Abstract

Purpose

This chapter provides a legal and theoretical overview of environmental PPMs articulated in private standards. It seeks to expand the debate about environmental PPMs, elucidating important dimensions to the issue from the perspective of global governance and international trade law. One of the arguments advanced in this chapter is that a comprehensive analysis of environmental PPMs should consider not only their role in what is regarded as trade barriers (governmental and market driven) but also their significance in global objectives such as the transition towards a green economy and sustainable patterns of consumption and production.

Methodology/approach

This chapter is based on an extensive literature review and doctrinal legal research.

Findings

This research shows that environmental PPMs represent a key issue in the context of the trade and environment relationship. For decades such measures have been thought of as being trade distortive and thus incompatible with WTO law. Although it seems clear now that they are not unlawful per se, their legal status remains unsettled. PPMs can be regarded as regulatory choices associated with a wide range of environmental concerns. However, in trade disputes, challenged measures involving policy objectives addressing production issues in the conservation of natural resources tend to focus on fishing/harvesting techniques. On the other hand, an important goal of Global Environmental Governance (GEG) is to incentivise sustainable consumption and production in order to achieve the transition to a green economy. In this sense, it can be argued that what are generally denominated as ‘PPMs’ in the WTO terminology can alternatively be regarded ‘SCPs’ in the language of environmental governance. Environmental PPMs are not only limited to state-based measures, such as import bans, tariff preferences, and governmental labelling schemes. Environmental PPMs may also amount to good corporate practices towards environmental protection and provide the rationale for numerous private environmental standards.

Practical implications

Most academic attention afforded to environmental-PPMs has focused on their impacts on trade or their legality under WTO law. Although legal scholars have already referred to the significance of such measures in the context of environmental governance, this issue has remained almost entirely unexplored. This chapter seeks to fill the gap in the literature in this regard. In particular, it addresses the relevance of environmental PPMs in the context of decentralised governance initiatives such as the UN Global Compact and private environmental standards.

Originality/value

Overall, this chapter assists in the understanding of the significance of environmental PPMs in the context of private environmental standards and other governance initiatives involving goals related to sustainable consumption and production. This chapter adds to the existing body of literature on the subject of PPMs in international trade and environmental governance.

Private standards are increasingly governing international food trade, but little is known about the implications for developing countries. The objective of the study is to provide evidence in the ongoing debate on standards as barrier or catalyst for developing countries’ export. We use the Peruvian fresh asparagus export sector as a case study and provide empirical panel data evidence on the effects of certification to private food standards on export volumes of firms. Our dataset on the transactions of 567 export firms from 1993 to 2011 allows us to take export dynamics and time trends into account, as well as to keep country and sector specific effects constant. In our empirical strategy, we first use simple OLS and ignore firm-specific unobservable effects and dynamic export patterns. We then account for export persistence, as well as company fixed effects and finally, use System-GMM estimators to address potential reversed causality issues. These approaches represent substantial methodological improvements compared with previous studies on the trade effects of private standards. The empirical innovation is crucial for accurate impact estimation, as results indicate that certification to standards has a positive effect on the export volumes of companies, but that the significant effect dwindles as soon as unobserved firm heterogeneity and export persistency are properly controlled for. Additional studies with large data availabilities are needed to further disentangle the effect and confirm the case study results.

Abstract

The success enjoyed by some of the alternative agrifood movements has led to a dual process: on the one hand, their mainstreaming and cooptation; while on the other hand, their institutionalization into public regulation and law. This dual process is the result of the influence these movements have had on consumers and politicians and serves to demonstrate the constant exchange between the spheres of public and private regulation, a feature that characterizes the neoliberal model of governance. In turn, this has led to the appearance of new alternative initiatives which may converge with or diverge from founding initiatives when these are the result of divisions within a movement. The question that arises here is obvious: despite these evident achievements, by working within the market and using the tools of neoliberal regulation, have these movements managed to generate the social change they intended from the outset? This chapter will attempt to answer the question by offering a reflection on two of the most widely discussed aspects of this strategy: first, the private and/or public space where these movements develop and the citizen-consumer duality of the actors to whom they appeal; and second, their ability to generate standards, norms, and certification systems, that is, their ability to establish the rules of the game.

The chapter contributes to on-going debates about the inclusion of smallholders in export value chains for high-value agricultural products. Specifically, it investigates the factors driving the procurement practices of exporter of fresh fruits and vegetables in sub-Saharan Africa, and specifically sourcing from smallholders. A survey is undertaken of exporters of fresh fruit and vegetables in sub-Saharan Africa. The resulting data are used to estimate econometrically the propensity of exporters to source from smallholders, and the intensity of sourcing among those exporters who do procure from smallholders. Explanatory variables include firm and market characteristics, supply chain costs, type of product, availability of alternative sources of supply, and judgments regarding the performance of smallholders and other sources of supply.The propensity to procure from smallholders is found to be negatively associated with being a small exporter and the performance of medium- and large-scale producers. Exporters are more likely to source from smallholders if they have their own production capacity and smallholders are judged to perform well. The requirement of customers to comply with private food safety standards is found to have no significant effect on the propensity to procure from smallholders. Conversely, compliance with private standards has a strong influence on the intensity of sourcing from smallholders. Exporters judging smallholders to perform well are more likely to source intensively from smallholders, but to source less if they judge their own production to perform well. High fixed costs tend to be associated with lower intensity of sourcing from smallholders. The results suggest that compliance with private food safety standards does not drive the exclusion of smallholders from export value chains; indeed, conversely, the requirement to comply with such standards is associated with greater intensity of sourcing from smallholders. Smallholders evidently play a key role in the defrayment of risk by exporters in that many exporters combine their own production with smallholder procurement. Costs of procurement from smallholders, however, remain an issue. Evidently, the fixed costs of smallholder supply chains increase appreciably with the intensity of sourcing. The research reported here provides a new perspective on the inclusion of smallholders in export value chains for horticultural products. The incorporation of smallholders into these value chains is seen as the outcome of the procurement decisions of exporters. Contrary to much of the discourse in this area, the results suggest that smallholders can and do compete in export value chains for horticultural products even in the context of exacting food safety standards.

Abstract

The study aims at reviewing a synthesis of disclosure, transparency, and International Financial Reporting Standards (IFRS) implementation in an attempt to provide directions for future research. Prior research overwhelmingly supports that the IFRS adoption or effective implementation of IFRS will enhance high-quality financial reporting, transparency, enhance the country’s investment environment, and foreign direct investment (FDI) (Dayanandan, Donker, Ivanof, & Karahan, 2016; Gláserová, 2013; Muniandy & Ali, 2012). However, some researchers provide conflicting evidence that developing countries implementing IFRS are probably not going to encounter higher FDI inflows (Gheorghe, 2009; Lasmin, 2012). It has also been argued that the IFRS adoption decreases the management earnings in countries with high levels of financial disclosure. In general, the study indicates that the adoption of IFRS has improved the financial reporting quality. The common law countries have strong rules to protect investors, strict legal enforcement, and high levels of transparency of financial information. From the extensive structured review of literature using the Scopus database tool, the study reviewed 105 articles, and in particular, the topic-related 94 articles were analysed. All 94 articles were retrieved from a range of 59 journals. Most of the articles (77 of 94) were published 2010–2018. The top five journals based on the citations are Journal of Accounting Research (187 citations), Abacus (125 citations), European Accounting Review (107 citations), Journal of Accounting and Economics (78 citations), and Accounting and Business Research (66 citations). The most-cited authors are Daske, Hail, Leuz, and Verdi (2013); Daske and Gebhardt (2006); and Brüggemann, Hitz, and Sellhorn (2013). Surprisingly, 65 of 94 articles did not utilise the theory. In particular, four theories have been used frequently: agency theory (15), economic theory (5), signalling theory (2), and accounting theory (2). The study calls for future research on the theoretical implications and policy-related research on disclosure and transparency which may inform the local and international standard setters.

Abstract

This paper suggests that a corporate-environmental food regime is emerging as part of a larger restructuring of capitalism. Like past food regimes, it reflects specific social and political compromises, which I interpret through the social movement concept of interpretive frames. The diasporic-colonial food regime of 1870–1914 grew up in response to working class movements in Europe, and created a historically unprecedent class of commercial family farmers. When world markets collapsed, those farmers entered into new alliances, including one that led to the mercantile-industrial food regime of 1947–1973. Lineaments of a new food regime based on quality audited supply chains seems to be emerging in the space opened by impasse in international negotiations over food standards. Led by food retailers, agrofood corporations are selectively appropriating demands of environmental, food safety, animal welfare, fair trade, and other social movements that arose in the interstices of the second food regime. If it consolidates, the new food regime promises to shift the historical balance between public and private regulation, and to widen the gap between privileged and poor consumers as it deepens commodification and marginalizes existing peasants. Social movements are already regrouping and consolidation of the regime remains uncertain.

Abstract

Purpose

This chapter outlines incorporation of voluntary environmental accounting standards into national law as evidenced by the Scandinavian experience. In illustrating such hardening of soft law approaches it highlights difficulties national authorities face when attempting to regulate globalised commercial entities with extra-territorial activities. Adoption at national level of these standards into legally binding obligations illustrates convergence of global governance standards even where there is no central authority or designed codification.

Methodology/approach

Doctrinal legal research and literature review. To illustrate the incorporation of voluntary standards at a national level, Scandinavian examples (Denmark, Norway, Sweden and Finland) were chosen – frequently upheld as best practice in requiring the reporting of environmental information financial reports.

Findings

The research shows that the most proactive national authorities in this regard are endorsing certain voluntary standards and rewarding their use with reduced regulatory burden. I first outline certain voluntary environmental standards and then illustrate adoption of these standards into legally binding frameworks.

Research limitations

The main limitation was difficulty in finding English language versions of some national regulations.

Practical implications

This chapter seeks to illustrate a normativisation of soft law frameworks into legally binding national obligations. Viewed through the phenomenon of Global Administrative Law it would seem evident that national authorities are willing to adopt various international voluntary standards to regulate the increasingly globalised actions of companies.

Originality/value

Voluntary standards and the various reporting methods of non-financial information is an extremely broad regulatory sphere with decentralised regulation and parallel regulatory frameworks. This chapter, in illustrating the convergence of environmental governance standards through normativisation of previously voluntary standards, will assist the reader in attaining an overview of the extent of this regulatory convergence.
