Coronavirus disease 2019 (COVID-19) is a fast-moving pandemic that has brought about calamities and challenges to the human world. In the field of international higher education (IHE), it problematizes and challenges the operation of neo-liberal mentalities and rationales, while generating disruptions and impediments to the flows of globalization. Drawing upon extant research on IHE across spatial and cultural contexts, this essay aims to: (1) unravel the deficiencies of neo-liberal mentalities and rationales in coping with the challenges of COVID-19 to IHE; (2) assess the impacts of COVID-19 on the developments of globalization and internationalization of higher education with particular focus on the complications therein; and (3) explore the possible spill-over effects on and implications for the re-positioning of IHE in the post-COVID-19 era. Albeit the negative impacts of COVID-19 may not last, its spill-over effects are bound to cast a long shadow over IHE’s future development. This essay explores how IHE can persist in spite of deficiencies in neo-liberalism and fluidity in globalization.

The coronavirus (COVID-19) pandemic has arguably exposed the failures of neoliberalism and its political agenda over the past generation. The response has seen governments resurrect neo-Keynesian policies in order to address the weaknesses in the current market system and to mitigate the worst economic downturn since the Second World War (1939–1945). This chapter contextualizes the Australian perspective and the policy responses to the economic challenges posed by COVID-19. The authors contrast that with the experience of the USA and UK with whom the country shares common institutions and culture, including a generation of neoliberal economic reforms.

By closing large sections of the economy, the Australian COVID-19 response provided extensive social welfare support and bailed out several sectors and industries. Previously unacceptable and unthinkable levels of budget deficit and country debt were incurred. This systemic state intervention into the economy raises the question of whether the pandemic signals the end of the neoliberal era and its ramifications – or whether this neo-Keynesian pause was a kneejerk response to ensure and protect its legacy.

This chapter discusses the use of law and legal institutions by the emerging social movement seeking to end Australia’s policy of mandatory detention for refugees and asylum seekers. Through an examination of Australian inquiries and court cases alongside social campaigns, it considers the ability of legal institutional responses to identify the harms, in particular state and institutional responsibility, and the subsequent impact of these legal processes in inhibiting and promoting social and structural change. It shows how social movements are harnessing law and creating new legal and civic spaces in which to contest Australia’s refugee and asylum seeker regime.
