Abstract

Symbolical-interaction sociology is useful to mediators and relevant to mediation practice. It explores the elements of everyday social interaction including behavior of disputants during instances of conflict. In particular, Erving Goffman’s frame analysis offers mediators a practical tool useful in assessing and managing both the intellectual and emotional responses of disputants during mediation. Moreover, frame analysis can effectively guide mediators in assisting disputants to reorient their respective responses to each other and to the dispute, thereby enhancing opportunities for meaningful dialogue. In addition, Goffman’s game, drama, and ritual metaphors offer simple but powerful analytic tools guiding mediation clients through terrain which would otherwise be chaotic and overwhelming. Mediators committed to enhancing their practices and researchers in search of a sound theoretical base for effective dispute resolution can benefit substantially by applying these insights to the practice of mediation.

Abstract

The sociological and socio-legal literatures on social movements have identified three main types of “legal framing” in contemporary social movement discourse: collective rights framing, individual rights framing, and nationalistic legal framing. However, it is unclear from the current research how movement actors decide which of these framing strategies to use, under what circumstances, and to what effect. In this article, I offer a model for future empirical research on legal framing, which (1) distinguishes legal framing by its argumentative structure, ideological content, and remedy; and (2) analyzes how a social movement’s internal culture and institutional environment constrain the symbolic utility of particular legal frames and shape the movement’s legal framing strategy. I argue that the alternative approach offered here will help theorize how social movements strike a balance between the institutional pressure to reproduce dominant ideologies and the internal pressure to reform those ideologies. This perspective thus helps build socio-legal theory on the relationship between legal framing and social subordination, and on the conditions under which movements will be able to inflect legal language with insurgent social movement values.

Abstract

Capital budgeting projects fail about as often as they succeed. Recent research shows that accountants may frame information related to capital budgeting projects to be consistent with their preference for the project (e.g., accept or reject), perhaps in order to persuade management to agree with them. Psychology research consistently shows that framed information results in systematic differences in judgments. The purpose of this study is to examine whether framed information affects capital budgeting decisions, and to examine whether this effect is moderated by the importance of the potential project. Results from an experimental case completed by 173 participants indicate attribute frames affect capital budgeting decisions, however, the effect is moderated by the importance of the decision.
