Abstract

Purpose

The purpose of the project was to investigate environmental law issues surrounding the regeneration of brownfield land.

Design/methodology/approach

Following a literature review, an inductive approach and an interpretivist epistemology with a phenomenological focus were chosen. A constructionist ontological stance was adopted. A qualitative paradigm was selected to explore the issues in a focus group comprising industry, legal expert and academic contributors.

Findings

A critique of the literature on relevant environmental law issues including contaminated land, waste management, water pollution, environmental impact assessment (EIA) issues and finally the political agenda is presented. Contaminated land, waste management, regulators and legislation were discussed in the focus group. The participants contributed their experiences and proposed several changes to environmental law. However, water pollution and EIAs were not considered by the contributors.

Research limitations/implications

Developers face many environmental law challenges when endeavouring to progress housing on brownfield sites including contaminated land, funding, waste treatment permits, water pollution and EIAs. The benefits of the remediation of brownfield sites for housing seem to be a political priority, but reform of challenging environmental law issues less so. Understandably, the legal complexities of Brexit will take precedence.

Originality/value

The literature review identified the need to research the experience of brownfield environmental law challenges and recommended changes to environmental law from industry, legal experts and academia.

Abstract

The zero-waste term in municipal solid waste management has been the utopian objective of every waste management authority in the cities in developing countries, even though it comes with different perceptions, which are sometimes misguided. People can produce no waste unless they live with no consumption. The zero-waste term does not mean that we produce no waste, rather we dump no waste at the landfill site. It means we dispose of nothing at a landfill site since the issue of landfill site can be a culprit of waste management, for its reiterating city land demands that generate “headaches” to city authority because of NIMBYism (Not In My Back Yard issue). No one accepts living voluntarily next to a landfill site as it creates more harm than harmless. With zero waste at the landfill site in mind, the waste management authority attempts to deal with the complexity of municipal solid waste management, by reviving each element of the waste management stakeholders to concertedly move on to deal with waste. Individual households and communities, without which waste management will not be successful, were positioned as the main thrust of waste management. A multipronged approach was implemented with all stakeholders, i.e., lawmakers, regulators, waste producers, implementers, and pressure groups, appearing with different functions but a common point: zero waste at the landfill site. A stakeholder with a large capacity, i.e., local government focuses on creating a large project that has a large impact on overall waste management; private sectors may contribute to establishing recycling centers, and waste-to-energy projects. Meanwhile, the individual households, which are large in number but have a small capacity, establish community-based activities, i.e., waste banks. This chapter attempts to provide the overall picture of municipal solid waste management in 14 cities in developing countries toward their goal of zero waste at landfill sites.

Abstract

Purpose

Using the policy recommendations identified in the study as an analytical departure point, the study proposes a “public-private governance and sustainability model” that builds upon the policy options and develops implementation strategies for the key stakeholder institutions implementing the proposed solutions in the US food waste management ecosystem.

Design/methodology/approach

Within an exploratory research perspective, an affinity diagram is employed to help identify important policy recommendations identified with key policy reports. Moreover, the study employs a “meta regulation” approach that employs four essential characteristics of any regulatory instrument or approach: target, regulator, command and consequences.

Findings

The study has identified the recommended solutions identified as most effective, and developed recommended implementation strategies that could accomplish the goal of potentially reducing food waste in the US at the consumer level. The study recommends passage of federal legislation that specifies what form of administrative rule-making and enforcement process should be instituted, as well as who are the important stakeholders to be considered and authority provided in this rule-making and enforcement process.

Originality/value

This study offers a comprehensive “proposed public-private governance and sustainability model” addressing food waste management safety and quality date labeling implementation challenges by the enforcing federal, state and local governments, as well as collaborating with industry associations and consumer interest groups.

The Hanford site, in Washington State, presents a large-scale test for long-term stewardship of residual radioactive and chemical contamination. Large quantities of waste and contaminated materials will remain in perpetuity near the land's surface and the Columbia River, making Hanford perhaps the most complex long-term stewardship challenge among former weapons production sites. This paper explores the scope of contamination, the Department of Energy's approach to cleanup, the likely residuals requiring long-term stewardship, and the issues that are thus raised. Expectations with respect to long-term land uses, the likely durability of institutional controls, and funding, information management, and accountability have long been influenced by mistrust and tension between local communities, regulators, tribes, and the Department of Energy (DOE). Despite positive steps by DOE such as the creation of the Office of Legacy Management, DOE's dependence upon annual appropriations, its sovereign immunity with respect to key state and local land use regulations, and recent policy pronouncements that cast doubt on the willingness to respond to unanticipated problems with additional cleanup, all leave doubt in the minds of regulators and communities that DOE can be counted upon to be both proactive and accessible once cleanup is complete.

Abstract

Purpose

The international nuclear community continues to face the challenge of managing both the legacy waste and the new wastes that emerge from ongoing energy production. The UK is in the early stages of proposing a new convention for its nuclear industry, that is: waste minimisation through closely managing the radioactive source which creates the waste. This paper proposes a new technique (called waste and source material operability study (WASOP)) to qualitatively analyse a complex, waste‐producing system to minimise avoidable waste and thus increase the protection to the public and the environment.

Design/methodology/approach

WASOP critically considers the systemic impact of up and downstream facilities on the minimisation of nuclear waste in a facility. Based on the principles of HAZOP, the technique structures managers' thinking on the impact of mal‐operations in interlinking facilities in order to identify preventative actions to reduce the impact on waste production of those mal‐operations.'

Findings

WASOP was tested with a small group of experienced nuclear regulators and was found to support their qualitative examination of waste minimisation and help them to work towards developing a plan of action.

Originality/value

Given the newness of this convention, the wider methodology in which WASOP sits is still in development. However, this paper communicates the latest thinking from nuclear regulators on decision‐making methodology for supporting waste minimisation and is hoped to form part of future regulatory guidance. WASOP is believed to have widespread potential application to the minimisation of many other forms of waste, including that from other energy sectors and household/general waste.

Abstract

Purpose

This study aims to explore the state of environmental management accounting practice and the motivations for its use with a view to improving waste and recycling management by local government. The focus is on practice in local governments situated in the state of New South Wales (NSW), Australia. Prior studies suggest the need for environmental management accounting as a supporting tool for waste management.

Design/methodology/approach

An exploratory case study method was applied in 12 NSW local government organisations. In each local government interviews were conducted with managers responsible for waste and recycling issues.

Findings

Contrary to prior research this study found that, in the local governments investigated, an increasing amount of environmental management accounting information is being made available. The case studies found two main motivations encouraging the development of environmental management accounting in local government: first, social structural influences, such as regulatory pressures from different environmental regulatory bodies, environmental expectations from local communities, and pressures from peer councils; second, organisational contextual influences reflecting situational needs in the organisational contexts, such as complex waste operations and service designs, changes and uncertainties in waste and recycling management, and the council's strategic position for waste management.

Research limitations/implications

The results imply that institutional theory and contingency theory provide different but complementary explanations for the development of environmental management accounting in waste management. Although previous environmental studies are overwhelmingly in favour of social system‐based theories, such as institutional theory, to explain environmental changes in organisations, an organisation's contextual dynamics seem to be equally important.

Originality/value

The findings about motivations provide useful information for environmental strategists and government regulators to make policies that improve accountability and the efficiency of waste and recycling management as well as promote future development of environmental management accounting to support sustainable waste management solutions.

Abstract

Financial assurance rules, also known as financial responsibility or bonding requirements, foster cost internalization by requiring potential polluters to demonstrate the financial resources necessary to compensate for environmental damage that may arise in the future. Accordingly, assurance is an important complement to liability rules, restoration obligations, and other regulatory compliance requirements. The paper reviews the need for assurance, given the prevalence of abandoned environmental obligations, and assesses the implementation of assurance rules in the United States. From the standpoint of both legal effectiveness and economic efficiency, assurance rules can be improved. On the whole, however, cost recovery, deterrence, and enforcement are significantly improved by the presence of existing assurance regulations.

Purpose

In less than a decade to Sustainable Development Goals, the urban solid waste (USW) emanating from households, especially in developing countries, calls for concern. Several policies have been suggested and some implemented, but the challenges facing USW management remain, especially in developing nations. Past studies demonstrated that the fourth industrial revolution (4IR) technologies can be used to improve urban public services. The role of 4IR in mitigating the challenges of USW is yet to receive in-depth research in Nigeria. Thus, the study investigated 4IR role regarding mitigating the challenges facing USW.

Design/methodology/approach

Seven cities across Nigeria, including the Federal Capital Territory, were used as the study area to achieve the research objectives via a qualitative research design. Thirty-two semi-structured interviews were conducted from selected regulators, households, legislators, ICT experts, NGOs and waste managers. A thematic approach was adopted to analyse the collated data.

Findings

Findings group the USW challenges into five categories. The 4IR technologies can be used to manage USW; thus, they create an opportunity to integrate and promote sustainable clean cities.

Research limitations/implications

This study is confined to the 4IR role concerning mitigating the encumbrances facing USW in Nigeria and proffered feasible policies to enhance a sustainable healthy environment.

Practical implications

Proffered policy solutions will stir policymakers and construction practitioners to think outside the box and offer and better understand how 4IR technologies can be utilised to mitigate those challenges. The outcome will create sustainable clean cities as part of the implication contribution to the body of knowledge.

Originality/value

Evidence from the reviewed literature shows a paucity of literature focussed on 4IR roles in mitigating the encumbrances facing USW in Nigeria. Therefore, this study contributes to the existing research work on 4IR concerning its role in enhancing USW in Nigeria and, by extension, to other developing countries.

Abstract

Purpose

The chapter aims to evaluate the efficacy of stakeholder participation in the solid waste management system of Mauritius in view of providing a possible mechanism to attain the goals of a sustainable waste management framework.

Methodology

The study employs qualitative indicators, namely, User Inclusivity and Producer Inclusivity of the Wasteaware Benchmark Indicators. Secondary data are used to conduct a critical and comprehensive analysis of the sub-indicators falling under each of the two main indicators to determine the overall compliance level with respect to stakeholder engagement of the waste management sector of Mauritius.

Findings

The results of the study show a LOW/MEDIUM compliance level for both User Inclusivity and Provider Inclusivity indicators, which indicates that improvement is required in the stakeholder engagement mechanism in Mauritius. The main weaknesses identified comprise of lack of an adequate legal framework with clear definition of waste types with regards to segregation, especially for non-hazardous wastes, low efficiency of sustainable waste management awareness campaigns and lack of inclusion of the informal sector. The main strengths identified consist of a proper bidding mechanism in place and a good level of equity in the provision of waste management services with respect to comingled waste collection. Suggested improvement areas include a revamping of the existing legal framework related to waste management to cater for higher inclusivity of all stakeholders together with including sustainable waste management topics in the formal education curriculum.

Originality

The User Inclusivity and Producer Inclusivity indicators were previously applied only to cities to measure the level of stakeholder participation, but this study has demonstrated that these indicators can also be adopted on a nation-wide level to evaluate stakeholder engagement. The use of these indicators together with secondary data presents a less time-consuming method to assess stakeholder participation in the waste sector, which can be particularly useful for Small Island Developing States.

Abstract

This chapter highlights the overwhelming situation of plastic pollution in the Nigerian tourism sector. While plastic waste pollution is detrimental to the ecological system, it also has a direct negative effect on Nigeria's economic sectors including tourism. Approximately, 8% of the world's carbon emissions are caused by tourism-related activities. Tourism activities have contributed enormously to the improper disposal of trash, raw sewage and toxic chemicals into Nigeria's environment. However, there is a lack of comprehensive initiative or policy to curb the gigantic waste pollution in Nigeria, specifically in the Nigerian tourism sector. This has caused more confusion among the consumers and the tourism practitioners. Therefore, this chapter outlines the current situation, the implication for the businesses and the responsibility of the stakeholders.
