Abstract

Purpose

International investment law governs matters related to transnational investments. The extensive reach of transnational corporations (TNCs) has granted them substantial economic, political and social influence, often intertwining them with public interest issues and implications in human rights violations. This paper aims to explore the profound influence exerted by TNCs in today’s globalized world and its implications for human rights and social responsibility within the framework of international investment law. Particularly, it acknowledges the vulnerability of economically weak South Asian states and cites past instances such as the Bhopal gas tragedy in India and the Rana Plaza disaster in Bangladesh as egregious violations of human rights. Focusing on South Asian bilateral investment treaties (BITs), this paper aims to examine the scope of investors’ social accountability.

Design/methodology/approach

This research engages with doctrinal and analytical methods in traversing through primary and secondary sources. It would parse the arbitral tribunals’ jurisprudence for their discussion on the inclusion of social accountability obligations within international investment agreements (IIAs). Further, it engages in a quantitative analysis related to the nature of the social accountability-related obligation of the corporation within South Asian BITs.

Findings

The findings reveal a glaring absence of the law on investors’ social accountability and the need for enhanced regulatory mechanisms to address the escalating influence of TNCs on human and social rights. The absence of a robust legal framework, coupled with the asymmetric nature of international investment law, granting investors greater rights and leverage compared to states, exacerbates this challenge. The phenomenon of “regulatory chill” inhibits states from effectively enforcing regulatory measures aimed at protecting human rights and the environment. Furthermore, the broad interpretation of clauses such as “fair and equitable treatment” by investment tribunals often undermines states’ ability to implement measures in the public interest. While international organizations such as the UNCTAD and the UNCITRAL Working Group III are actively discussing reforms to IIAs, the existing guidelines addressing investors’ social accountability are woefully lacking in the content as well as the method of their integration with international human rights law. The findings underscore the imperative for South Asian nations, the subject of this research’s empirical analysis, to adopt a comprehensive approach involving both domestic law reforms to promote corporate social accountability and active pursuit of negotiations for the inclusion of binding social obligations for investors within IIAs.

Practical Implications

This research, drawing upon international law developments, offers suggestions for incorporation of social accountability provisions via relevant domestic law reform. The research could be viewed as a prelude for mapping the legal developments in the area of investors’ social accountability within investment agreements, as well as investment contracts, drawing guidance from international law instruments.

Originality/Value

To the best of the authors’ knowledge, no other study analysed the scope of investors’ social accountability in South Asian BITs.

Abstract

Purpose

The purpose of this study is to present a systematic review of the effects of COVID-19 on the conventional textile production subsector. The emergence of the COVID-19 virus in 2019 has subsequently caused many problems, such as unemployment, business closures, economic instability and high volatility in the global capital markets amongst others within the wider manufacturing industry including textile production.

Design/methodology/approach

Relevant secondary data are obtained from the Scopus database and Statista. Based on the data analysis of 21 seed articles, three research themes are identified: challenges in the textile industry, new material innovations or solutions and the textile industry performance.

Findings

The results reveal that the COVID-19 pandemic has affected the textile industry, disrupted the supply chains of this industry, affected profit margins, stopped employment and impacted the retail of products to customers. Aside from the negative repercussions, there are also good sides to the pandemic which, for instance, range from advanced material innovations to textiles with anti-microbial, self-cleaning and anti-bacterial properties that would limit the transfer of the virus.

Practical implications

Findings reinforced the need for effective strategies and investments in the research and development departments of the various firms in the textile industry to innovate operations and novel materials for the next global pandemic.

Originality/value

Many companies have adopted novel strategies and practices that are helping them to survive the pandemic. This study, therefore, recommends further investigation into material innovations and reimagining strategies by companies and the supply chain within the textile industry so that it is protected against future crises.

Abstract

Purpose

This study aims to comprehensively inspect the impact of blockchain technology in the context of globalization, focusing on the most influential research works, scientific production by countries, commonly used keywords, trending topics and the conceptual and intellectual structure of this field.

Design/methodology/approach

A bibliometric analysis was conducted in R Studio, involving the review and scrutiny of 194 research papers indexed in the Scopus database. This analytical approach allowed for a systematic examination of the literature and the identification of key patterns and trends in blockchain and globalization research.

Findings

The analysis revealed the most influential research contributions, highlighted countries with significant scientific production, identified frequently used keywords and unveiled emerging trends and areas of focus in the field of blockchain and digitization. Additionally, the study explores prospective research directions.

Research limitations/implications

This research provides insights into the current state of blockchain and globalization research, offering valuable information for scholars, policymakers and industry professionals. The recognized themes provide a systematic structure for upcoming inquiries, directing studies toward vital domains like supply chain management and sustainable development. Moreover, the analysis emphasizes the significance of interdisciplinary collaboration and provides practical insights, enabling businesses and policymakers to enhance transparency, counteract fraud and adjust to the digital era for societal and economic advancement.

Originality/value

The study contributes to the prevailing literature by steering a comprehensive analysis of the interplay between blockchain technology and globalization, shedding light on influential works and emerging trends. It adds value by providing a structured overview of the field's intellectual landscape.

Abstract

Purpose

This study examines the effect of supply chain (SC) learning (i.e. supplier and customer learnings) on green innovation (i.e. green product and process innovations) and investigates the moderating role of green transformational leadership in the SC learning-green innovation linkage in the construction industry.

Design/methodology/approach

Data are gathered from construction firms in Vietnam by a questionnaire survey. Hypotheses of the study framework are tested by hierarchical regression analysis.

Findings

Both supplier and customer learnings have positive effects on green innovation (both green process and product innovations). Furthermore, green transformational leadership moderates the linkage between supplier learning and green innovation but does not moderate the linkage between customer learning and green innovation.

Practical implications

Construction firms need to constantly develop capabilities of SC learning for promoting their green innovation.

Originality/value

The present study is one of the first attempts in construction that investigates the importance of SC learning to achieving green innovation as well as the role of green transformational leadership for strengthening the effect of green learning on green innovation.

Abstract

Purpose

The purpose of this study is to investigate the factors that influence the development of human capital by examining the interplay between different organizational mechanisms, including leadership, organizational culture and human resources management (HRM) practices. This study aims to enhance our understanding of how knowledge exchange influences human capital, with a specific focus on the unique context of Dubai, an area and context that have been underexplored in this research domain.

Design/methodology/approach

This study used a survey-based approach, involving 611 participants working across different sectors based in Dubai. This study used partial least squares structural equation modeling as the statistical analysis method.

Findings

The results of the study indicate that leadership behaviors have a predictive influence on organizational culture. In turn, organizational culture significantly affects knowledge exchange. Additionally, the study reveals that commitment-based HRM practices play a significant moderating role in the relationship between organizational culture and knowledge exchange.

Originality/value

This study contributes to the existing literature by providing valuable insights into the interplay between leadership, organizational culture and commitment-based HRM practices. By exploring these factors and their influence on knowledge exchange and human capital, the study enhances both the theoretical understanding and practical application in this field.

Abstract

Purpose

This study investigates how the degree of internationalization (DOI) affects the financial performance of emerging market companies by making the distinction between export intensity and multinationality (i.e. foreign direct investment). The authors argue that the different DOI-performance patterns in the literature relate to different internationalization approaches, which are moderated in distinct ways by formal institutions in the home country.

Design/methodology/approach

Based on data of Brazilian firms in several industries and with different internationalization patterns including 100 exporting firms and 30 multinational companies with varying degrees of multinationality over a period of five consecutive years, the authors test their hypotheses using an unbalanced panel data with 346 firm-year observations. In order to test how the quality of formal institutions moderate the DOI-performance relationships, the authors estimate the changes in the slope of the regression line by adding and subtracting one standard deviation to the Worldwide Governance Indicators (WGI) variables.

Findings

A positive and linear association between export intensity-performance (EI-P) highlights the location specific comparative advantages of exporting Brazilian firms, while the multinationality-performance (M-P) relationship points to a horizontal S-shape pattern which conforms to the theoretical assumptions of the three-stage internationalization process. Formal institutions moderate positively the EI-P relationship, but moderate negatively each of the three stages of the M-P relationship.

Research limitations/implications

The findings from this study provide critical insights that contribute to the ongoing debate on how formal institutions in the home country affect the DOI-performance relationship of emerging market companies (EMCs). However, the authors consider that it has limitations as they focused exclusively on formal institutions captured by governance institutions in the Brazilian context.

Practical implications

This study provides relevant insights to managers and policy makers. Findings reveal that strong formal institutions in the home country make it easier (cheaper) for EMCs to invest abroad, and, at the same time, increase the efficiency of exporting firms and positively influence financial performance. Moreover, results show that during downturns in their domestic markets, multinational EMCs outperform domestic firms. In that sense, while policy makers can promote the internationalization and competitiveness of EMCs by implementing more supportive formal institutions, managers should consider a proactive approach and invest abroad when conditions in the home country are favorable.

Originality/value

By making the distinction between export intensity and multinationality this study contributes to the literature on the DOI-performance of EMCs providing a more nuanced view on how formal institutions in the home country moderate the EI-P and M-P relationships in different ways.

Abstract

Purpose

Diversity in boards has gained attention as a reflection of societal imbalances. The purpose of this paper is to investigate the impact of diversity in terms of both gender and nationality in management boards of small and medium-sized enterprises (SMEs) on firm performance from an upper echelons perspective. The authors also examine how board-specific characteristics influence the structural makeup of boards in gender and nationality diversity terms.

Design/methodology/approach

The authors focus on the UK because of its individualistic society and flexible labour market and assess 309 SMEs in the manufacturing industry over 2009–2019. A 3-stage least squares (3SLS) estimator is used to analyse the data, the Shannon index to measure board diversity, return on assets as proxy for firm performance, and owner-manager presence, board member age and tenure are the board-specific characteristics of primary interest.

Findings

Both gender and nationality diversity contribute to firm performance and represent distinct upper echelon characteristics that change the cognitive and psychological dynamics of boards. Firms with larger boards do not perform better, but diverse boards reduce the narrowing view of CEOs. Yet the presence of owner-managers, despite their performance-enhancing contribution, holds firms back from benefitting from diversity as a strategic choice.

Originality/value

This study extends the upper echelons theory to include board diversity as an important aspect that should become more central in upper echelon thinking when understanding firm performance. The authors’ findings suggest that theoretical developments in search of understanding firm behaviour must proceed by accounting for diversity and not simply focusing on decision-making styles.
