Abstract
Purpose
The purpose of this article is twofold; to verify the existence of different profiles of firms based on the level of sophistication of their patent management core processes and to test the impact of the interplay between two patent management supporting dimensions, namely patent strategy and organization for patenting, on the level of sophistication of patent management core processes.
Design/methodology/approach
The method consists of a survey study, collecting data from a set of European patent management professionals. These data are analyzed with factor analysis, cluster analysis and regression analysis to test several hypotheses.
Findings
The results show that patent strategy positively and significantly impacts patent management sophistication, and that the patent organization positively moderates this relationship. In other words, a patent strategy, supported by a well-developed patent organization and culture, will positively influence the processes of managing a firm's patent portfolio.
Originality/value
This study is, to the authors’ knowledge, the first one to provide quantitative evidence that supports the notion that it is important to take a strategic and organizational perspective of patent management.

Purpose
The development of oil shale has become a popular technique in the energy industry in recent years. Although more research attention has been paid to this topic, there are scanty studies on patent portfolios. This study aims to explore this current mainstream technique and the patent portfolios of oil shale developers and investigates the major assignees at present to find the technical development trend of oil shale as a reference for government, policy makers, investors and industrial strategic development.
Design/methodology/approach
This study applies correspondence analysis and K-means clustering analysis on data mining and probes into the competitive techniques and strategic groups of the main enterprises in the oil shale industry. In addition, by approval dates, this study analyzes technical directions and the development trends of the current main oil shale enterprises.
Findings
The findings show differences in the enterprises regarding technical positions and patent portfolio strategies.
Originality/value
Differential positioning analysis suggests the relative technical advantages of the various enterprises and evaluates the competition among oil shale enterprises.

Abstract
Purpose
In the intellectual property (IP) and management literature, the question of how external patent attorneys impact patent filings has been understudied. The purpose of this paper is to advance this area of research by examining how the use of external patent attorneys influences the patent filing strategies of firms and what impact firms’ level of experience with the exclusive use of in-house resources has on filing strategies. This study, thus, provides insights into the strategic dimension behind patent filing, a process which is affected by patent attorneys’ work and decision-making processes.
Design/methodology/approach
The econometric analysis is based on a patent database of 922,553 patents which is combined with an EPO patent database covering applications from 1990 to 2010. The authors test the hypotheses for this study using patent indicators addressing the impact of in-house firm experience vs the use of external patent attorneys on firm’s filing strategy.
Findings
This research finds empirical evidence that external patent attorneys’ work has an effect on patent scope, international scope, and patenting speed. Moreover, it can be shown that external patent attorneys have a positive impact on most filing dimensions, such as patent scope, international scope and the Patent Cooperation Treaty option, whereas the level of in-house firm experience has a negative impact on most filing dimensions. This implies that external patent attorneys seem to pursue a “maximization approach” while experienced firms seem to pursue a more differentiated approach to filing patents, for instance, drafting narrower and more focused patents.
Practical implications
The study suggests that effective filing strategies require an integrated approach between diverse IP stakeholders. More particularly, filing strategies should be communicated and aligned between all actors, including external patent attorneys in order to achieve the targeted patenting output.
Originality/value
The current study develops a patent filing typology, which accounts for patent attorneys’ decision options. In providing insights into patent attorneys’ work and their impacts on intellectual property rights management, the study is a useful complement to prior research, which has predominantly focused on applicants or examiners.

Abstract
Purpose
This study aims to ascertain whether technological diversification (TD) enhances firm performance and explores the effect of patent portfolio balancing (PPB) on firm financial performance and the moderating role of research and development (R&D) intensity.
Design/methodology/approach
This study empirically investigates a panel dataset based on 296 information and communications technology (ICT) small and medium-sized enterprises (SMEs) over 5 years, using a fixed-effects panel regression with time-lagged and moderating effects. Data are collected from a government survey and a firm and patent database.
Findings
The relationship between PPB and return on assets (ROA) is negative, indicating that TD in SMEs adversely affects firm performance. R&D intensity positively moderates the relationship between PPB and ROA, implying that follow-up R&D after creating new patents could weaken the negative relationship between TD and firm performance. This moderating effect only occurs when R&D intensity is sufficiently high, suggesting that high R&D firms could be more successful at diversification.
Practical implications
As TD consumes many resources, managers should set the optimal level of diversification and recognise the need for follow-up R&D for successful diversification.
Originality/value
This study conceptualises a unique theoretical framework for the PPB of ICT SMEs, revealing the moderating role of R&D intensity in changing the negative influence of PPB on firm performance.

Abstract
Purpose
Given the changing role of patents within enterprises, this research aims to investigate the link between patent management and technological innovation performance in Chinese high‐tech enterprises. Also, from theoretical underpinnings this study highlights the managerial implications of effective patent management which will lead to enhanced technological innovation performance.
Design/methodology/approach
Hypotheses related to patent management and technological innovation performance in Chinese high‐tech enterprises have been developed based on a review of the literature and related field interviews. Data has been collected from 118 high‐tech enterprises using questionnaires and analyzed using regression and SEM analysis.
Findings
Patent acquisition has a positive impact on both protection and commercialization of patents. Considered together, the combination of patent acquisition and commercialization has a positive impact on technological innovation performance in high‐tech enterprises. While patent protection positively affects patent commercialization, it has no direct effect on economic or societal performance. Therefore, the key factors to enhance the link between patent management and technological innovation performance of Chinese high‐tech enterprises are effective patent acquisition and subsequent commercialization.
Originality/value
From a resource‐based view, this paper delineates the concept of patent management and validates the link between patent management and technological innovation performance. To the authors' knowledge, it is a relatively new perspective to explore patent management based on a micro‐level.

Purpose
This paper aims to provide suggestions for the identification of potential new applications for the existing products and/or technologies.
Design/methodology/approach
A nine-step method has been developed for extracting information about a product or technology, processing the international patent database (IPD) and extracting useful hints for potential new applications. An academic case study has been used to perform the first application of the proposal.
Findings
A novel approach for processing IPD aimed at supporting the identification of new opportunities for exploiting existing products/technologies. The case study application shows that the proposal allows to extract potentially useful and non-obvious suggestions for new product applications.
Research limitations/implications
Although some limits inevitably affect this preliminary version of the proposal, important hints for future developments have been inferred for a more comprehensive exploitation of both the firm internal knowledge and the suggestions provided by the international patent database.
Practical implications
The achieved results can support firms in expanding market opportunities for their products or technologies.
Originality/value
The proposed approach offers a new structured path for stimulating idea generation for new product applications, by exploiting product information and the cooperative patent classification.

The study demonstrates significant relationship between national culture and KM process. Further, it also provides directions for future research.
Practical implications
The study will help top management to understand and appreciate the impact of national culture on KM process in organization, where people from different nations are working together. The management may apply appropriate organizational interventions to manage people of different national cultures in effective manner and effective utilization of knowledge of the organization through KM process. This paper will be considered as a quick reference and resource for anyone interested in this area.

This study is a comprehensive literature review of influence of national culture on KM process. Further, it also sets the research agenda for future researchers.

Purpose
This paper aims to offer an understanding of the actions which facilitate the open innovation achievement in companies from the management of their human capital. Although innovation contributes to keep competitive advantages in time, small and medium-size enterprises (SMEs) hardly innovate because of the high expenses involved. The current problems also demand solutions that incorporate characteristics which are responsible for both the environment and society.
Design/methodology/approach
The actions in the study are called “Detonating factors of innovation,” and they obey the practices taken from a thorough exercise of systematic review on the previous scientific literature in the ISI Wok and Scopus databases for the period 2007-2019. Articles associated with open innovation and organizations were also reviewed, along with those containing detonating factors.
Findings
Human capital is exposed in this study as the primary and fundamental resource of any organization with the capacity to modify and impose the social and environmental factors in the solutions to global problems process. Thus, it was found that the detonating factor is linked to the selection of employee profiles, training, resource availability, incentive models, communication and work environment.
Originality/value
Open innovation literature is based more on large companies than on small ones, and in almost no case is it sought to be a tool for social development, but for technological development. The contribution of this study allows the advancement in the state of the art and also serves as an instrument to inspire SMEs to associate for innovation purposes, apart from including socially and environmentally responsible characteristics.

Purpose
Several causes may induce firm managers to analyze the actual technology condition of patent portfolios, among which is the need of exploiting patents strategically. In this paper, the question of how to support intellectual property (IP) managers of large high technology companies in their strategic decision-making process of evaluating patents is examined. The purpose of this paper is to provide a decision support framework that suggests the suitable exploitation strategy for patents.
Design/methodology/approach
The paper proposes an audit framework able to point out whether patents are aligned to the overall business strategy, to select those that are not aligned, and to identify the most appropriate exploitation strategy for each patent of the portfolio. The framework is structured into two phases: in the first one, patents are selected through the analysis of four dimensions that characterize the value of patents effectively; in the second one, a questionnaire is distributed to IP managers in order to support their decision on patents. The paper illustrates case-based applications of the framework.
Findings
Results of applications show that the framework is able to suggest IP managers the suitable exploitation strategy on four possible alternatives (maintaining, licensing, selling, abandoning) for each patent of their portfolios.
Originality/value
The framework is an innovative and valuable tool to IP managers, and besides its structural formulation, it is appreciable in terms of application expedition and efficiency of performance.
