Abstract

In the course of the 2000s Denmark has experienced a shift in drug policy in general and of cannabis policy in particular. Danish drug policy used to be known as liberal, but is now saturated with ‘zero‐tolerance’ and ‘tough on crimes’ rhetoric. What happened, and what have the consequences been? This article describes recent changes, focusing on the closing of Pusher Street in Christiania, Copenhagen, one of northern Europe's largest open cannabis markets. This most spectacular outcome can also be seen as a conquered symbol of a former liberal ‐ and for many too lenient ‐ drug policy.

Abstract

The Swiss drug policy once was very progressive in the 1990s when the harm related to drug use was most visible to the public. Failure of repression opened the room for more innovative harm reduction approaches. In 2008, the four-pillar model including the legal basis for substitution and heroin-assisted treatment of opioid use disorders as well as for other harm reduction facilities was approved by the population that had learned about the success of these measures. Less violence, better health outcomes among people who use drugs and less stigma supported the change of attitudes in the population towards a public health-based approach when dealing with drug use. Switzerland first received heavy criticism for the autonomous policy change at the international level while it is nowadays often cited as best practice example for dealing with people with an opioid use disorder. Otherwise, the country has usually been quiet in drug policy discussions at the UN level. Nevertheless, Switzerland’s reappointment to the Commission on Narcotic Drugs, the central drug policy-making body within the United Nations for a period of four years starting in 2018 is promising, given their unblemished recommendation for human rights-based drug policies including the abolition of the death penalty for drug offences, among other things. Alongside cannabis policy changes at the international level, Switzerland witnessed an unexpected development in cannabis availability and sales. However, the country is still rather conservative with regard to current cannabis policies, although cannabis with less than 1% of THC can be sold legally and the possession of up to 10 g will be followed by a fine only, if at all. Switzerland is open to experiment with new regulations but only if the law allows for that. To conclude, the strong sense of connectedness with the international community may support Switzerland’s next steps towards public health and evidence-based harm reduction.

Abstract

This chapter looks at the past, present and future of international cannabis control required by the UN drug control conventions in the post-2016 United Nations General Assembly Special Session era with an eye on the next High Level Ministerial Segment (HLMS) at the UN Commission on Narcotic Drugs in 2019, and beyond. From a policy analysis perspective, the author meanders through the increasing tendency to legally regulate recreational cannabis markets notwithstanding the obligation enshrined in the UN drug control conventions to limit cannabis exclusively for ‘medical and scientific’ purposes. Taking into account relevant national and international developments, the chapter describes how the growing discomfort with the status of cannabis and the prohibitive and punitive approach stemming from the international drug control regime went through a process from soft to hard defections of the treaty obligations. The case of the Netherlands demonstrates the difficulty faced by reform-minded states in reconciling their wish for a different cannabis control mechanism with their obligations under international law, resulting in an incomplete regulation of its coffee-shop system, where small amounts of cannabis are tolerated for sale, but where the illicit supply to the shops remained unregulated. Subsequent more wide-ranging reforms to regulate cannabis from seed to sale in Uruguay, several US States and – in 2018 – in Canada, are clearly violating the obligations of the UN drug control conventions. Nevertheless, the HLMS will likely leave the elephant in the room untouched. The emerging paradigm shift regarding cannabis shows that a modernisation of the UN drug control regime is long overdue. This chapter discusses some of the options available.

Abstract

Both Bolivia and Uruguay broke ranks with the global drug prohibition regime by introducing novel drug policies. State control of the production and supply of coca and cannabis represents a clear departure from both the spirit and the letter of the international drug conventions. Although, the rationale, processes and outcomes of policy change were distinctive in many regards, this chapter posits that there are conceptual resemblances. In both countries, the leadership of a charismatic and idiosyncratic president has to be considered. Furthermore, in both countries, mobilisation and activism were also decisive. Lastly, in both countries novel drug policy responded to specific problems that decision-makers faced. Approaching drug policy reforms in Bolivia and Uruguay in terms of personal leadership, mobilisation and policy problems provides a useful analytical first-cut to assess the continuity and change in drug policy observable elsewhere. Additionally, scrutinising the reasons and motivations for undertaking drug policy reform also allows to better understand each country’s behaviour on the international stage.

Abstract

Purpose

Public support for various policy options for managing cannabis in the Caribbean and the characteristics of those most likely to support specific policy options remains largely unknown. The purpose of this study is to investigate the impact of age, sex and employment status on the public attitudes towards the full legalisation of cannabis, partial legalisation (that is for medical or religious purposes) or its continued prohibition.

Design/methodology/approach

Using secondary data collected from nationally representative public opinion polls conducted by Caribbean Research and Development Services from 2016–2018, this paper compares the public attitudes towards cannabis in Barbados, St. Vincent and the Grenadines, St. Lucia, Antigua and Barbuda and Dominica using a multinomial logistic model.

Findings

Support for the continued prohibition, legalisation or partial legalisation of cannabis varied significantly by age, employment status and country of residence. Women, people over 51 years of age and the employed were more likely to support full prohibition. Attitudes towards cannabis policy in the Caribbean are by no means homogenous, neither are the policy shifts occurring across the region, with some of these changes occurring slowly and not necessarily reflective of cultural dynamics.

Originality/value

This study is unique in its cross-country analysis in the Caribbean and providing valuable insight into the levels public support for cannabis legalisation. Its findings can help shape targeted public education in these countries.

Abstract

Purpose

Motivated by upper echelon theory, this paper aims to examine the association between gender and the cannabis industry in the USA from both policy and an organizational perspective.

Design/methodology/approach

This paper examines two novel data sets in two legal adult-use cannabis states. First, it examines how city council gender diversity relates to city opt-out measure decisions, barring cannabis operations and forgoing related tax revenues. Second, it examines how management gender diversity relates to organizational performance.

Findings

Results suggest that, from a policy perspective, cities with higher council gender diversity are less likely to propose an opt-out measure to city taxpayers. From an organizational perspective, results suggest that female representation at the highest level is associated with higher sales in the retail sector of the cannabis industry.

Research limitations/implications

Findings are somewhat limited by data availability and may not be generalizable to all adult-use legal states. While the study recognizes the possibility of self-selection bias in the results, robust analyses is performed to limit this possibility. Finally, while the study wholly recognizes that gender is not binary, it is limited to a binary gender variable based on the gender recognition software used in this study. It is also understood that this may not accurately capture the richness of a more inclusive examination of gender.

Practical implications

Results from this study inform communities on the impact of city council gender diversity on policy outcomes and related tax revenue levels. Further, results inform the adult-use cannabis industry on benefits derived from executive-level gender diversity.

Social implications

Evidence suggests that gender diversity has a significant impact on the adoption of legalized adult-use cannabis policy. Social benefits from legalization potentially include increased revenues from taxes, decreased spending on cannabis enforcement, decreased health costs and decreased drug-related violence. Many of these benefits substantially impact communities disproportionally burdened by former prohibition. Additionally, the results indicate that gender is associated with the level of sales within cannabis organizations, generating debate about the possibility of economic performance in the absence of historical executive gender barriers.

Originality/value

This paper provides an initial empirical examination of gender diversity within and around the rapidly evolving adult-use cannabis industry in the USA.

Abstract

Purpose

International policy approaches to cannabis production and use are changing rapidly, and within the Irish context, alternatives to prohibition are being considered. This study aims to explore policymaker’s attitudes towards the decriminalisation and legal regulation of cannabis for recreational use in the midst of an unfolding policy process, examining the degree which a “policy window” might be open for the implementation of cannabis policy change.

Design/methodology/approach

Semi-structured interviews were held with eight key informants within the policy field in Dublin, Ireland. Kingdon’s (2014) Multiple Streams framework was used to consider whether the problems, policy and political streams were aligning to support progressive policy change.

Findings

Irish policymakers indicated broad support for the decriminalisation of cannabis. The legal regulation of cannabis received more qualified support. Existing policy was heavily criticised with criminalisation identified as a clear failure. Of particular interest was the willingness of policymakers to offer opinions which contrasted with the policy positions of their organisations. While a policy window did open – and close – subsequent governmental commitments to examine the issue of drugs policy in a more deliberative process in the near future highlight the incremental nature of policy change.

Originality/value

This study provides unique insight into the opinions of policymakers in the midst of a prolonged period of policy evolution. A latent aspiration for historical policy change was situated within the realpolitik of more traditional approaches to policy development, demonstrating that the alignment of Kingdon’s (2014) problem, policy and political streams are essential for change in cannabis policy.

Abstract

Purpose

Almost five years after legalization, the unlicensed cannabis market is still thriving in Canada, and legacy cannabis retailers continue to face barriers to legal market entry. This study aims to shed light on these challenges and offer policy recommendations supporting legacy retailers and the government’s goals of enhancing public safety and displacing the unlicensed market.

Design/methodology/approach

This study reviewed online sources, including the media, gray literature, government, and other policy and legal websites, to identify legacy retailers’ challenges to entering the Canadian ecosystem since legalization and policy approaches of legalized jurisdictions with similar issues.

Findings

Legacy retailers face financial, legal and social barriers to entering the legal market. The Canadian government should focus on lowering and eliminating these barriers by developing programs that reduce financial risks and required capital, facilitate partnership programs and accelerators, provide innovative options that reduce overhead expenses, encourage pooled ownership to support small businesses, prioritize market entry for equity-deserving individuals and enable automatic expungement. A description of programs that have been implemented in other jurisdictions to address similar barriers is provided.

Practical implications

The policy recommendations in this paper would enable increased entrepreneurship and employment in a growing sector. While the tax revenue earned from the new market entrants may not be enough to support all the recommended policy initiatives, it could be reinvested to fund some of them creating sustainable growth opportunities.

Originality/value

The paper provides practical, timely policy recommendations on expanding the legal cannabis market in Canada and addressing unintended negative consequences of current policies.

Abstract

This paper considers the findings of the Beckley Foundation's Global Cannabis Commission Report (Room et al, 2008), an overview of the scientific literature on cannabis, detailing its potential harms and those caused by its prohibition. It moves on to consider the various strategies that different jurisdictions have adopted to deal with cannabis use, before moving beyond the Conventions, arguing that countries should have more autonomy to develop policy best suited to their individual circumstances.Cannabis was incorporated into the global prohibitive regime via the Single Convention on Narcotic Drugs 1961 (United Nations Office of Drugs and Crime, 1961), and is further affected by two later drug Conventions, the Convention on Psychotropic Substances 1972 (United Nations Office on Drugs and Crime, 1972) and the Convention against Illicit Traffic in Narcotic Drugs and Psychoactive Substances 1988 (United Nations Office of Drugs and Crime, 1988). Together, these require that all signatories make production, commerce and possession of cannabis criminal offences under domestic law: in the UK, this expectation is effected via the inclusion of cannabis in Schedule 2 of the Misuse of Drugs Act 1971 (HM Government, 1971). In the half century since the initial Convention was drafted, patterns of cannabis consumption have altered fundamentally; smoking cannabis has transformed from a relatively rare behaviour confined to a scattering of countries and cultures, to almost a rite of passage among young people in many nations. The United Nations Office on Drugs and Crime (2009) estimates that there is a global population of 190 million cannabis users, rendering it by far the most widely used illicit drug, yet, paradoxically, one that is rarely mentioned in international drug control policy discussions.

Abstract

Purpose

The purpose of this paper is to: describe and contextualize the aims and distinctive and common characteristics of cannabis festivals in countries with different cannabis policies; assess characteristics of participants; identify reasons to attend cannabis festivals; explore to which extent cannabis festivals contribute to the social and cultural acceptance of cannabis, as perceived by attendees.

Design/methodology/approach

The approach incorporates three methods of data collection in the research design; quantitative research among 1,355 participants, participant observation and interviews with the organizers.

Findings

Cannabis festivals in Amsterdam, Berlin, Rome and Athens have common features but also maintain and reproduce local, social and cultural characteristics. Cannabis festivals, as well as their attendees, represent heterogeneous categories. The style of the festival – music festival or march combined with music – affects the main reason for attendance by the participants. In cannabis festivals more similar to music festivals the majority of the respondents attended for entertainment while at the cannabis festivals in the form of a march combined with music the majority attended for protest. Furthermore, increasing age, residency and the high frequency of cannabis use are factors that led the participants to attend for protest.

Originality/value

The research on cannabis festivals is limited. This paper not only explores the aims of cannabis festivals in four capital cities of Europe and the characteristics of their attendees including motivations, but also offers interesting insights for understanding the ways in which political and social constructions like cannabis festivals shape attitudes, perception and behaviors around cannabis use.
