Abstract

A Memorandum of Understanding (MoU) was uncovered in January 2017 detailing the sharing of patient data from NHS Digital to the Home Office. It signified a deepening of the hostile environment’s presence in the NHS, and was comprehensively rejected by medical professionals. In November 2018, following extensive action calling for its removal, the MoU was withdrawn. This chapter explores how three factors: the lack of legal basis, wide reaching effects, and ethical conflicts of the MoU led to the success of this action, and aims to apply these lessons to other areas of hostile environment policy. It will be established that ethics proved the most influential factor in inciting the opposition, however, all factors may have been integral to the overall success. It shall be demonstrated that, although the success of this action promises much with regards to charging policy, it may be of limited applicability to other areas of the hostile environment.

Abstract

The chapter examines the current state and prospects of cooperation between the Eurasian Economic Union and the BRICS members. Firstly, the chapter describes comparative analysis between the economic strategies, which represents the two associations facing similar challenges; set themselves similar goals and objectives to achieve sustainable economic growth. Also, the authors provide an empirical analysis of trade and economic cooperation between the EAEU and the BRICS countries, which shows different levels and dynamics of relations with each member of the BRICS. Furthermore, it is proposed to use new ‘soft’ formats, which, in the authors' opinion, will provide synergistic use of the fundamental platforms for dialogue created in the EAEU and BRICS to intensify cooperation and deepen practical interaction. Finally, the chapter concludes that the potential interaction between the two associations of developing countries would create positive prospects and new opportunities, subsequently accelerating their economic growth. Such consolidation of capabilities of these institutions would transfer such cooperation into a practical direction by implementing the goals defined in the strategic planning of the EAEU and BRICS countries.

Abstract

A policy of surveillance which interferes with the fundamental right to a private life requires credible justification and a supportive evidence base. The authority for such interference should be clearly detailed in law, overseen by a transparent process and not left to the vagaries of administrative discretion. If a state surveils those it governs and claims the interference to be in the public interest, then the evidence base on which that claim stands and the operative conception of public interest should be subject to critical examination. Unfortunately, there is an inconsistency in the regulatory burden associated with access to confidential patient information for non-health-related surveillance purposes and access for health-related surveillance or research purposes. This inconsistency represents a systemic weakness to inform or challenge an evidence-based policy of non-health-related surveillance. This inconsistency is unjustified and undermines the qualities recognised to be necessary to maintain a trustworthy confidential public health service. Taking the withdrawn Memorandum of Understanding (MoU) between NHS Digital and the Home Office as a worked example, this chapter demonstrates how the capacity of the law to constrain the arbitrary or unwarranted exercise of power through judicial review is not sufficient to level the playing field. The authors recommend ‘levelling up’ in procedural oversight, and adopting independent mechanisms equivalent to those adopted for establishing the operative conceptions of public interest in the context of health research to non-health-related surveillance purposes.

Abstract

Within the tertiary Institution where I am employed there is a real and concerted effort to engage meaningfully as a Treaty 1 partner with the local Iwi (tribe) 2 through a formal arrangement. 3 However the institution often inadvertently finds itself crossing the ‘cultural boundary’ of what or how Indigenous and local Iwi knowledge systems and practices fit within its tertiary systems. This chapter explores some of the challenges that have arisen between Iwi and the Institution. In particular it examines the Memorandum of Understanding (MoU) the Institute has with the four Arai-Te-Uru Rūnaka (tribal councils) that saw the creation of a Kaitohutohu 4 position at Senior Management level. From this came the establishment of a Kōmiti Kawanataka (Treaty of Waitangi Committee) and the writing of the Māori Strategic Framework (MSF). All staff are required under the MoU to action the MSF within their teaching and learning as well as in their service provision. The Institute has established internal training to assist staff with how they can implement the MSF. Training is offered at zero cost and staff have a two-year window of opportunity to enrol in and complete it.

Abstract

Purpose – This research aims to explore Qanun Aceh post-conflict enacted in the legislation of Government of Aceh through a Memorandum of Understanding (MoU) and enhancement policy of Wali Nanggroe associated with educational development.

Approach Methodology – The review of the literature links to the Qanun Aceh exploring the Wali Nanggroe institution through normative theory. A qualitative method was used to find a strategic policy of the Legislation Government of Aceh related to documents used in data analysis.

Findings – The study found the existence of the Wali Nanggroe institution brought several opportunities and challenges of unifying Aceh people post-conflict. The discussion of the Wali Nanggroe Institution has brought new dynamics in the policy and educational development in post-conflict Aceh. The Government of Aceh and the Parliament did not take the policy for educational building in order for the society to have an understanding of the Wali Nanggroe institutional position as stated in the Law of Government Aceh (LoGA).

Research Limitations – The examination of these dynamics and prospect of the Wali Nanggroe institution is linked to the policy on educational development for the Aceh people and implementation of the LoGA post-conflict of the Aceh Government and the Government of Indonesian Republic.

Practical Implications – The solution offered is to improve the educational system to give a political understanding of the Aceh people.

Abstract

The impact of an effective principal on the quality of teaching and learning has been clearly established. Logically, the next question to be answered is: How can we best prepare principals to lead the improvement of instructional practices and outcomes for students? Partnerships between school districts and universities have shown the capacity to be an effective means of preparing principals, and much has been confirmed about how those partnerships should be structured in order to benefit both partners. This document looks briefly at the literature that describes and supports these partnerships, outlines the framework of a successful partnership in Florida, and provides insightful “lessons learned” throughout the planning, implementation, and evaluation of that partnership.

Since both organizations realize important benefits, constructing a district/university partnership should be easy. However, differences in the professional cultures of the two organizations as well as differences in the demands and constraints they each face make it a challenging task. From finding the right university partner to planning the collaborative work in detail; what was learned in the Florida partnership is described in straightforward terms. In this way, the document provides a road map to a successful district and university partnership.

Abstract

This is a case study on the implementation of shared services across back-office functions between the National Library of Scotland and the National Galleries of Scotland in the period 2008 to early 2013. It describes the potential benefits of a Library doing business in a less conventional way, at a time when the public sector is facing challenges of high customer expectations and tight budgets. From 2004 the concept of building shared services in the cultural sector was promoted by the Scottish Government as a means of achieving improved performance and more cost-effective service delivery. The initial four attempts to create shared services in the cultural sector failed. This study looks at the first attempt that succeeded and draws out the factors contributing to that success. Key precursors to progress included finding common ground and developing trust between parties who were initially suspicious of each other, establishing an effective governance framework, obtaining ongoing commitment from senior management, and aligning everyone’s agendas to make them compatible. By 2013 the program had delivered a common Information Systems network, as well as two parallel finance systems sitting on the same server. In March 2013 the HR teams entered a phase of living together for six months to test their integrated operations prior to formally becoming a shared service, treating both the Galleries and the Library as a single client. Building a shared service with another cultural partner has been a useful, though demanding experience. Both organizations are better off for committing to sharing.

Abstract

This chapter reports on the “CEO’s-eye-view” of the 1990 financial crisis at Citibank using unique data from CEO John Reed’s private archives. This qualitative analysis sheds light on questions that have perennially plagued executives and intrigued scholars: How do organizations change routines in order to overcome inertia in the face of radical change in the environment? And, specifically, what is the role of the CEO in this process? Inertial behavior in such circumstances has been attributed to ingrained routines that are based on cognitive and motivational truces. Routines are performed because organizational participants find them to cohere to a particular cognitive frame about what should be done (the cognitive dimension) and to resolve conflicts about what gets rewarded or sanctioned (the motivational dimension). The notion of a “truce” explains how routines are “routinely” activated. Routines are inertial because the dissolution of the truce would be inconsistent with frames held by organizational participants and fraught with the risk of unleashing unmanageable conflict among interests in the organization. Thus, the challenge for the CEO in making intended change is both to break the existing truce and to remake a new one. In this study, I uncover how the existing organizational truce led to the crisis at Citibank, why Reed’s initial attempts to respond failed, and how he ultimately found ways to break out of the old truce and establish new routines that helped the bank survive. These findings offer insight into the cognitive and motivational microfoundations of macro theories about organizational response to radical change.
