The authors describe an exploratory analytical tool called The 5Ps Leadership Analysis (Personal Attributes, Position, Purpose, Practices/Processes, and Product) as a heuristic for better understanding the complexities of leadership. Using The 5Ps Leadership Analysis, the authors explore the leadership of General Robert E. Lee of the Confederate Army of Northern Virginia and General George B. McClellan of the Union Army of the Potomac—more specifically, the leadership of the two generals on September 17, 1862 during the Battle of Antietam. The paper concludes with suggestions for application in the classroom.

Industrial relations, organizational behavior, and human resource management scholars have studied numerous aspects of internal workplace conflict resolution, ranging from the design of conflict resolution systems to the processes used for resolving conflicts to the outcomes of the systems. Scholars from these specialties, however, have paid considerably less attention to external workplace conflict resolution through litigation. This chapter analyzes certain areas of such litigation, focusing specifically on workplace conflicts involving issues of managerial and employee misclassification, independent contractor versus employee status, no-poaching agreements, and executive compensation.

Leading recent cases involving these issues are examined, with particular attention given to the question of whether the conflicts reflected therein could have been resolved internally or through alternative dispute resolution (ADR) methods rather than through litigation.

Implications of this analysis are drawn for workplace conflict resolution theory and practice. In doing so, I conclude that misclassification disputes could likely be resolved internally or through ADR rather than through litigation, but that no-poaching and executive compensation disputes could very likely not be resolved internally or through ADR.

The chapter draws on and offers an integrated analysis of particular types of workplace conflict that are typically treated separately by scholars and practitioners. These include misclassification conflicts, no poaching and labor market competition conflicts, and executive compensation conflicts. The originality and value of this chapter are to show that despite their different contexts and particular issues, the attempted resolution through litigation of these types of workplace conflicts has certain common, systematic characteristics.

To explore whether supposedly non-modern patrimonial arrangements ever advance the “modern” economy, this essay examines emergent state institutional practices in North America in relation to the domain of public lands from colonial times to the late nineteenth-century U.S. I deconstruct the Weberian model of patrimonialism into four elements – logic, setting, obligations, and resources – in order to show how state grants of land to individuals and corporations (notably railroad companies) constituted patrimonial practices embedded within modern structures. “Modern state patrimonialism” had its origins in royal patrimonialism. Monopolization of resources – by a state rather than an absolutist ruler – continued to offer the basis for patrimonial practice, but state patrimonial resource distribution became less personalistic and more connected to public goals (financing the state, rewarding state service, settlement of territory, development of a national economy, and construction of a transportation system). Recipients of patrimonial distributions often gained considerable control over disposition of resources that they received. In these patrimonialist practices, economic action was constructed in logics of action that occurred outside of “market” transactions. Future research should analyze patrimonial dynamics during the twentieth and twenty-first centuries, by identifying state monopolizations of scarce and desirable resources (mineral rights; city water systems; electrical systems; telephone systems; radio, television, and other airwave bandwidth; the internet), and analyzing how the distribution of those resources are entailed, controlled, licensed, or otherwise managed. A research program in the study of modern patrimonialism helps build out an institutionalist sociology of the economy.

WE are as yet without the means of verifying the forecast in our last issue that there would be a cutting of library estimates this year. There has been some; one library authority known to us having ordered a five per cent. cut. The fact still is that such retrenchments can only be made at the expense of a very few items of our estimates, and of these the book fund is the severest sufferer. This is a fact that cannot always be brought home to finance committees who only think as a rule in gross figures, and do not know that the library estimate consists mainly of fixed charges. The librarian who forms an estimate in anticipation of cuts does not aft quite honestly, but in the way of the world at present he may, like the Unjust Steward, be acting wisely. But it is pitiful to think that this should even be a matter for discussion.

A classification scheme by its notation does not do more than locate the subject; therefore, after the books are classified according to the scheme adopted, a secondary arrangement must be provided for the shelves, whereby books in a given class may be arranged in some order to accelerate finding and to differentiate one book from another. In this chapter, we discuss how an outside writing program was able to assist the stakeholders at a local middle school and the story behind the leaders involved in the process. This program was part of a larger system of “interventions” geared toward improving student success and teacher efficacy. Traditional interventions (after-school tutorials, grouping by state assessment scores, test-taking strategies) were viewed as lacking when it came to their impact on the campus's mostly students of color. Knowing the potential impact of a solid reading and writing program on urban youth, the faculty on the campus teamed with a Writers in the Schools (WITS) writer who proposed several promising practices. The contributions of a professional writer, real-world examples, and ongoing teacher professional development with support contributed to creating a knowledge community of writers that, in addition to creating more scholarship for students and staff, manifested itself in more minority students performing at the highest levels on the state accountability assessments.
