Abstract

Based on extensive empirical fieldworks conducted in Belgian and French family justice courtrooms in order to explain how culture and ethnicity are processed and understood in the daily reasoning and assumptions of legal professionals, this chapter analyzes different forms in which culture and ethnicity are framed in family law cases. Understanding how and along which dimensions these elements do vary in judicial reasoning constitutes the preliminary but necessary step before assessing the need of cultural expertise as such. In this attempt, we shed light on a scope of variations between complex and non-deterministic models of culture – consistent with contemporary anthropology literature – and more simplistic ones, in which culture and identity are conceived as fixed realities. Throughout this path between norms, facts, and stereotypes, we illustrate not only the multiplicity and complexity of forms which cultural elements can take in the exercise of family justice, but also the risks that some significances may carry with them and the urgent need to improve more fluid and dispassionate conceptions of cultural diversity before developing “cultural expertise” as such, an expertise that could otherwise reinforce stereotypical and fixed views of “cultures.”

Abstract

Using Kunming, the capital of China's southwest Yunnan Province, as an example, this mixed-methods research examines three interacting dimensions of social change in contemporary China: migration, ethnicity, and education. In particular, it sheds light on the issue of educational achievement of migrant children, especially children of ethnic minority background. The quantitative portion of the study is based on data gathered from over 700 sample students, teachers, and principals who participated in the “2008 Kunming Migrant Children's Survey.” A two-level hierarchical linear modeling (HLM) is employed to identify student- and school-level factors and to estimate the impacts of these factors on migrant children's academic achievement. The qualitative portion of the study is based primarily on the data collected through in-depth individual interviews and focus-group discussions with 97 migrant students, teachers, and school principals from 10 government and nongovernment migrant children's schools in Kunming between 2008 and 2009. The qualitative and quantitative results highlight four interrelated groups of educational barriers experienced by migrant students in pursuing compulsory education: institutional, socioeconomic, cultural, and psychological barriers. In particular, cultural and psychological barriers, including difficulty in school adaptation, low self-esteem, lack of family support, and discrimination against ethnic minorities due to their different religious beliefs and ethnic traditions, are found to have exerted particularly significant negative influences on academic achievements of ethnic minority students.

Abstract

Purpose

The purpose of this paper is to investigate the families’ and professional caregivers’ experience of mental health services for patients in the migrant population with intellectual disability (ID).

Design/methodology/approach

To highlight this rarely studied topic, the authors chose a qualitative approach, using a semi-structured interview guide. The authors performed a search for relevant articles. Three families of former patients of a specialized psychiatric inpatient unit and 12 professional caregivers were interviewed. The interviews were taped, transcribed and analyzed using a thematic analysis.

Findings

In total, 17 themes from the families’ answers and 14 themes from the caregivers’ answers were grouped into four main themes each. Two main themes were identical for both groups: perspectives on mental illness and “the Norwegian system.” Additionally, the families were concerned about the impact on the patient and family and coping strategies. The caregivers highlighted patient–caregiver interaction and family–caregiver interaction.

Research limitations/implications

Further research should include the patients’ opinions based on the findings of this study. Also, studies including larger samples from both specialist services and community services are needed to develop evidence-based services for these patients.

Practical implications

Proposed adaptations to enable assessment and treatment of mental illness in migrants with ID should be adapted to cultural preferences. The following adaptations are proposed: inclusion of the entire family, awareness of cultural dimensions, information about the health care system, education in mental illness, the use of interpreters and adequate time spent with the families.

Originality/value

Mental health services for this group are an understudied topic. Clinical experience indicates that professionals struggle when providing services for such patients.

Abstract

Purpose

The aim of this article is to explore the phenomenon of gifted migrants in vocational training and education. To date, migrant apprentices have been predominantly discussed from a deficit perspective. Special attention has been given to competence insufficiency and underperformance, as well as to migrant adolescents’ lack of professional and educational attainment. However, recent research points to a social group of migrants who are successful educational and professional achievers.

Design/methodology/approach

The article at hand discusses five theoretical models commonly applied to explain underachievement among migrant adolescents. It then examines these models’ explanatory power to predict migrants’ educational success. To conclude, the research parameters and theoretical framework of a Swiss longitudinal study designed on the basis of these findings is presented.

Findings

Educational research has increasingly focused on migrants, as well as on vocational education and training. However, what resulted from existing research is a predominantly unfavorable image of migrant apprentices that exclusively portrays them as so called “educational losers” of socio‐economically and culturally disadvantaged backgrounds. Based on theoretical explanatory models, a number of assumptions were extracted to show how educational success among migrants could be explained and whether resilience factors play a role in it. From the resilience perspective, professional success of migrant apprentices is likely to result from a stable, long‐term attachment figure or mentor who served as a role and identification model and was of significant importance in the adolescents’ workplace, for example as professional mentor. Furthermore, it is expected that educational facilities, in particular vocational training institutions, must have excelled in demanding high educational achievement, providing clear organizational and management structures, and high teaching quality as well as good instructor‐learner relationships.

Originality/value

As has been shown, educational research has increasingly focused on migrants, as well as on vocational education and training. However, what resulted from existing research is a predominantly unfavorable image of migrant apprentices that exclusively portrays them as so called “educational losers” of socio‐economically and culturally disadvantaged backgrounds. This implies that educational and professional success is not attainable for youths from disadvantaged families. On the other hand, successful migrant careers have been exemplarily portrayed; systematic research however is scarce and virtually non‐existent in German‐speaking academia. The lack of educational policy debate about successful migrants is probably a result of this research gap.

Abstract

Purpose: This chapter analyses the effects of social stratification and inequalities on the outcomes of transnational mobilities, especially on the educational trajectory of returning migrant children.

Study approach: It places the Bourdieusian capital concepts (Bourdieu, 1977, 1984) centre stage, and analyses the convertibility or transferability of the cultural and social capital across different transnational locations. It examines the serious limitations of this process, using the concept of non-dominant cultural capital as a heuristic analytical tool and the education system (school) as a way of approaching the field. As we examine ‘successful mobilities’ of high-status families with children and racialised low-status families experiencing mobility failures, our intention is to draw attention on the effect of the starting position of the migrating families on the outcomes of their cross-border mobilities through a closer reading of insightful cases. We look at the interrelations of social position or class race and mobility experiences through several empirical case studies from different regions of Hungary by examining the narratives of people belonging to very different social strata with a focus on the ‘top’ and the ‘bottom’ of the socio-economic hierarchy. We examine the transnational mobility trajectories, strategies and the reintegration of school age children from transnationally mobile families upon their return to Hungary.

Findings: Our qualitative research indicates that for returning migrants not only their available capitals in a Bourdieasian sense but also their (de)valuation by the different Hungarian schools has direct consequences on mobility-affected educational trajectories, on the individual outcomes of mobilities, and the circumstances of return and chances for reintegration.

Originality: There is little qualitative research on the effects of emigration from Hungary in recent decades. A more recent edited volume (Váradi, 2018) discusses various intersectionalities of migration such as gender, ethnicity and age. This chapter intends to advance this line of research, analysing the intersectionality of class, ethnicity and race in the context of spatial mobilities through operationalising a critical reading of the Bourdieusian capitals.

Abstract

Purpose

By combining manifold approaches from migrant entrepreneurship and family business studies, the purpose of the paper is to shed some light upon the contextual features of motivation, resources, generational pathways of Turkish migrant family entrepreneurs in Berlin – through the lens of a mixed and multiple embeddedness approach.

Design/methodology/approach

An explorative research design, based on an eclectic theoretical framework and on purposive sampling, combines qualitative in-depth interviews/content analysis and on-site observation resulting in an almost ethnographic assessment of selected case studies of Turkish migrant family entrepreneurs (concerning age (min. 20 years), size (15+ employees) and currently at a stage of succession).

Findings

The results show that despite specific strategies vary – four circumstances hold true for all cases: (1) firm trajectories were characterized by little strategic planning and mostly trail-and error processes in the past and business survival is highly dependent on owner families; (2) owner families heavily relied on personal, family and collective resources, not benefiting from promotion programmes or micro-funding measures for SMEs; (3) owner families have actively developed their (mixed) embeddings during the growth of their migrant business beyond the single ethnic group at various spatial scales; (4) succession adds another layer of context – what we call here multiple embeddedness – with ambivalent effects: emerging potentials and conflicts between the preceding and succeeding generation.

Practical implications

Results have shown that is it necessary to set up both: customized funding opportunities for migrant start-ups in general and succession consulting for migrant family entrepreneurs in particular. Given the magnitude of family migrant entrepreneurs and the accelerating migration patterns in most Western European countries, there is urgent need for such measures.

Originality/value

Family entrepreneurship has been often discussed without a migration perspective, neither taking a systematic look at pertinent motivation, resources, and future trajectories nor context. Migrant entrepreneurship studies barely take the family or family-specific issues (e.g. succession) into account, and mainly deal with the integration or economic aspects. Our mixed and multiple embeddedness approach allows for a holistic view on transgenerational migrant family entrepreneurship by integrating both socio-spatial (actor, family, network, micro, meso, macro) and multi-generational contexts (preceding, succeeding).

Purpose

As migration of family members becomes an omnipresent phenomenon, the conventional norm of having a family and living under the same roof together is far from normal for many households. It produces transnational practices and multisite lifestyle configurations. This study aims to explore the implication of maternal absence as a result of transnational labour migration on the left-behind child in the context of transnational labour migration from Ethiopia.

Design/methodology/approach

It focusses on the perspective of those who stayed behind. The ethnographic fieldwork was carried out in two rural villages – Bulebullo and Bokekesa – of Worebabbo district in Northern Ethiopia. It involved in-depth interviews with children and their caregivers supported by interviews and group discussions with members of the community, local officials and traditional leaders.

Findings

Transnational mothering and other mothering emerge as new practices of mothering in the rural villages due to maternal absence have interrelated implications and meanings for the left-behind child. However, the rigidity of sending societies’ norms related to mothering and gendered labour dynamics exacerbated the negative implications of maternal absence on left-behind children. The absence of the fathers’ effort to redefine mothering or fathering by providing childcare is part of the equation in the relationship between maternal absence and left-behind children.

Originality/value

The findings of this study refute the notion that labels mother’s out-migration as “abandoning children”, “disrupting families” and “acts of selfishness”.

Abstract

Korean educational migrant (kirogi) families have received widespread popular attention due to their ironic form of family that sacrifices the togetherness of a family. Recent trends suggest that this practice is spreading to the less affluent classes and that many such families are heading to ‘new’ destinations, including Singapore. This study examines the transnational schooling and life experiences of Korean transnational educational families in Singapore. It addresses the questions, why did these families choose Singapore? Why did transnational schooling, which parents almost unanimously said that they had organised for the betterment of their children's future, lead to some families getting stuck in the destination country?

Fieldwork in Singapore and Korea was conducted between April 2006 and September 2007. In-depth interviews with both mothers and fathers who have at least one child attending public, private or international schools in Singapore, at the primary or secondary level, were conducted with 18 families. The analysis was conducted using a grounded theory approach and NVivo 7/8.

Although the Korean state's emphasis on international competitiveness and parental aspirations for their children's future upward social mobility were common motivators, Koreans in Singapore were also attracted by the relatively low cost, English–Chinese bilingualism and other ‘family-friendly’ features in Singapore. However, kirogi children had highly contrasting schooling experiences and they met with mixed success in gaining what they expected. Furthermore, many children in public schools faced demotion and other difficulties in their new school environments. Some less affluent families found themselves facing dilemmas of cross-border schooling. This study shows that transnational schooling does not necessarily operate equally favourably for participants from diverse class backgrounds. It also demonstrates that the societal contexts of reception in both the countries of origin and of destination, including the buffering institutions and reference groups and peer culture, are important factors shaping the schooling and life experiences of educational migrant children and in reconfiguring their trajectories.

The immigration conundrum to craft policy that ensures border security and safeguards human rights is grave and complex. Individuals fleeing religious persecution made finding refuge part of our heritage since colonial times. This American tradition has enshrined our values to the world. This essay is limited to summarizing the asylum process and recent events through the summer of 2018 which affect it. Policy changes are ongoing. The asylum process is complicated by illegal immigration. The surge in migrants arriving at and/or crossing the border has led to controversial policies over the years. Unlike those who illegally cross the border and remain unknown to law enforcement, everyone who makes an affirmative asylum claim to a United States Citizenship and Immigration Services (USCIS) officer, or a defensive asylum claim in immigration court, has been thoroughly vetted through identity, criminality, and terrorism background checks. Granting refuge to those fleeing persecution reaffirms the values of a country that is, as Lincoln richly stated, the last best hope of Earth. Comprehensive immigration reform is needed on many immigration issues, two of which are to ensure border security and safeguard the asylum-seeking process.
