Abstract

Black slavery and white racism in the South and the nation, de jure and de facto Jim Crow, Brown v. Board of Education (1954), which outlawed separate schools, “massive resistance” to it (Klarman, 1994, p. 82), plus racial disparities in educational achievement since 1954, all frame this narrative of black males' quest for higher education. Bondmen were denied literacy and black freemen rarely attended school, much less pursue advanced study, during the antebellum period. Union victory in the Civil War, abolition of slavery with the Thirteenth Amendment (1865), and Reconstruction marked the rise of not only Negro schools and colleges but also southern share cropping, called “the new slavery” (Du Bois, 1935, p. 715), and epidemic violence against blacks that imposed their disfranchisement and segregation, by laws and customs, until the 1960s. Thus African American males sought collegiate and professional training in a national milieu of white supremacy, which postulated black men's mental and moral inferiority but ignored their widespread poverty, separation, and unequal opportunities. Confined in historically black colleges and universities (HBCUs), they breached the color-line little by little at white institutions, thereby paving the way for Brown, the civil rights movement, and desegregation. In the second half of the 20th century, HBCUs and the majority-white institutions trained increasing numbers of black male graduates and professionals. By 1980 though, only some 11 percent of young black men had received 4 years of college compared to 25.5 percent of young white men (Jaynes & Williams, 1989). An “achievement gap” was evident and it persists today (Lee, 2002, p. 3), revealing the deep roots of race and class inequality in America. White racism, its legal and extralegal forms, and black aspirations and efforts underlay and continue to fuel black men's drive for higher learning. Over time black men, and certainly women as well, faced racist structures, ideologies, and attitudes born of slavery; sub-citizenship, stereotypes, and terror, among other barriers, through a century of Jim Crow; and after Brown, ongoing discrimination, socioeconomic disadvantages, and ambiguous “affirmative action” policies (Jaynes & Williams, 1989, p. 376).

Abstract

Purpose

To study a range of options for providing equity finance (equity capital) in social enterprises.

Design/methodology/approach

The UK government’s keenness for social enterprises to overcome the sector’s cultural aversion to borrowing and seek finance for their activities and end grant dependency within the sector is discussed. Considers the different motives of ethical investors and the potentially blurred boundary between what constitutes a social enterprise and what constitutes a private enterprise. Reports on how the Community Interest Companies (CICs), which provides the legal format for social enterprises, has adapted its regulations to pave the way for new forms of equity finance for social enterprises.

Findings

It is possible to adapt the rights of ownership identified by Jeff Gates (1998) to provide the basis for equity finance for social enterprises through its attention to liquidation rights, income rights, appreciation rights, voting rights, and transfer rights.

Originality/value

Clarifies some of the aspects involved in equity finance to reveal the potential of this type of finance for social enterprises.

Abstract

This mainly exploratory study was a one‐point‐in‐time survey of the situation in one English county. This study involved a survey of all social care homes in the county, followed by measures of quality of life/service for a random sample of 30 people identified by the survey, interviews with home managers, service users, family carers and care managers, and focus groups with members of four community learning disability teams. The total number of people placed from out‐of‐area was estimated to be close to 2,000 (1,500 were placed by the local authority within the county). The main reason for such placements was lack of good local services, but cost also seemed important. For many of those who had been in long‐stay hospital, locality appeared not to be important. Effects varied, but at least a third of people were experiencing very poor service quality and quality of life. Family carers generally felt their relative was happy, but fear of losing the placement was a strong theme. Distance was a major difficulty for both family and care manager involvement. For local community learning disability teams, the main problems included increased workload, reduced provision for local residents, difficulty in dealing with placing authority and the poor quality of the homes. Challenges for public agencies include provision of better local services, management of the cost incentives, especially for London Boroughs, and a system where funding follows the person wherever they chose to live.

Abstract

This paper is concerned with examining the variables which influence the periodic redesign of physical distribution systems. It assumes that with a few exceptions every arrangement for moving goods from production to customer is one which has been built up through a series of non‐related decisions made in answer to a problem which has developed to such proportions that it cannot be solved by adjusting the existing system. The paper ignores also the relatively few companies who are large enough to use an integrated distribution system which has been developed with the aid of a simulation or with linear programming techniques. The problems of these companies are adequately dealt with in the literature on simulation and linear programming techniques.

Abstract

This article focuses on the development and current situation of services for people with learning disabilities in England. Deinstitutionalisation started in the 1960s, when a series of scandals in hospitals were brought to public attention. In response, the 1971 government White Paper Better Services for the Mentally Handicapped was published, and the first community‐based services were introduced. Further policy papers attempted to modernise social services in the following period. The 2001 White paper Valuing People is the most recent policy framework specific to people with intellectual disabilities. It identifies rights, independence, choice and inclusion as the four leading principles for services and support, and will be of primary importance for future development. However, at present implementation is in the very early stages. Not least, the intense implementation of market mechanisms by the Thatcher Government in the 1980s and 1990s has led to a situation that is hard to grasp, the organisation of care and support varying from authority to authority.

Abstract

Purpose

The purpose of this paper is to provide insights and implications for hospitality management and education through an interview with an entrepreneur, leader, hotelier, and philanthropist in Central Florida – Mr Harris Rosen.

Design/methodology/approach

The study takes a qualitative approach along with a personal interview, which was used as a tool for data collection. An open‐ended interview protocol was designed to facilitate data collection.

Findings

The study presents insights of Mr Rosen on several key issues in hospitality management and education, including: entrepreneurship, leadership, education, and philanthropy. Implications and discussions are provided based on his perspective.

Originality/value

The study provides fresh ideas and perspectives on many relevant issues related to hospitality management and education. The insights and discussions provide prompt critical thinking on hospitality industry career development and various existing education systems.

Abstract

Purpose

The purpose of this paper is to offer insights and lessons learned about how to successfully balance the interests of the many competing stakeholders who can or do influence the CVB's strategy for marketing a destination.

Design/methodology/approach

The study uses a qualitative case study approach utilizing an extensive interview as the method for data collection. A series of structured questions specifically designed to focus the interview on the topic of interest was used to facilitate data collection.

Findings

The paper presents insights from Mr William C. Peeper, the person largely responsible for building the Orlando Orange County Convention and Visitors Bureau from a two‐person organization into the multi million‐dollar operation it became by the time he retired 25 years later. Since the focus of the paper is on how to successfully balance the differing goals of stakeholders to achieve organizational goals, this interview offers a number of lessons learned that can be used by any organizational leader seeking to balance the interests of diverse stakeholders.

Originality/value

This study provides fresh ideas and new insights into how to successfully manage an organization's stakeholders in ways that make it possible to achieve an organization's mission across time. The success Mr Peeper had in gaining sustained support for the mission and goals of the Orlando CVB provides important lessons on how to manage all stakeholders especially the corporate governance structure that is pertinent to any organization that has to accommodate many diverse viewpoints and interests. There is little existing knowledge on managing stakeholders across time as their interests and needs change and the management of them must also adapt.

Abstract

Purpose

The purpose of this article is to explain recent enforcement trends under the Foreign Corrupt Practices Act (FCPA), providing examples of recent cases.

Design/methodology/approach

The paper describes recent trends in FCPA enforcement, including increased enforcement by US authorities, greater vigilance by private industry, and global anti‐corruption efforts. It provides an overview of the FCPA, including the original reason why the Act was passed, its anti‐bribery provisions, the need to show corrupt intent, the interstate commerce requirement, exceptions and affirmative defenses, record‐keeping and control provisions, and penalties. It describes recent FCPA prosecutions and enforcement actions and draws conclusions on how to reduce FCPA risk.

Findings

The FCPA is a Watergate‐era law that was passed in response to disclosures by a number of large US corporations that they had made illicit payments to foreign government officials. The FCPA applies to bribes by any US issuer or domestic concern, paid to any foreign official, foreign political party, official or candidate, or official of a public international organization in order to assist in obtaining, retaining, or directing business. To prosecute, the government must show corrupt intent. The FCPA also contains provisions that require accurate record‐keeping and internal controls of US issuers. Violations of the FCPA are subject to both criminal and civil penalties.

Originality/value

The paper presents a thorough explanation, practical advice, and examples of recent violations and penalties by experienced lawyers specializing in FCPA compliance as well as white‐collar defense, securities regulatory matters, internal investigations, and anti‐money laundering.
