Abstract

E-commerce is gaining popularity across the globe and Mauritian businesses are also increasingly making use of online platforms to engage in cross-border electronic transactions. However, there are several implications arising from online trading which need to be addressed, among which one is the validity of e-contracts. This research will therefore emphasise on two main components of e-contracts: choice of law and the applicable jurisdiction. While Mauritian laws were amended to give effect to digital signatures and e-agreements, there is no extensive or substantive domestic legal provision on choice of law and jurisdiction. Hence, the purpose of this study is to advocate for a greater clarity on the legal framework governing the applicable law and jurisdiction governing a conflict situation in e-contracts, with the view of increasing trust in international e-commerce and to bring in consistency with international commercial relations. This study will be carried out in the Mauritian context by adopting the black letter approach which will analyse the relevant rules and regulations concerning e-contract formation and validity. Additionally, a comparative analysis will be conducted on the legal framework relating to the applicable law and jurisdiction in e-contracts for selected countries: the European Union and the United States. These countries have been chosen for the comparison due to their high involvement in e-commerce and their advanced as well as comprehensive rules on e-commerce.

Abstract

Circular economy (CE) has gained the attention of the business community with the promise of several trillions of dollars to be gained from finding productive uses for waste materials, and developing new business models focused on extending and reimagining the useful life of products. Industrial symbiosis (IS) involves the shared management of resources among multiple firms, most often within some geographic proximity. IS is particularly focused on the reuse of secondary materials, such as industrial by-products, for which conventional recycling does not exist. IS and CE represent a radical reconceptualization of business models from individual to collective competitive advantage with private and public benefits. IS has been recognized as a novel strategy for businesses and regions interested in implementing the CE. In this chapter, we explore the conditions and circumstances in which IS could play a pivotal role in increasing circularity and sustainability in diverse supply networks.

Abstract

This chapter enters the debate of knowing if the financial regulations should be overhauled in the continuity of behavioural finance developments. The lack of precision in the behavioural finance conclusions could lead to misleading new financial regulations adoption. Furthermore, through an analysis of the literature, we show that behavioural finance hypothesis building converges to the neoclassical one's, which contradicts the idea to overhaul financial regulations. We also highlight the fact that universal heuristics and biases contribute to the financial regulations revision proposal. Finally, we analyse some of the propositions put forward by advocates of behavioural finance and the limits thereof.

However, due to micro and macro changes in the business field, strategies to find a way to improve brand reputation with business partners and customers have altered from transaction marketing to newer approaches such as employing a social media platform. However, not all brands make use of social media to enhance their reputation. The present study uses Apple as an example of the one of the best known brands which does not benefit from social media platforms as to the degree expected.

Abstract

Tourists and visitors currently tend to consider environment and the purity of nature, educational tourism, culture and history, large‐ and small‐scale events, and entertainment and fun as crucial issues. For certain specific target groups, these wishes and needs may be satisfied by a new form of tourism called “geotourism”, which is an multi‐interest kind of tourism exploiting natural sites and landscapes containing interesting earth‐science features in a didactic and entertaining way. Relative to demand, a form of tourism based on imagination and emotion, favouring experience and sensations, and explaining the natural environment by playing with its temporal and spatial dimensions may provide opportunities of economic development. Different target groups (e.g. seniors, families, schools) potentially interested in cultural and natural landscapes seem to constitute specific markets to consider. In this sense, on‐site interpretation needs to be more adapted to the visitors' expectations and a more original and striking way of communication has to be used. From a promotional point of view, “geomarketing”, a kind of image communication that explores the temporal and spatial dimensions of the rocks (e.g. minerals, fossils) and forms (e.g. glaciers, caves) of the Earth's surface, may be developed. This will not only generate inquisitiveness among the target groups selected, but also give a clear position to a destination, in order to distinguish itself from similar territories. Of course, product communication must complete this marketing strategy with the creation, promotion and sale of specific and original products, especially for the summer period (from spring to autumn). For instance, a mix of walking, wellness, “agro‐tourism” and “geotourism” may be profitable for regional economic development. Thus, this paper is a conceptual contribution based on a theoretical work and a literature review.

Abstract

In this chapter, the authors illustrate how the use of ethnographic methods as a mode of cultural inquiry can support educators in developing students’ competencies to navigate in and across cultural contexts. The authors report on an undergraduate service learning course held at the University of California, Los Angeles, which combines attendance in a university class with weekly visits to a play-based after-school club located in a multicultural immigrant community. The chapter draws examples from the required field notes written by undergraduate students about their visits to the after-school club, as well as oral comments by the students gathered through interviews. As a way of offering practical engagement in the lifeworlds of the demographically diverse children attending the after-school club, the authors apply examples from the undergraduates’ statements to consider the value of the course – and the engagement it requires with anthropological methods and multilingual and multicultural children – in supporting students’ cultural competence. In doing so, the authors demonstrate what they believe to be a worthwhile approach for cultivating cultural competence in higher education in a socially just and culturally responsive manner.
