Abstract

This paper illustrates how two contemporary economic traditions - New Institutional and Austrian economics - may be used to add insight into the organization and governance of public sector investment programs. When combined, these frameworks offer a theoretical foundation that may be used for purposes of assessing relative levels of agency and transactions costs within different institutional settings. The insights provided suggest that one option for reducing these costs is to “outsource” the public sector investment function. The theories explored in the paper are not panacea for dealing with agency and transaction costs, but they do draw attention to key institutional characteristics that influence their size.

Abstract

Purpose

The paper aims to explore the links between corruption and accounting in the public procurement setting. In particular, it investigates how accounting can fight or facilitate corruption

Design/methodology/approach

The study takes a qualitative approach, analyzing one of the worst recent Italian cases of corruption, the “MOSE” trial. Documents produced during the trial are analyzed.

Findings

The findings contribute to our understanding of how the (mis)use of accounting can help to build a “sustainable” corruption network, and be used to create, maintain and share corruptive cash flows. Participating actors can use accounting tools to coordinate their actions and organize their misconduct. Accounting may also reveal the existence of such networks, however, by enabling the fiscal police to discover tax fraud, and by reconstructing how a corruption network functions from records kept to manage internal cash flows and the provision of other benefits.

Practical implications

Because corruption is a worldwide phenomenon, a better understanding of how it functions may lead (among other things) to the identification of more effective prevention measures. Particular attention should be paid to events that favor corruption, such as extraordinary occurrences, huge amounts of public resources and new institutional structure without appropriate control and balance tools.

Originality/value

Given the specific features of episodes of corruption, qualitative studies on this topic are scarce. Little is known about corruption processes, and even less about the part that accounting can play in them. The MOSE case offers some intriguing insight, showing how accounting can be used to build a “sustainable” corruption network by collecting slush funds and facilitating benefit-sharing among individuals.

Abstract

The Foreign Corrupt Practices Act (FCPA) of 1977 and its amendment – the Trade and Competitive Act of 1988 – are unique not only in the history of the accounting and auditing profession, but also in international law. The Acts raised awareness of the need for efficient and adequate internal control systems to prevent illegal acts such as the bribery of foreign officials, political parties and governments to secure or maintain contracts overseas. Its uniqueness is also due to the fact that the USA is the first country to pioneer such a legislation that impacted foreign trade, international law and codes of ethics. The research traces the history of the FCPA before and after its enactment, the role played by the various branches of the United States Government – Congress, Department of Justice, Securities Exchange commission (SEC), Central Intelligence Agency (CIA) and the Internal Revenue Service (IRS); the contributions made by professional associations such as the American Institute of Certified Public Accountants (AICFA), the Institute of Internal Auditors (IIA), the American Bar Association (ABA); and, finally, the role played by various international organizations such as the United Nations (UN), the Organization for Economic Cooperation and Development (OECD), the World Trade Organization (WTO) and the International Federation of Accountants (IFAC). A cultural, ethical and legalistic background will give a better understanding of the FCPA as wll as the rationale for its controversy.

Abstract

Purpose

The purpose of this paper is to analyze Japanese police corruption and assess the effectiveness of the police reforms to minimize it.

Design/methodology/approach

This paper focusses on police corruption in Japan by analyzing its causes and evaluating the effectiveness of measures to prevent it. The paper concludes with some recommendations for minimizing police corruption in Japan.

Findings

Even though recent preventive measures in Japan initiated through police reforms have reduced opportunities for police corruption, it is still necessary to improve public trust in the police. The Japanese police do not initiate anti-corruption measures, but focus instead on prevention through ethics training and reliance on stringent regulations. Fostering a civil society coalition for monitoring police corruption, conducting public perceptions surveys of corruption and bringing police corruption studies into academic discussions are tools for tackling police corruption.

Originality/value

This paper will be useful for scholars, policy-makers and anti-corruption practitioners interested in learning how the Japanese police prevent corruption.

Abstract

Purpose

“Corrupt practices” is a recurring feature of media coverage. The paper seeks to encourage debates about the influence of institutional structures on agency to break away from methodological individualism. This paper aims to encourage reflections on the role of both the structures and actors which have shaped the continuous expansion of corrupt practices in Nigeria.

Design/methodology/approach

Whilst recognising that deviant behaviour by some individuals is always possible, this paper has rejected methodological individualism and shows the value of locating anti-social practices within the broader socio-political and historical context. Within a socio-political framework, this study adopts the theories of critical realism, developmental state and globalisation to understand the relationship between social agency and society, focusing upon the institutional structures and the role of social actors.

Findings

The evidence shows that socio-political and economic development, politics, power, history and globalisation have continued to reproduce and transform the institutional structures and actors which have facilitated anti-social practices in Nigeria. The paper concludes that large sums of government revenue have been undermined by the anti-social practices of the Nigerian political and economic elite (both local and international), which have enriched a few, but impoverished most, Nigerians.

Practical implications

As a consequence of recurring corrupt practices in Nigeria, there is a pressing need for reform to curb these practices which have had, and continue to have, a serious effect on Nigeria and its future development.

Originality/value

It provides a framework for understanding and explaining the inter-relations of actors and institutional structures and the linkages and influences that have shaped the practices in Nigeria.

Abstract

Purpose

Contemporary literature has paid scholarly attention to financial criminal practice from a variety of competing perspectives. However, this paper seeks to encourage reflections on some questionable practices of the political and economic elite which increase their capital accumulation but harm citizens.

Design/methodology/approach

Within a socio‐political framework, this study adopts the theories of the developmental state and globalisation in order to understand the relationship between social agency and society, and focuses on the institutional structures and the role of social actors.

Findings

The paper used publicly available documents to construct case studies to provide some evidence of the strategies and tactics used by political elite to facilitate their capital accumulations. Evidence is provided to show that large sums of government revenue have been undermined by the financial criminal practices of the Nigerian political and economic elite (both local and international), which have enriched a few, but impoverished most, Nigerians.

Practical implications

Financial criminal practices have played a major role in causing serious damage to the economic and social landscape of Nigeria, which in turn, has undermined social welfare and also investment in the public services, thereby eroding the quality of life and producing a decline in average life expectancy. As a consequence of recurring corrupt practices by the political and economic elites in Nigeria, there is a need for reform in order to curb the practice which has had and continues to have, a serious effect on Nigeria and its future development.

Originality/value

Broader accounts of the impact of financial criminal practices on development in developing countries are relatively scarce. Previous studies have tended to individualise the problem.

Abstract

During the 2020 election cycle, 2,276 super PACs spent over $2.1 billion in federal elections. This chapter argues that changes made to the US campaign finance system brought about by the Citizens United v. FEC (2010) and SpeechNow.org v. FEC (2010) cases have destabilized the American political system by fueling tensions between right-wing and left-wing populist factions and by contributing to congressional corruption. By moving away from the political corruption standard and toward the free speech standard in Citizens United, polarizing wealthy mega-donors and dark money sources have come to play a dominant role in congressional elections. These cases also helped to contribute to a two-tiered campaign finance regulatory structure that distinguishes between campaign contributions given directly to federal candidates and political money contributed to super PACs to support or oppose federal candidates. In the 2020 congressional elections, PACs and super PACS outspent both major party candidates combined in 35 House and Senate races. Super PACs are serving as “shadow parties” by targeting competitive races for the purpose of swaying partisan control of Congress. This study also shows that an exceedingly high percentage of super PAC money is spent on negative advertising that further divides rather than unifies the nation. This chapter also highlights the corrupting influence of congressional leadership PACs and examines how super PACs have enabled foreign and dark money sources to illegally influence congressional campaigns.

Abstract

The presence of political corruption possibly predates the historical record. For years, it was viewed as an artifact of political development, a common malignancy that nations would naturally reject as a function of their respective national maturations; this was one of the underlying theses of the American progressive movement. However, this cleansing has been neither as straightforward nor as natural as its proponents would argue. An anti-corruption coalition established in the 1990 under the umbrella of Transparency International (TI) has brought a new light on the world of political corruption. TI annually publishes a Corruption Perception Index that in 2001 ranked over 90 nations in terms of their perceived political corruptions. Peter Eigen, the TI Chairman, observed that “There is no end in sight to the misuse of power by those in public office – and corruption levels are perceived to be as high as ever in both the developed and developing nations” (Transparency International Press Release, 2001).1

Purpose

The purpose of this paper was to assess the similarities and differences between the Political Parties and the Access to Information Acts in Malawi. While political parties are largely funded by donations that are frequently kept as a secret, the Access to Information Act does not include political party funding among the categories of non-disclosed information.

Design/methodology/approach

This paper is based on the qualitative content analysis of the legislation in Malawi. Content analysis of the two pieces of legislation was adopted. This paper is a review of the literature and an examination of Malawi's Political Parties and Access to Information Acts. The document study was supplemented by a review of related literature on the two legislations.

Findings

The Political Parties Act prohibits the government, ministries and departments from directly or indirectly funding political parties. The Access to Information Act to ensure information generated by Malawi government ministries, departments and agencies is readily made available by the citizens when needed or requested. The Access to Information Act does not exempt political parties from disclosing their funding sources. The two acts work in tandem to promote accountability and transparency in political party funding and sources.

Research limitations/implications

This study is limited to Malawi's Political Parties and Access to Information Acts. Only the South African related acts have informed the paper. However, several acts within developing countries would have greatly aided the paper.

Practical implications

The implementation of the two pieces of legislation has implications for the balance between disclosure and non-disclosure of political party funding. Oversight functions and credible human resource capacity are needed in both political parties and government enforcement institutions.

Social implications

Oversight functions by the Administrator-General through the Registrar of Political Parties and the Malawi Human Rights Commission are key to the implementation of Malawi's Political Parties and Access to Information Acts, respectively. Proper enforcement of the oversight functions is expected to result in an open, transparent and accountable Malawian society.

Originality/value

Various players are needed in the accountability chain to protect disclosure and non-disclosure of information. Very little information is known on the powers, functions and duties of office bearers capable of enforcing legislation to keep political parties' funding clean. Little is known on how the citizens can access information regarding political parties funding.
