Abstract

The debate over ‘judicial activism’ has flourished in recent decades, but the term was in fact coined 70 years ago, by the historian Arthur Schlesinger, Jr. The legal academy has bemoaned the term as perpetually ill-defined, but can this be attributed to its equivocal beginnings on the pages of Fortune magazine? This chapter investigates the circumstances in which the term was produced and the early meanings given to it in scholarly work. It is argued that there was very little effort on the part of legal academics and political scientists to gather a consensus as to definition, or otherwise to treat the terminology with caution, before the term was wrested from the university cloisters and captured by the popular media in the mid-1960s.

Abstract

Purpose

The practice of restraint and confinement of patients with mental disorders is common in Indonesia. This practice is known as pasung and is usually carried out by the family or the villagers in community settings. The previous separated studies have investigated the reasons for, methods, duration and consequences of applying pasung to the patients. A scoping review is needed to study the existing practice of restraint and confinement in Indonesian communities. This study aims to review the published studies on the practice of restraint and confinement of people with mental illness (PWMI) in Indonesia.

Design/methodology/approach

A scoping review method was used to identify studies on the practices of restraint and confinement of PWMI. A search of Science Direct, PubMed database and Google Scholar for articles was conducted.

Findings

There is an increasing interest in studying the pasung-related aspects among Indonesian mental health practitioners. The studies included the patients, family, caregivers and community as the research subjects. Various elements of pasung; the actors, duration, reason, the consequences and the challenges in releasing pasung have been reported. Stakeholders should consider many factors related to pasung to achieve the free pasung program in Indonesia.

Research limitations/implications

Pasung is a practice that exists in a significant number in Indonesia. Although researchers have sounded the importance of the pasung as a problem in the community, much has to be done to alleviate the inhuman treatment of PWMI.

Originality/value

This paper adds to the literature on the research concerning the practice of restraint and confinement of PWMI. The findings could be uses as the basis of the improvement of policy on mental health services, not only in Indonesia but also in other countries where the practice of restraint and confinements of PWMI in the community settings is existing.

Abstract

Purpose

This paper aims to investigate the need for active boundary conditions during fire testing of structural elements, review existing studies on hybrid fire testing (HFT), a technique that would ensure updating of boundary conditions during a fire test, and propose a compensation scheme to mitigate instabilities in the hybrid testing procedure.

Design/methodology/approach

The paper focuses on structural steel columns and starts with a detailed literature review of steel column fire tests in the past few decades with varying axial and rotational end restraints. The review is followed with new results from comparative numerical analyses of structural steel columns with various end constraints. HFT is then discussed as a potential solution to be adapted for fire testing of structural elements. Challenges in contemporary HFT procedures are discussed, and application of stiffness updating approaches is demonstrated.

Findings

The reviewed studies indicate that axial and rotational restraints at the boundaries considerably influence the fire response of steel columns. Equivalent static spring technique for simulating effect of surrounding frame on an isolated column behavior does not depict accurate buckling and post-buckling response. Additionally, numerical models that simulate fire performance of a column situated in a full-frame do follow the trends observed in actual test results up until failure occurs, but these simulations do not necessarily capture post-failure performance accurately. HFT can be used to capture proper boundary conditions during testing of isolated elements, as well as correct failure modes. However, existing studies showed cases with instabilities during HFT. This paper demonstrates that a different stiffness updates calculated from the force-displacement response history of test specimen at elevated temperature can be used to resolve stability issues.

Originality/value

The paper has two contributions: it suggests that the provision of active boundary conditions is needed in structural fire testing, as equivalent static spring does not necessarily capture the effect of surrounding frame on an isolated element during a fire test, and it shows that force-displacement response history of test specimen during HFT can be used in the form of a stiffness update to ensure test stability.

Abstract

Purpose

In literature, previous studies have focused on analyzing rienforced concrete (RC) columns with idealized end conditions when subjected to fire. In nature, full fixity or free rotation at column ends is not attained. Such ends may be considered partially restrained in rotation. This paper aims to shed a new light on the effect of different degrees of rotational restraint on the lateral deformation behavior of slender heated RC columns subjected to non-linear strain distributions produced by a time-dependent temperature history.

Design/methodology/approach

To find the strain distribution on the cross section, an iterative technique is adopted using Newton–Raphson method. By introducing a reliable calculation procedure, the lateral deformational behavior is expressed using numerical and searching techniques. A methodology is presented to calculate the effective length factor for RC columns at elevated temperature.

Findings

The results of the proposed model showed good agreement with available experimental test results. It was also found that the variation of rotational end restraint level has a considerable effect on the lateral deformation behavior of heated slender RC columns. In addition, the effectiveness and the validity of an analytical model should be verified by simultaneously validating the axial and lateral deformations. Moreover, the effective length factor for heated column is higher than that for the corresponding column at ambient temperature.

Originality/value

This paper shows the impact of different boundary conditions on the behavior of heated slender RC columns. It suggests powerful techniques to determine the lateral deflection and the effective length factor at high temperatures.

Abstract

Purpose

This paper aims to investigate computationally and analytically how different levels of restraint from surrounding structure, via catenary action in beams, affect the survival of steel framed structures in fire. This study focuses on examining the mid-span deflection and the tensile axial force of a non-composite heated steel beam at large deflection that is induced by the catenary action during exposure to fires. The study also considers the effect of the axial horizontal restraints, load-ratio, beam temperature gradient and the span/depth ratio. It was found that these factors influence the heated steel beam within steel construction and its catenary action at large deflection. The study suggests that this may help the beam to hang to the surrounding cold structure and delay the run-away deflection when the tensile axial force of the beam has been overcome.

Design/methodology/approach

This paper is part one of the parametric study and discusses both the effect of the axial horizontal restraints and load-ratio on the heated steel-beam. Reliance on the prescriptive standard fire solutions may lead to an unpredicted behaviour of the structure members if the impact of potential real fires is not considered.

Findings

Variation of the horizontal end-restraint level has a major effect on the behaviour of the beam at high deflection, and the loading on a beam at large displacement can be carried effectively by catenary behaviour. An increase of axial horizontal stiffness helps the catenary action to prevent run-away at lower deflections. The studies also investigated the influence of varying the load ratio on the behaviour of the heated beam at large deflection and how it affects the efficacy of the catenary action. The study suggests that care should be taken when selecting the load ratio to be used in the design.

Originality/value

In a recent work, the large deflection behaviours of axially restrained corrugated web steel beam (CWSB) at elevated temperatures were investigated using a finite element method (Wang et al., 2014). Parameters that greatly affected behaviours of CWSB at elevated temperatures were the load ratio, the axial restraint stiffness ratio and the span–depth ratio. Other works included numerical studies on large deflection behaviours of restrained castellated steel beams in a fire where the impact of the catenary action is considered (Wang, 2002). The impact of the induced axial forces in the steel beam during cooling stage of a fire when the beam temperature decreases, if thermal shortening of the beam is restrained, large tensile forces may be induced in the beam (Wang, 2005; Allam et al., 2002). A performance-based approach is developed for assessing the fire resistance of restrained beams. The approach is based on equilibrium and compatibility principles, takes into consideration the influence of many factors, including fire scenario, end restraints, thermal gradient, load level and failure criteria, in evaluating fire resistance (Dwaikat and Kodur, 2011; Allam et al., 1998).

Abstract

Purpose

Green roofs are acknowledged as a method to substitute greenery washed out by the urbanization. They provide many ecological and sustainable benefits of greenery; reduce the adverse effects of high-rise building constructions. Though this concept is more popular across many countries over the past few decades, still, implementation of this technology in Sri Lanka is new and scant. Hence, the purpose of this paper is to identify and analyze the potential of green roofs in high-rise buildings in Sri Lanka.

Design/methodology/approach

The data collection was conducted through expert interviews and questionnaire survey. Expert interviews were carried out to validate the prospects and restraints identified through literature review to the Sri Lankan context and analyzed using content analysis. Questionnaire survey identified the most significant prospects and restraints using descriptive statistics and paired sample t-test. Purposive sampling was used to select participants.

Findings

Reduction of air pollution, aesthetical appearance, thermal benefits and energy savings, reduction of an urban heat island effect, the addition of points in the green rating system are the top most significant prospects that need to be highlighted in promoting green roof systems in Sri Lankan high rises. Less space allocation on rooftops, lack of technical competence and lack of awareness and research are restraints that need most effective elimination strategies to encourage green roof systems.

Originality/value

The first identified and quantified prospects and restraints for green roof system in Sri Lankan high-rise buildings can be utilized by the government, donors, multi-lateral agencies to promote the sustainable development in Sri Lanka and this knowledge could be used in different scale awareness programs. The value of this paper is such that the paper discusses the links of green roofs with the other facets of sustainability. The new legal reforms and amendments in Sri Lanka could potentially be pending with findings of this study.

Abstract

Purpose

The appearance retention of trouser creases, subject to tumble drying, for some trousers can be improved by the simple process of restraining the inner leg seam to the aligned outer seam of the trouser leg at a single point just below the crotch. The purpose of this paper is to assess the effectiveness of this approach on crease retention during laundering for a variety of commercially available trousers of different fibre compositions and blends.

Design/methodology/approach

Trousers made from various fibres and blends were purchased at retail and were washed and tumble dried as received, or after treatment (e.g. to provide shrink resistance for wool trousers or to improve the level of permanent set in the crease), with one leg restrained while the other was free and the impact on crease retention assessed.

Findings

The findings indicate that the use of a restraint device provides the largest improvement to the crease appearance for trousers constructed from wool or wool blends with polyester. Some level of permanent set is necessary for the restraint to function and an improvement in crease rating of up to three points (AATCC 1‐5 scale) is possible after five laundry cycles.

Practical implications

An effective prototype trouser restraint device, suitable for use in a domestic environment was constructed based on two rare earth magnets and should allow the consumer to improve the appearance retention of trousers, particularly for those containing appreciable amounts of wool.

Originality/value

The method allows the consumer to improve the crease retention of wool containing trousers, beyond what is possible through industrial processes, by using a laundry aid (restraint).
