Abstract

Purpose

The purpose of the chapter is to study the possibilities of systemic intellectual support for managerial decisions in modern business systems and perspectives of authomatization of this process on the basis of intellectual technologies.

Methodology

The methodology of the chapter includes the methods of systemic and problem analysis, analysis of causal connections, modeling, and formalization.

Conclusions

Advantages of usage of technologies of intellectual support for decisions in modern business systems are substantiated; they are connected to multitask character, full determination of possibilities and problems of the business system regardless of employees’ involvement in this process, and “scale effect” during making of managerial decisions. Also, drawbacks of intellectual support for decision-making in modern business systems are determined: incompleteness of authomatization of the process of making of managerial decision, foundation primarily on digital data, necessity for complex digitization of the business system, and the problem of security of digital data and intellectual technologies.

Originality/Value

Large opportunities of systemic intellectual support for managerial decisions in modern business systems and wide perspectives of almost full authomatization of this process on the basis of intellectual technologies, accessible at all stages of the process of decision-making, are determined. For this, an algorithm of complex intellectual support for decisions in a modern business system is offered. The obtained results allow determining intellectual technologies of support for managerial decisions in modern business systems as a perspective direction of improving this process.

Abstract

This chapter asserts the theoretical importance of a relational approach for examining the historical development of civil rights for people with intellectual disabilities. A relational approach examines contestations over rights as embedded within and across various groups, settings, and times. Through this approach, we see, first, that struggles over rights are primarily struggles over “relational visions,” or the desired relational structure across groups. Second, rights for people with disabilities intersect with rights for other minority groups, and therefore, we must examine the broader stratification and relational structure. Third, rights developed differently depending on relational setting. Finally, rights have been used as “technologies of power,” requiring “normative” behavior for inclusion. Overall, a relational approach provides a set of concepts and a theoretical framework that furthers our understanding of citizenship for people with intellectual disabilities as it transformed through time and as it developed alongside citizenship for other populations.

The emergence of an evidence-based medicine logic represents a major change in the large and complex field of American healthcare. In this analytical case study, the authors show that the intellectual school of evidence-based medicine became an important meso-structure that facilitated the growth of the new logic in American healthcare. The new intellectual school was a community of scholars who generated shared rules and resources through intergenerational mentoring. The school engaged in advocacy to advance new intellectual paradigms for conceptualizing healthcare quality that, when connected with material practices in the field of American healthcare, came to form a new institutional logic.

For students with intellectual disability, assessment is used to evaluate individuals as having an intellectual disability (e.g., intellectual functioning assessments and adaptive behavior assessments), as well as to guide instruction and making decisions about what to teach. Throughout this chapter, the authors present assessments related to the determination of individuals having intellectual disability as well as ones that inform, guide, or evaluate instruction for students. Abstract

The transformation from an industrial to a knowledge economy and society are underway. In the knowledge economy, the knowledge of people and organizations—their intellectual capital assets—are the primary factors of production and the source of wealth. This is in contrast to other kinds of capital that fueled the industrial and the agricultural economies. Librarians have understood the knowledge society as one characterized by an increased focus on digital resources and an expanded use of virtual channels to deliver those resources. However, the nature of the knowledge society and economy is far more expansive than a digital environment. A knowledge society is one in which all members of a society engage in knowledge transactions—in the business environment, in the social sphere, in civic activities, and in everyday environmental actions. This view of the knowledge society presents new opportunities for librarians to leverage their intellectual capital. This chapter profiles the intellectual capital assets of librarians, considers how they align with professional competencies, and presents use cases that illustrate the value of these assets. Future scenarios illustrate how traditional functional competencies might shift in the knowledge economy. These also suggest contexts which highlight undervalued or new competencies. Seven observations describe how librarians might prepare for expanded roles in the knowledge society.

This paper focuses on two related questions at the intersection of antitrust and intellectual property law. First, under what circumstances must the holder of a patent or a copyright or the owner of a trade secret allow others to use that intellectual property? Second, under what circumstances can the holder of an intellectual property right use that right to make it difficult for another party to succeed in a related market? These questions have vexed antitrust and intellectual property scholars alike ever since the Federal Circuit ruled in 2000 that patent holders “may enforce the statutory right to exclude others from making, using, or selling the claimed invention free from liability under the antitrust laws,” a ruling that directly contradicted the Ninth Circuit ruling that antitrust liability could be imposed for almost identical conduct, depending on the motivations of the patent holder. The various proceedings in United States v. Microsoft only added fuel to the firestorm of controversy.After briefly retracing the jurisprudential path to see how this situation arose, we propose a solution that primarily involves a variation on the real property concept of adverse possession for the intellectual property space along with a slight extension of the Essential Facilities Doctrine for industries that exhibit network effects. We examine, both for firms with and without market power, how our proposal would resolve the situations presented by large fixed asset purchases, the introduction of entirely new products, and operating systems with network effects. We also demonstrate how our proposal could be applied in the European antitrust enforcement context.

Abstract

The research focuses on determining the prospects for improving the practice of accounting, reflecting in International Financial Reporting Standards (IFRS), and managing intellectual property objects in Uzbekistan based on international experience. Using data from the World Bank's 2022 statistics and regression analysis, the authors model the impact of a set of managerial measures on the manifestations of creating and applying intellectual property objects. The authors conclude that nonfinancial measures are preferable, with human resource management (HRM) in research and development (R&D) being a prospective choice for managing the creation and application of intellectual property objects. The theoretical significance lies in justifying the need to reflect an expanded list of intellectual property objects in IFRS. The research also justifies the conditions for effective management of intellectual property objects, that are a rejection of financial measures and reliance on and active use of nonfinancial management measures. The managerial significance is reflected in the newly developed nonfinancial approach to accounting, reflecting in IFRS and managing intellectual property objects. This approach can enhance the efficiency of such management in knowledge-intensive and high-tech industries, unlocking the potential of IFRS to support the development of the knowledge economy. The practical significance lies in offering author recommendations for improving the practice of accounting, reflecting in IFRS, and managing intellectual property objects in Uzbekistan. Implementing these recommendations in the practice of IFRS and corporate accounting in Uzbekistan could propel the country toward a leading model in the knowledge economy and strengthen its position in global high-tech markets.
