Abstract

Purpose

This purpose of this paper is to discuss the relationship between political independence and operational impartiality in regard to the effectiveness of anti-corruption agencies (ACAs). Against this background of western orthodoxy, it asks whether a non-western country with high levels of corruption (Vietnam being an example) can find another pathway in its efforts to effectively combat corruption.

Design/methodology/approach

An exercise in qualitative conceptual clarification and theoretical speculation, drawing upon practical examples.

Findings

It is argued that it is important to distinguish between de jure and de facto political independence, and that neither can be fully understood unless they are considered in relationship to other key values, particularly operational impartiality, public accountability, and systemic legitimacy, and in the context of bureaucratic politics. There is little coherent theoretical knowledge available about the relationships among these variables. Such values are central to western notions of “good government” but are much less institutionalised in non-western jurisdictions with high levels of corruption. The question is raised: can such countries, Vietnam being one example, develop effective anti-corruption strategies which because of the nature of their own political system, cannot depend on political independence for its ACAs?

Originality/value

Attention is drawn to some conceptual and putatively theoretical issues relating to the effectiveness of ACAs, and which have received little explicit attention in the relevant academic literature.

Abstract

Neutrality has traditionally been considered a key trait of the civil service in Western democracies. The conception of the neutral bureaucracy is closely linked to the notion of the prominent politics–administration dichotomy of the two spheres of politics and administration, as advocated by Max Weber (1980) and Woodrow Wilson (1887). According to conventional wisdom, the firm and encompassing implementation of the merit principle realises the idea of a neutral bureaucracy. In that respect, neutrality and merit-based recruitments are often considered the opposite of politicisation. Conventionally, a neutral bureaucracy is considered to assure competence and immunity against opportunistic ideas brought in by volatile, sometimes erratic political leadership. Because elected politicians come and go with elections, they cannot ensure that political decisions are carried out based on the ‘best’ available knowledge. In that sense, bureaucrats are conceived as neutral, obedient servants that subordinate their behaviour to the will of political masters, to the law and the common good. However, there is no strict politics–administration dichotomy in contemporary politico-administrative systems. Empirical findings from the late 1970s onwards demonstrated that bureaucrats are by no means as neutral and ‘apolitical’ as assumed, but rather remarkably involved in political processes. This chapter discusses the literature on neutral competence and presents an empirical analysis of Danish and British civil servants’ accounts of neutrality. This chapter concludes by suggesting the concept of competent neutrality and discussing implications for our understanding of bureaucratic neutrality.

Codes of conduct have been adopted very broadly on both sides of the Atlantic in the last two decades. They have been introduced for both elected representatives and appointed officials. Though the accountability mechanisms vary, elected politicians prefer self-policing and enforcement. For appointed officials who carry out specialized functions with exposure to particular, clearly identifiable, ethical risks, where the need for public trust and confidence is great, it is important but also relatively straightforward to develop codes of practice. For generalist public servants, the situation is different. The range of ethical risk to which civil servants are exposed is broader. It is less easy to be specific about the risks involved.

Abstract

Purpose

This paper aims to explore the ethical dilemmas faced by records administrators concerning political impartiality by examining the case of the National Archives and Records Administration (NARA) in the USA, which has faced reputational challenges due to perceived political bias.

Design/methodology/approach

This paper proposes a phronetic approach to resolve the ethical dilemmas associated with political impartiality in records administration. This approach emphasizes practical wisdom and ethical decision-making, offering a unique and effective way to address the challenges faced by presidential record archivists.

Findings

The proposed phronetic approach provides a means to resolve the ethical challenges posed by political impartiality in records administration, with a particular focus on NARA. By taking a transparent and impartial approach, agencies can minimize criticism and ensure their continued ability to equitably serve the public.

Practical implications

The phronetic approach offers a framework for addressing ethical dilemmas related to political impartiality in records administration, with potential implications for other independent agencies facing similar challenges.

Originality/value

This paper offers a unique perspective on the ethical dilemmas of political impartiality in records administration and proposes a practical and effective approach to resolving these challenges. It contributes to the broader discussion on the intersection of ethics and public administration.

Abstract

Denmark’s apparent success at controlling corruption is likely both real and more complex than it may appear. This chapter reviews a series of hypotheses about the extent and sources of corruption control in Denmark, emphasizing both domestic and international factors. Some possible vulnerabilities are discussed, including whether Greenland – which is usually excluded from Danish governance ratings – might introduce corruption via its mining industries, and whether the growing wind-power industry (in some senses, another extractive enterprise) might also encourage corruption. A simple data analysis, using the Gothenburg University Quality of Government Impartiality Index, suggests that small social scale, a homogeneous population, competitive politics, and extensive international connectedness might well help check Danish corruption, but relationships among the variables are complex and marked by considerable simultaneity. Denmark illustrates two subtleties often overlooked: the importance of “soft controls” – social values, a working consensus, an emphasis on fairness, and common goals – for corruption control, and the question of whether advanced market societies really control corruption or merely reduce incentives to engage in it, as a result of business-friendly policies and institutions. A final issue involves dependent variables: better indirect measures of corruption might well be obtained by gathering and benchmarking indicators of government performance.

Abstract

Purpose

In 2019, civil servants in Hong Kong publicly protested against their government as part of the anti-extradition bill movement. This study aims to understand how civil servants formed their support to the movement despite a deep-rooted bureaucratic culture. The authors argue that moral values (e.g. impartiality and integrity) and aspirations to liberal democracy are powerful motivations that override bureaucratic values (e.g. political neutrality and political loyalty) in the context of social movement.

Design/methodology/approach

Based on a protest on-site survey (n = 277), this study analyzes the relationship between civil servants’ value orientations and their political demands and actions.

Findings

Regression analyses show that civil servants’ consideration of moral values relates positively to support to investigative demands, while a more liberal orientation predicts greater support to consequential demands and action intentions. A moderation effect is found in which greater consideration of moral values attenuates the negative effect of bureaucratic values on the support to both types of demands. In addition, the two types of values interact with each other to influence support to consequential demands, which, in turn, predicts willingness to further political actions.

Originality/value

This study seizes a valuable opportunity to examine the political participation of civil servants in Hong Kong. As Hong Kong and the civil service system face tightening authoritarian controls, the findings shed light on the dynamics of moral values, bureaucratic values and liberal orientation in motivating resistance among civil servants.

Abstract

Purpose

The notion that disasters are not natural is longstanding, leading to a growing number of campaigns aimed at countering the use of the term “natural disaster.” Whilst these efforts are crucial, critical perspectives regarding the potential risks associated with this process are lacking, particularly in places affected by violent conflict. This paper aims to present a critical analysis of these efforts, highlighting the need to approach them with care.

Design/methodology/approach

The author draws upon insights and discussions accumulated over a decade of research into the relationship between disasters and conflict. The article includes a critical literature review on the disaster–conflict relationship and literature specifically addressing the idea that disasters are not natural. The analysis of field notes led to a second literature review covering topics such as (de) politicisation, instrumentalisation, disaster diplomacy, ethics, humanitarian principles, disaster risk reduction, peacebuilding and conflict sensitivity.

Findings

This analysis underscores the importance of advocating that disasters are not natural, especially in conflict-affected areas. However, an uncritical approach could lead to unintended consequences, such as exacerbating social conflicts or obstructing disaster-related actions. The article also presents alternatives to advance the understanding that disasters are not natural whilst mitigating risks, such as embracing a “do-no-harm” approach or conflict-sensitive analyses.

Originality/value

The author offers an innovative critical approach to advancing the understanding that disasters are not natural but socio-political. This perspective is advocated, especially in conflict-affected contexts, to address the root causes of both disasters and conflicts. The author also invites their peers and practitioners to prioritise reflective scholarship and practices, aiming to prevent the unintentional exacerbation of suffering whilst working towards its reduction.
