Abstract

Purpose

If a seller fails to deliver the correct quantity, the buyer may reject the goods in accordance with the Sale of Goods Act 1979, section 30(1). The nature of this right to reject is unclear, and whether breach by short delivery will suffice to terminate the contract is also unclear. The purpose of this paper is to clarify this area of law.

Design/methodology/approach

The focus is on the combined case‐law and academic commentary on the topic of short delivery, and the broader issue of termination.

Findings

The paper suggests that breach by short delivery does terminate the contract. It suggests that the right to cure cannot provide an entirely satisfactory response for victims of short delivery. The paper also proposes a reform of the Sale of Goods Act 1979 to take this into account.

Research limitations/implications

This research mainly focused on the current legal position. Further research on the historical development of the rules on short delivery, which were crystallised in the Sale of Goods Act 1893, will provide valuable insights into this area of law.

Practical implications

The proposal for reform could have a practical benefit in terms of protecting buyers from the danger of short delivery, by providing them with a more secure remedy than what appears to be currently available.

Originality/value

To the extent of the author's knowledge, this is the first dedicated analysis of short delivery in the literature.

The problems of urban distribution and the need to confront them particularly at a time of escalating petrol costs, is one of the most urgent issues facing retailers and food suppliers today. Hence the conference held recently, organised by the National Materials Handling Centre, and entitled ‘Urban distribution — strategy for the future’. One of the major preoccupations was the conflict of interests which impedes progress; environmental lobbies, central and local planning, EEC legislation. However, this paper by Alan Rushton buries these differences beneath his overriding concern with the practical rather than the ideological aspect of the subject. His point of reference is a study which looked into the problems of high street delivery, producing a scale of importance for the various difficulties encountered, and assessing the likely success of the solutions available.

Abstract

Recent advancements in information and communication technologies have led to the rapid growth of electronic commerce market. In the United States, e-commerce retail sales for 2002 reached $45.6 billion, indicating an increase of 26.9% from 2001 while total retail sales increased 3.1% during the same period. Although e-commerce sales account for only 1.4% of total sales in this country, forecasts show that the magnitude of digital economy will continue to expand. The logistical requirements of e-commerce goods that extend to each customer's address stimulate greater complexity in traditional supply chain management, potentially causing higher costs for freight supply chain participants. To harness the economic potential of e-commerce, it is important to encourage the development of a freight transportation system that will support its steady growth, while avoiding the possible negative effects from the changes in freight transportation. Due to the intrinsic nature of e-commerce goods, advances in home delivery have the potential to promote the growth of e-commerce as well as to create sustainable urban freight transportation systems. Based on the case study of the United States, this paper presents an in-depth discussion of the key challenges arising in home delivery operations, and proposes potential solution strategies that will lead to more efficient and reliable home delivery systems.

Abstract

Purpose

This paper seeks to analyse the different characteristics a bill of lading holds as a document of title, including the proprietary effects a transfer of goods in transit can have and the bill's use as a means of security as well as its limitations in mo6dern international commerce.

Design/methodology/approach

The paper examines the document's nature and the evolution of its traditional legal functions. The analysis includes, among other things, the implications different types of bills have as an instrument in commercial trade. Special attention is given to the attributes that are likely to limit the bill's application in modern international trade, concerning both its scope and value. Finally, the paper offers a set of conclusions and suggests reform measures.

Findings

The paper shows how technological innovations in recent years have resulted in the emergence of new forms of transport documentation that might challenge the bill's role in the future. The paper provides a clear understanding of the problems associated with the bill's current form and outlines the main approaches proposed to meet its need for reform.

Practical implications

The paper offers a conceptual analysis of the bill's weak points and discusses how simplification and standardisation, a central registry system and electronic transmission of information may be able to increase efficiency.

Originality/value

Critical assessment undertaken may pave the way for an open discussion on the subject. Legal culture and mercantile customs should be taken into consideration if a successful and sustainable reform is to be achieved.

Abstract

Purpose

This study aims to apply a Lean Six Sigma framework to support continuous improvement in the maritime industry (shipbuilding, logistics services and shipping companies) during COVID-19 pandemics. By applying the concepts of Lean Six Sigma and supply chain resilience, the most suitable continuous improvement method for the maritime industry is developed to maintain a resilient supply chain during COVID-19.

Design/methodology/approach

A specific shipbuilding, logistics services and shipping company in Indonesia is chosen as the research object. The Lean Six Sigma framework reveals the wastes through the supply chain resilience concept, and implements internal business processes to maintain optimal system performance.

Findings

The paper identifies important implementation aspects in applying Lean Six Sigma to shipbuilding, logistics services and shipping. The DMAIC (define, measure, analyze, improve and control) approach is applied to achieve supply chain resilience. Resilient measures are generated for the case companies to maximize performance during the pandemics.

Practical implications

This paper provides a new insight for integrating Lean Six Sigma and resilience strategies in the maritime industry during COVID-19 disruptions. The authors provide some insights to sustain the performance of the maritime industries under study.

Originality/value

This study is part of the first research in the maritime industry that focuses on continuous improvement during COVID-19 using Lean Six Sigma and supply chain resilience.

Abstract

Purpose

To assess the introduction and performance of light electric freight vehicles (LEFVs), more specifically cargo cycles in major 3PL organizations in at least two Nordic countries.

Design/methodology/approach

Case studies. Interviews. Company data on performance before as well as after the introduction. Study of differing business models as well as operational setups.

Findings

The results from the studied cases show that LEFVs can compete with conventional vans in last mile delivery operations of e-commerce parcels. We account for when this might be the case, during which circumstances and why.

Research limitations/implications

Inherent limitations of the case study approach, specifically on generalization. Future research to include more public–private partnership and multi-actor approach for scalability.

Practical implications

Adding to knowledge on the public sector facilitation necessary to succeed with implementation and identifying cases in which LEFVs might offer efficiency gains over more traditional delivery vehicles.

Originality/value

One novelty is the access to detailed data from before the implementation of new vehicles and the data after the implementation. A fair comparison is made possible by the operational structure, area of delivery, number of customers, customer density, type of packages, and to some extent, the number of packages being quite similar. Additionally, we provide data showing how city hubs can allow cargo cycles to work synergistically with delivery vans. This is valuable information for organizations thinking of trying LEFVs in operations as well as municipalities/local authorities that are interested.

Abstract

Purpose

Delivery punctuality is essential in supply chain management, yet the cost of untimely delivery is usually assumed to be given or based on intuition and not quantified by facts.

Design/methodology/approach

The authors used a data set containing detailed transaction data for a nine-year period on orders and deliveries of sport goods. The methodology is based on applying a polynomial distributed lag model to longitudinal data on supply chain transactions.

Findings

The results indicate that small delivery delays up to two weeks decrease the sales by maximum 10% during a period of 3–4 weeks. Longer delays, up to 45 days, have a larger negative effect on sales, which can also last longer. For this case company, the estimated lost sales due to late deliveries (=5 days) were 5.1% of the delivery value. The longer delays got, the large the cost was: delays at least 45 days long were the most costly causing almost 40% of the estimated lost sales.

Practical implications

This study offers a methodology for quantifying lost sales due to delivery delays and estimating how long the poor delivery performance affects retailers' order behaviour.

Originality/value

The results give a quantitative decision-making tool for supply chain managers to estimate the profitability of investments in the supply chain performance, especially on improving punctuality.

The purpose of this monograph is to touch on some of the difficulties encountered in the passing of title to goods or the taking of a security interest in goods. The law is in a hopelessly complicated and technical mess which serves neither the interests of consumers or businessmen. It is particularly appropriate to look at this area at this time, as Professor Aubery Diamond, at the request of the Minister of Corporate and Consumer Affairs (Mr. Michael Howard M.P.), is examining the need for alteration of the law relating to security over property other than land. To this end Professor Diamond has issued a Consultation Document in which he poses a number of questions for the legal and business community to consider, it is to be hoped that the Government will act on any proposals produced instead of consigning them to a limbo as was done with the Law Reform Committee's Twelfth Report on ‘Transfer of Title to Chattels’ and with the proposed ‘Lending and Security Act’ suggested by the Crowther Committee on Consumer Credit in 1971.

Abstract

Purpose

Theadvanced air mobility (AAM) is defined by National Aeronautics and Space Administration (NASA) as safe, accessible, automated and affordable air transportation system for passengers and cargo, capable of serving previously hard-to-reach urban and rural sites. The purpose of this paper is to focus on explaining potential solutions, under study by the authors, which could support beyond visual line of sight (BVLOS) operations for goods delivery in a safe way.

Design/methodology/approach

According to recent NASA-commissioned market studies, by 2030, there will be as many as 500 million flights a year for package delivery services and 750 million flights a year for passengers’ transportation (AAM). A significant number of these aircrafts will be unmanned aerial vehicles, meaning that they are self-flying or autonomous, of which the smallest ones are quadcopters: they are relatively inexpensive and are capable to perform various tasks, such as aerial observation, crop monitoring and treatment, search and rescue, power line monitoring and goods delivery. On the other hand, there are still many difficulties in introducing them into medium- and low-risk BVLOS routine operations for goods delivery: unfortunately, there are no regulations and technologies yet that enable these operations.

Findings

This conceptual paper outlines the studies about possible solutions, identified by authors, which could support BVLOS operations in a medium- and low-risk environment; in particular, the following aspects have been analysed: regulations, integrating control systems for drones, sensors (on board obstacle detection and avoidance), emergency management (emergency on ground system to identify safe landing areas), concepts of droneway (or flight corridors) and drones recovery hub.

Originality/value

The purpose of this paper is to provide a conceptual description of the possible solutions, under study by the authors, which could contribute enabling the BVLOS operations in a medium- and low-risk environment. The paper aims describing the state of the art, terms of regulations, classifications and limitations and describing possible conceptual solutions that could guarantee safety in introducing unmanned aircraft system operations inside urban areas.
