Abstract

Investigates the differences in protocols between arbitral tribunals and courts, with particular emphasis on US, Greek and English law. Gives examples of each country and its way of using the law in specific circumstances, and shows the variations therein. Sums up that arbitration is much the better way to gok as it avoids delays and expenses, plus the vexation/frustration of normal litigation. Concludes that the US and Greek constitutions and common law tradition in England appear to allow involved parties to choose their own judge, who can thus be an arbitrator. Discusses e‐commerce and speculates on this for the future.

Abstract

Purpose

COVID-19, an infectious disease first identified in China, has resulted in an ongoing pandemic all over the world. Most of the countries have been experiencing a difficult period during the fighting of this pandemic. The purpose of this study is to explore the effect of privacy concerns and cultural differences on public opinion related to the pandemic. The authors conducted a comparative analysis of public opinion in the US and in China as a case study, in order to determine the results.

Design/methodology/approach

National policies on important issues faced during the COVID-19 pandemic in the US and in China were examined through a comparative analysis. The authors used text clustering and visualization to mine public opinion on two popular social media platforms, Twitter and Weibo. From the perspectives of concern for privacy and of national culture, this study combines qualitative and quantitative analysis to discover the acceptance level of national policies by the public in the two countries.

Findings

The anti-pandemic policies and measures of the US and China reflect the different characteristics of their respective political systems and national cultures. When considering the culture of the US, it is hard to establish and enforce a rigorous regulation on either mask wearing in public or home quarantine on the national level. The opinions of US people are diverse, regarding national COVID-19 policies, but they are rather unified on privacy issues. On the other hand, Chinese people show a high acceptance of national policies based on their mask-wearing customs and their culture of collectivism.

Originality/value

Prior studies have paid insufficient attention to the ways in which user privacy and cultural difference affect public opinion on national policies between the US and China. This case study that compares public opinion on current and topical issues which are closely bound up with public life shows originality, as it innovatively provides a cross-cultural perspective on the research of public opinion dissemination during emergencies by considering the ongoing COVID-19 pandemic.

Purpose

Since 2004, the British Government has delivered a national policy on social marketing that has created a new frame of reference in this field. This paper aims to study the genesis, evolution and implementation of the policy process that led to an important development in British public health.

Design/methodology/approach

An in-depth multifaceted single case study, mixing qualitative and quantitative data including participatory research, enabled by a cognitive approach based on elements of knowledge, ideas, representations and social beliefs in the elaboration of a public policy.

Findings

This approach to understanding the British policy on social marketing process demonstrates a useful explanatory capacity, producing a comprehensive articulation of the main cognitive, normative, and instrumental dimensions of this policy, including its significant mutations influenced by the 2008 Great Recession and subsequent political evolution.

Research limitations/implications

This paper has followed the British social marketing policy’s implementation in England. In Wales, Scotland and Northern Ireland, this national policy had specific developments that it was not followed in our study In general, subject to complex historical, social and political conditions, this is a field that preserves its dynamism and the ability to question concepts and processes. Ever seeking new directions and solutions, it requires an ongoing research study.

Practical implications

Conclusions speak in favour of a prescriptive framework for a national policy on social marketing that can inform other government entities’ efforts to develop similar policies in other countries. A correct understanding of such a political process can lead to better management of its development and its consequent contribution to improving social marketing policy and interventions.

Social implications

A proper conception and management of a social marketing policy can contribute to improving the well-being of citizens.

Originality/value

It is the first time that this specific cognitive approach has been applied so systematically to a national social marketing policy through a long-term research, providing a prescriptive framework for other’ efforts to develop similar policies.

Abstract

Purpose

Social enterprises are embedded in ecosystems with multiple actors interested in the field’s growth. One way to enhance social enterprises is through public policies and developing countries like Brazil included this in the public agenda. After an important mobilization of private organizations and public managers, the Brazilian federal government implemented in 2017 the National Impact Investment and Business Strategy (ENIMPACTO) renamed in 2023 to National Impact Economy Strategy with the same abbreviation. Since its creation, ENIMPACTO saw significant modifications leading to a decree in 2023 extending its mandate, amplifying membership and changing its name to the National Impact Economy Strategy while maintaining the same acronym. This experience leads us to the following question: How was ENIMPACTO created and developed?

Design/methodology/approach

We used institutional arrangements and advocacy coalition theory to analyze the key elements that contributed to ENIMPACTO’s creation and its evolution through time. A qualitative, single-case study on the Brazilian experience implementing ENIMPACTO was conducted through semi-structured interviews with national strategy members, participant observation, document and data analysis.

Findings

We argue that advocacy coalition and institutional arrangements frameworks combined are needed to understand Enimpacto’s complexity. The strategy presented an extensive multiple-actor articulation involving shared beliefs that were also important to gather support on recreating and expanding Enimpacto when external events threatened its continuity. Yet, it presented important challenges on how to achieve consensus and alignment regarding important concepts and regulation strategy among the actors and manage the public policy governance and activities implementation.

Originality/value

We combine institutional arrangements and advocacy coalition frameworks and apply them to analyze a public policy composed of actors of multiple sectors that play an active advocacy coalition role. We also present empirical evidence that elements of the advocacy coalition framework add analytical elements to institutional arrangements literature and how they affect each other. We point to two important elements of the institutional arrangements framework (territoriality and subsidiarity) that were not initially considered by ENIMPACTO and were later incorporated because of tensions in the field. We provide empirical evidence of the incipient role that public administration can play in promoting social enterprises' agenda that might base similar strategies to boost social enterprises in other locations.

Abstract

Purpose

This paper aims to investigate how public libraries in Cameroon contribute to the achievement of goal 16 of the Sustainable Development Goals, which is “peace, justice and strong institutions”.

Design/methodology/approach

The methodology used is observation, talks with the librarians of public libraries from different regions of the country. Authorities in charge of this domain in Cameroon, that is the Ministry of Arts and Culture. Statistics from these different actors have been collected and used for the study, as well as those available through the National Institute of statistics.

Findings

The participation of public libraries in the implementation of goal 16 in Cameroon is remarkable, even if they lack substantial budgets for the achievement of their goals and rely partly on donations. The increasingly widespread use of information and communication technologies, as well as certain paying activities, partly compensates for this lack. Democracy, living together, access to employment and self-employment through the dissemination of information and animation are effective tools that public libraries implement. Users from different origins can gather and discuss freely on national issues. Public libraries are sometimes involved as mediators in the resolution of some social conflicts.

Practical implications

In a period were seeking peace, justice and strong institutions is one of the main national issues discussed in Cameroon, the study provides more visibility to both the authorities and the potential users on the important role played by public libraries in the resolution of national issues.

Originality/value

The study determines the different actors of a national policy in the framework of the creation, and the promotion of the public libraries and their respective roles for a more concerted and better-oriented action.

Abstract

This chapter aims to analyse how tourism has oscillated from a wicked problem and a geopolitical strategy tool in Brazilian federal tourism public tourism policies (PTP) over the past century (spanning from 1921 to 2022). Recently tourism has garnered significant relevance, emerging as an alternative avenue for development within the constraints and resource limitations faced by the National States. The empirical study collected secondary data from the government official press, encompassing records from the Senate, the House of Representatives, as well as the executive and judiciary branches. Considering this timeframe, a corpus comprising more than 31,000 documents TNAs (‘Tourism Normative Acts’) was meticulously gathered and systematically analysed. Our analytical framework integrates classical geopolitics, with a primary focus on State actors and the nation-building process, and the public policy approach, which is focussed on the degrees of wickedness. Our findings show that (a) the number of international tourists as well as the number of NAT have increased in a considerable way recently, but we cannot directly connect both; (b) three are the periods (1970–1980, 1990–2000, and 2002–2016) in which we can see a tourism geopolitical strategy has been more explicitly and effectively mobilized, and it is not necessarily reflected in the number of NAT, but in the actions generated in each period; and (c) the wicked degree of the tourism policies seem to be reduced according to the more explicit geopolitical strategy is. Despite, the importance tourism has reached, the support system underpinning this endeavour remains deficient, notably in terms of material and financial resources essential for its efficacious execution.

Abstract

Purpose

This study examines the implementation of a community-level Sustainable Broadband Adoption Program (SBA) under the Broadband Technology Opportunities Program (BTOP), a national public policy program meant to expand broadband deployment and adoption under the American Recovery Act of 2009, and administered by the National Telecommunications and Information Administration (NTIA) at the U.S. Department of Commerce. The California Connects Program (CC) was administered by the Foundation for California Community Colleges (FCCC).

Methodology/approach

This chapter focuses on one part of CC’s efforts to expand broadband adoption among the most underserved Californians through collaboration with the Great Valley Center (GVC). CC-GVC provided basic computer and Internet classes to disconnected populations with low-literacy levels, and primarily in Spanish, through community-based organizations, public schools, public libraries, small businesses, and others in the Central Valley, an 18 county rural region with a high concentration of digital destitute populations. The program worked with under-resourced local community institutions with a range of poor technology resources and that operated under variable set of social, economic, political, and institutional conditions. Through inductive, process-oriented, and explanatory case study research, the structure, strategy, and training approach of CC was examined. Content and theme analysis of primary and secondary qualitative and quantitative data involving the program’s leadership, direct service providers, partners, participants, and nonparticipants was conducted. This involved a sample of 600 in-depth and short, structured and unstructured interviews and focus groups, archival and participant observation notes.

Findings

It was found that CC-GVC was able to meet uncertainty and operated with low institutional resources and paucity of linguistically appropriate teaching resources for new entrants through a flexible leadership approach that adapted to the social situation and was open to innovation. Community technology trainers were also able to engage those without or little direct experience with computers and with low-literacy levels with a linguistically appropriate and culturally sensitive step-by-step teaching approach that empowered and met people where they are. The author expands non-adoption models to include structural barriers in the analysis of the disconnected. It is argued that non-adoption is a result of evolving inequality processes fueled by poverty and under-resourced community development institutions and that teaching and learning is a social and institutional process that takes trust and time.

Practical Implications

CC shows that even the most disadvantaged can be empowered to learn-to-learn to use computers and can begin to function online and gain benefit under the most extreme institutional and economic conditions, but it takes more time and resources than providers expected and the Recovery Act provided.

If intergovernmental relations are necessary in normal times, it should be even more required to face complex intergovernmental problem (CIP) as the COVID-19 pandemic. However, collaboration between governments depends on institutional rules as well as on political will. To discuss this issue, the analytical model is based on two dimensions: institutional design and political agency. As for the first dimension, since COVID-19 pandemic is considered as a CIP, three aspects are relevant when discussing how federations can organize the coordination between different levels of government: autonomy of subnational governments, mechanisms of coordination, and policy portfolio. As for political agency, the performance of political leadership (national presidents and governors) will be analyzed. The possibility of sharing collective goals across the federation is also a consequence of the political agency that takes place within the institutional systems of each federation. In short, it seeks to analyze the relationship between institutional design and political agency to deal with this CIP in five American federations.
