Abstract

From one angle, abortion law appears to confirm the regime politics account of the Supreme Court; after all, the Reagan/Bush coalition succeeded in significantly curtailing the constitutional protection of abortion rights. From another angle, however, it is puzzling that the Reagan/Bush Court repeatedly refused to overturn Roe v. Wade. We argue that time and again electoral considerations led Republican elites to back away from a forceful assertion of their agenda for constitutional change. As a result, the justices generally acted within the range of possibilities acceptable to the governing regime but still typically had multiple doctrinal options from which to choose.

Abstract

The focus of this paper is the economic theory of the plans for the European Monetary Union. Part 1 demonstrates that economists, bankers and policy makers know very little about monetary policy. Part 2 explains the errors of the common practice of defining money by its functions. Because any monetary policy must rest on a definition of money it seems reasonable to conclude that a flawed definition might lead to problems with monetary policy. Part 3 applies this insight to the plans for a common currency in Europe. Because of uncertainties about the timing and details of the implementation, some important considerations are necessarily speculative. They are relegated to appendices. Appendix 1 comments on the timing and authorship and responsibility for the official reports with their unspecified authors. Appendix 2 supplies some grounds for doubting the ultimate durability of the European Monetary Union focusing on reasons that are historical, economic and pragmatic. Because the entire movement is driven by politics, not economics, Appendix 3 considers some of the relevant political issues. The conclusions summarize and speculate on possible reasons for successful outcomes.

Abstract

Purpose

Many studies have shown that the intensity and the number of hurricanes are likely to increase. This paper aims to look at the immediate effects of hurricanes on the time on the market, share of houses sold and percentage of houses with price cuts in the housing market using the metropolitan statistical area-level data in Florida.

Design/methodology/approach

Using a difference-in-difference method, the authors estimate the impact that a hurricane has on the housing markets.

Findings

The authors find that a hurricane has a positive and significant effect on the time on the market. A hurricane leads to a delay of the sale of a typical house in Florida by five days. The authors test for within-year seasonality and show that these effects change with seasonality of the housing market. Markets with seasonal housing prices tend to be affected more by hurricanes than those where housing prices are not seasonal. The authors also show that effects of a hurricane are transient and fade away in a few months. The results remain significant as the hurricane intensity changes.

Originality/value

This is the first study to look at the short-term effects of the hurricanes and how their effects vary based on seasonality of the markets.

Abstract

Purpose

The purpose of this paper is to raise concern and discussion about poverty. This paper explores the difficulties of defining poverty and its origins.

Design/methodology/approach

This paper utilizes research from psychological and sociological literature to analyze differing schools of thought regarding poverty. A macro‐level perspective of poverty is defined and compared to a micro‐level perspective of poverty. The lack of conformity concerning these opposing schools of thought often impedes the development of solutions for poverty.

Findings

What society believes to be true about poverty will influence how society treats poverty. Some solutions to poverty may only perpetuate the problems of the impoverished depending on how poverty is operationally defined and its origins understood. Literary research is used to support a hypothesis that poverty exists in function to society to insure a readily available, low wage, labor force.

Social implications

The provided information regarding the impact of poverty on society and the individual could aid in the development of government and corporate solutions. Solutions for poverty could be enhanced and employed more accurately by examining the viewpoint of this author.

Originality/value

This paper is of importance for mental health practitioners, corporations, and government branches interested in treating the social effects of poverty.

Abstract

Purpose

The purpose of this paper is to examine critically the history of Records Management Journal on its 20th anniversary; it aims to review and analyse its evolution and its contribution in the context of the development of the profession and the discipline of records management. The paper seeks to provide the context and justification for the selection of eight articles previously published in the journal to be reprinted in this issue.

Design/methodology/approach

The paper utilises the contents of Records Management Journal (1989 to date) to present a thematic analysis of topics covered and their development over time, and statistical data (from 2002 to date) provided by the current publisher to assess quantitatively the use and impact of the journal worldwide. The paper then compares this with a series of key turning points in the records management profession.

Findings

There is evidence that the initial aspiration for the journal to make an important and long‐lasting impact on the field of records management in the UK has been exceeded because its readers and contributors are global. The volume of downloads has continued to increase year‐on‐year and the journal appears to be the only peer‐reviewed journal in the world in the records management discipline. The journal has responded to and kept abreast of the records management agenda.

Research limitations/implications

The analysis is based on the work of the current and immediate past Editor and did not seek the views of its Editorial Board members, readers or contributors to the journal.

Practical implications

Looking to the future, the journal must seek to widen its impact on other key stakeholders in managing information and records – managers, information systems designers, information creators and users – as well as records professionals. It must also continue to develop the scope of its content, whilst maintaining its focus on managing records, and must keep pace with technology developments. It should try to influence the professional agenda, be controversial, stimulate debate and encourage change. And it should remain a quality resource.

Originality/value

The paper provides a unique critical analysis of the journal, its history and contribution to the development of records management, on its 20th anniversary of publication.

Abstract

Juries are a decision making peer group composed of citizens who did not volunteer for the task, who do not know one another, and who are not connected to the people and events in the trial on which they will render a verdict. This chapter illuminates the communication events during deliberations, from selecting a foreperson, deciding when and how to vote, participation and turn-taking, the emergence of conflict, and rule-breaking. Deadlock juries, storytelling jurors, and juror misconduct are described during the group's task. Sources for scholars to gain access to jury data, partner with organizations in the judicial system, and available recent recordings of jury deliberations are shared. Knowledge gaps are pointed out in understanding how group verdicts emerge from the unregulated talk of jurors, as well as new challenges for the judicial system as the 2020 COVID-19 pandemic suddenly rendered jury service an unhealthy task for citizens.
