Abstract

Popular constitutionalists seek to recover the popular sovereignty foundations of American constitutionalism, bringing the people in as active participants in the constitutional enterprise as they create and refashion the Constitution by “majoritarian and populist mechanisms” (Amar, 1995, p. 89). The result is to recover an understanding, in FDR's words, of constitution as a “layman's document, not a lawyer's contract” (Kramer, 2004, p. 207). This understanding has deep roots in American constitutionalism, tracing its lineage back to the founding and, as popular constitutionalists insist, finds powerful expression in the likes of The Federalist and Abraham Lincoln (Ackerman, 1991; Tushnet, 1998). In exercising popular sovereignty, the people founded the Constitution, but they did not simply retreat from the trajectory of constitutional development. Rather, as Bruce Ackerman argues, since the Constitution of 1787 the people have spoken in a manner that has re-founded the Constitution giving us a “multiple origins originalism” (Kersch, 2006a, p. 801; see also Amar, 1998 and 2005). In turning to founding era thought and the notion of constitutional foundations, popular constitutionalists like Ackerman and Amar make common cause with conservatives who turn to original intent, but then they seek to synthesize this understanding with democratic expressions of popular will by emphasizing both formal and informal constitutional change, giving us layered “foundings,” and a more complex version of “living constitutionalism.” Such constitutional change, however, can only legitimately come from an authentic expression of “We the People.”

Abstract

In this chapter, the interplay between the development of the discipline, the development of the field of study, and the emergence of professional fields is examined using the example of mathematics. In connection with the formation of the modern research university, mathematics has emerged as an independent scientific discipline and as an independent field of study. In the process, mathematics attains a high degree of formalization and internal coherence. This is the basis for the penetration of mathematicians into more and more professional fields, even outside science. Real problems or real facts are reduced to aspects that are amenable to mathematical modeling by treating them as quantifiable parameters. As mathematics expands as a field of study, more and more professional sectors become applications of mathematical models. As a consequence, more mathematical fields of study are differentiating themselves, specializing in these application fields. This chapter analyzes this dynamic and its preconditions.

Abstract

Evidence suggests that international comparison has become a ubiquitous component of educational innovation and entrepreneurship in spite of significant variation among educational contexts worldwide. This chapter provides an overview of educational innovation and public sector entrepreneurship from an internationally comparative perspective. The influence that the global shift from natural resource and industry-based economies to knowledge-based economies has had on the development of educational innovation and entrepreneurship is explained. Several examples of educational innovation and education-oriented public sector entrepreneurship highlight the discussion, which concludes with an examination of specific knowledge society issues related to educational entrepreneurship and its reciprocal effect on innovation.

Abstract

This article examines how contact with the police led to the death of Michael Brown (an unarmed 18-year-old Black teenager from Ferguson, Missouri, who was shot and killed during an altercation with a police officer). And, how Darren Wilson (the White police officer from the Ferguson Police Department who shot and killed Michael Brown) was portrayed in mainstream newspaper articles covering the story of Brown’s death.

Using both frame analysis and Hall’s framework of discursive domains for organizing and making sense of events in social life, we analyzed news coverage of Brown in three of the top circulating daily newspapers in the US: The New York Times, Los Angeles Times, and The Washington Post. The Lexis Nexis database was used to retrieve a set of newspapers using the search term “Michael Brown.” Articles from the three leading newspapers were collected from the day the event occurred, August 9, 2014, through the end of the year, December 31, 2014.

The news articles used in this study were mostly written with an episodic frame. The articles presenting the socioeconomic background of Brown and Wilson were described as profiles on each individual and the neighborhood they came from, rather than a discussion about where they fell on the economic structure of this country and the larger, upstream forces that might influence those positions. The feelings and attitudes of the reader are also likely to be influenced by details included in the articles and how they were presented.

The findings contribute to the broader literature looking at the relationships between police and Black communities. Public health can play a role in advocating and facilitating programs that build better linkages between police and community. The public health field can take a leadership role in holding the news media accountable when they are engaging in frenetic inaction. Only by having difficult and challenging conversations that examines the upstream causes of violence and deaths like Brown’s, can we make progress in preventing them.

Abstract

Equity is an issue that pervades all aspects of primary care provision for children and as such is a recurring theme in the Models of Child Health Appraised project. All European Union member states agree to address inequalities in health outcomes and include policies to address the gradient of health across society and target particularly vulnerable population groups. The project sought to understand the contribution of primary care services to reducing inequity in health outcomes for children. We focused on some key features of inequity as they affect children, such as the importance of good health services in early childhood, and the effects of inequity on children, such as the higher health needs of underprivileged groups, but their generally lower access to health services. This indicates that health services have an important role in buffering the effects of social determinants of health by providing effective treatment that can improve the health and quality of life for children with chronic disorders. We identified common risk factors for inequity, such as gender, family situation, socio-economic status (SES), migrant or minority status and regional differences in healthcare provision, and attempted to measure inequity of service provision. We did this by analysing routine data of universal primary care procedures, such as vaccination, age at diagnosis of autism or emergency hospital admission for conditions that can be generally treated in primary care, against variables of inequity, such as indicators of SES, migrant/ethnicity or urban/rural residency. In addition, we focused on the experiences of child population groups particularly at risk of inequity of primary care provision: migrant children and children in the state care system.

Abstract

This chapter explores distributed leadership in volunteer multistakeholder groups tackling complex problems, focusing on community organizing practices to bridge the gap between health and health care in Columbia, South Carolina. Columbia faces increasing chronic disease, high rates of uninsured, unequal access to healthcare services, and rising costs. Regional leaders periodically tackled these problems together but faced challenges common to multistakeholder groups. In 2010, leaders from Columbia partnered with the authors in a learning enterprise to find new, more sustainable ways to address these challenges. Together we adapted a community organizing approach to develop distributed leadership skills necessary to overcome the challenges of volunteer multistakeholder groups and transform the health system in a local area. In the first year, teams provided health screenings to over 1,000 residents; over 3,000 residents exercised leadership to improve community health; over 5,000 residents pledged to improve their health. Clinic hours were extended; new health coaches focused on primary care and wellness programs. Providers and payers committed to reinvesting a share of savings in the community, which has a voice in their use. We show that developing distributed leadership via community organizing offers an approach to solving seemingly intractable community problems.
