conservation, in an evolving socialist land economy, namely China.

Design/methodology/approach

This paper utilizes a case study approach, supplemented by a cost‐benefit model, to estimate the feasibility of establishing a TDR model in Chongqing, China.

Findings

From the analysis, it is found that a market‐based land use mechanism can serve to maximize the benefits of all parties and can balance the interests between development pressures and conservation needs. However, this is based on a number of conditions, including: that a well‐developed legal framework should be set up, to clearly delineate property rights; that a good and enforceable planning system should be in place; and that a mature land market mechanism should be developed that allows open market prices to be realized in the trading of development rights.

Research limitations/implications

This case study is based on a hypothetical situation of one case. More data are needed to support the argument in the future.

Practical implications

Conservation is a major concern for the local governments in China, given the recent high speed economic growth. A model that can balance development pressure, while allowing the market to compensate fully for the infringement of property rights in the process of urban regeneration, is worthy of the authority's attention in future policy formulation.

Social implications

This paper shows that the society as a whole can strike a balance between the need for economic development and conservation of historic sites, provided some conditions can be met.

Originality/value

This paper fulfills an identified need to study the establishment of a market‐based land use model in the conservation policy of land in China.

Abstract

Purpose

The purpose of this paper is to examine the effect of perceived land tenure security in China on farmers' decisions to invest in relatively long‐term land quality improvement measures, taking into account the potential endogeneity of tenure security.

Design/methodology/approach

Data from a survey held in 2008 and 2010 among 259 households in Minle County, Gansu province, covering the years 2007 and 2009, are used to estimate the factors affecting land levelling investments, irrigation canal investments and perceived land tenure security. The authors use the 2SCML technique and the IVLS method to estimate a selection model and a non‐limited regression model, respectively, and use IVP methods to examine the robustness of the results.

Findings

The authors' results indicate that perceived land tenure security significantly affects self‐governed investments but does not affect individual investments in land quality improvements. In particular, the authors find that households that consider land certificates as important for protecting land rights invest significantly more in irrigation canals construction and maintenance. The authors' results further provide evidence that individual investments in land quality improvement contribute to higher perceived land tenure security.

Originality/value

The paper contributes to the available literature on the relationship between land tenure security and land investments by examining the role of perceived (instead of formal) land tenure security and by making a distinction between individual household investments and self‐governed land investments. The authors' results provide an explanation for the phenomenon that land readjustments still take place in some parts of China, but not in others.

Abstract

Purpose

The purpose of this paper is to analyze the relationship between farm size and agricultural production efficiency from the aspects of output and profit in order to find an optimal farm size that achieves both output and profit efficiency in agricultural production in China.

Design/methodology/approach

This study uses the 2012 China Family Panel Studies survey data and employs the stochastic frontier analysis (SFA) models to investigate empirically the relationship between farm size and agricultural production efficiency.

Findings

The study finds that there is an inverted-U curve relationship between farm size and output efficiency and a U-shaped curve relationship between farm size and profit efficiency in agricultural production in China. Based on the empirical results, the study estimates that the appropriate farm size is around 10–40 mu and the optimal farm size is around 20–40 mu both in terms of output efficiency and profit efficiency in Chinese agricultural production under the current agricultural technology and land management system.

Practical implications

The findings of this study suggest that appropriate land consolidation will bring more benefits to farmer households and agricultural production efficiency. There are some policy implications. First, governments should give long term and more stable land using rights to farmers through extending the period of land contract and verifying land using rights. Second, governments should encourage transfers of land using rights and promote land consolidation. But the implementation of this policy should consider regional differences and not be used for blindly pursuing increasing land size. Third, land consolidation should be accompanied with the development of specialized agricultural services.

Originality/value

The paper makes two major contributions to the literature. First, the authors use the SFA model to investigate the relationship between land size and agricultural production efficiency. Second, the authors establish two SFA models – the stochastic frontier output analysis model and the stochastic frontier profit analysis model – to estimate the optimal land size to achieve both output and profit efficiency of agricultural production in China.

Abstract

Purpose

The purpose of this paper is to investigate the economic relationship with recent changes in China’s land use policy and rural development through innovation and entrepreneurship.

Design/methodology/approach

The first issue of economic importance is in understanding the market value of land use rights (LUR) transactions. To examine this, the authors build an argument around the idea of economic and marginal rents from Ricardo. The second issue relates to the extent by which deepening the rural financial landscape by allowing the mortgaging of LUR will promote and advance much needed entrepreneurial activity. To explore this issue, the authors draw on Schumpeter. The empirical contribution is based on a survey of 1,465 farm households in Gansu, Henan, Shaanxi and Shandong provinces.

Findings

In an endogenous Two-Stage Least Squares model, the authors find a positive and significant relationship between a willingness to mortgage LUR and entrepreneurship, which suggest that the new policy may well meet that objective. However, the authors do not find that entrepreneurs alone will have a willingness to mortgage LUR; non-entrepreneurs – traditional farmer types – would also be willing to mortgage LUR, but with a caveat that either group already has a disposition or demand for credit.

Originality/value

The value of the analysis is to provide an evidence to understand the market value of LUR transactions and to study the relationship between mortgage of LUR and entrepreneurial activity.
