This paper aims to analyze Brazil’s legal and institutional arrangements for the design, implementation and accountability of public procurement for innovation (PPI) and to investigate how this apparatus has been adjusted, modified and even replaced to enable its use in innovation policies.

It is a descriptive analysis of the legal framework for PPI in Brazil supplemented with case reports of ongoing PPI contracts.

Despite the significant advances in the PPI legal framework in Brazil, this instrument’s implementation is still limited. A disconnection between PPI and innovation policy goals and legal-institutional constraints are reasonable answers to this problem.

Law is closely related to the design, implementation and control of public policy tools. However, there is still a tine understanding of how the legal framework can corroborate or constrain new mechanisms to state purchase power, such as PPI.

Public procurement is the most crucial tool of demand-side policies for innovation, and it is implemented according to the legal framework in each country. This paper adds to the law and innovation research agenda, providing an overview of the Brazilian PPI legal framework and how it is going so far.

This paper aims to use quantitative metrics to chart the unique history leading to Brazil’s leadership in renewable energy and identifies a set of meta-scenarios that define possible future carbon performance. These meta-scenarios provide a context for discussing specific energy policy implications both at the national scale and from the perspective of Brazil’s urban centres.

The paper defines and uses three metrics – energy efficiency, decarbonisation and carbon efficiency – to plot both Brazil’s historic energy pathway and a set of future energy scenarios put forth by various national and international energy agencies. The authors then use a meta-scenario approach to group these alternate pathways, identifying specific policy levers associated with the realisation of each.

The authors identify plausible policy changes that will help move Brazil off a current trajectory of stagnated energy performance to a “greener” scenario in which carbon efficiency improves even as Brazil’s economic growth continues. Such policies include energy efficiency programmes and continued expansion of the country’s already extensive hydropower and biomass capacity. Adoption of policies that would put Brazil on a more aggressive path towards a global sustainability scenario currently seems impractical.

This paper brings a standardized set of metrics to bear on Brazil’s unique energy history, which in turn helps identify specific policy impacts for continued GHG reduction in Brazil’s future from national and urban perspectives.

Court decisions, based largely on principles of equal protection and non-discrimination, throw out laws with preferences for open source software, demonstrating that such laws are not only bad public policy, but may also be illegal, and that neutrality and choice in software procurement is the better approach.

The second decade of the twenty-first century finds Brazil racked by a series of scandals that are extreme even by world standards. This chapter presents an explanation for one of the behaviors that have produced these scandals. Specifically, it is the offering of bribes to public officials by individuals or companies that stand to benefit from contracts to perform public services and, furthermore, the paying of kickbacks to the officials if the contract is awarded. I liken this behavior to the making of vows to the saints in the “popular” or “folk” form of Catholicism – and other popular religions that accept its basic premises – and the fulfillment of the promise if and when the otherworldly being provides what the petitioner requested. Part 1 of the chapter examines an election for mayor of the city of Fortaleza in 2012 in which the office was “bought” for what seemed to be an exorbitant amount of money. I hypothesize that this is to be explained by the anticipation of the city receiving government contracts to build a soccer stadium, a rail system, and other projects related to the 2014 World Cup. In Part 2, I examine Brazil’s religions beginning with popular Catholicism, to show that the normative way of gaining something desired from a supernatural – be it the restoration of health or the recovery of a lost item – is to offer it something it values and then fulfilling the promise if and when the petitioner receives what was requested. I contend that this important religious pattern continues to provide the template for the secular behavior that is being judged to be corrupt by standards other than those found in the religiously based worldview of many Brazilians.

Brazil and Chile have nearly similar recent political histories. Emerging from protracted military dictatorships at roughly the same time, both developed presidential and representative democratic processes, though with contrasting individual national emphases. Military dictatorships in both countries originated in anti-corruption rationales, among others, and both have emphasized anti-corruption practices since regime changes. Brazil impeached two presidents, ostensibly for corrupt practices. Yet, Chile has managed a corruption level, according to Transparency International’s Corruption Perception Index, that is among the lowest in Latin America, while Brazil’s is among the highest. This study compares and contrasts the two nations’ experiences with a view to uncover key causal, or at least explanatory, variables in this striking contrast in levels of perceived corruption.
