Abstract

This paper draws on the experiences of project marketing and solution selling to improve the understanding of how to create superior value for customers. Project marketing and solution selling have both developed approaches to deal with complex marketing situations for a number of years now. The upstream mobilization of customer network actors and the downstream enlargement of the content and scope of the offering are the key features of these approaches.

This paper presents two case studies to focus attention on elements that are crucial to this twin-track approach. The downstream extension of the offering relies on services supporting the customer's action (SSC), which supplement traditional services that support the supplier's product (SSP). The upstream extension leads to an introduction to other types of services or elements of the offering – the services supporting the customer's network actors (SSCN).

Furthermore, the paper proposes a marketing process that takes the supplier's viewpoint, for whom the entire approach is a network mobilization, into account. This approach to the offering, which included SSP, SSC, and SSCN, is typical of a network strategy in which the supplier recruits and enrolls new actors to (re)model the buying center.

This marketing process is in tune with the latest developments of the service-dominant (S-D) logic, as it proposes a move from the value chain toward a value-creation network/constellation. Consequently, creating superior value for customer means mobilizing and servicing actors far beyond the boundaries of the buying center, supply chain, and customer solution net.

Abstract

Aldo Leopold's idea of a land ethic was inspired by his work in game management. The land ethic merged ecology with an aesthetic and ethical sensibility. This chapter traces the origins of the idea to Leopold's efforts to devise incentives for private landowners to share their land with wildlife. Scholars have failed to account for how Leopold's affection for the institution of private property shaped his ethical philosophy. Although the land ethic is conventionally understood as a defense of the rights of animals, plants, and the environment they inhabit, it was also a defense of property rights. The limitations of the land ethic as philosophical basis of wildlife management and conservation stem from these contradictory purposes. Although Leopold's ecological aesthetic may help people to visualize an alternative to the violent simplification and diminished biodiversity of the modern form of capitalist agricultural commodity production, his emphasis on voluntary mechanisms has detracted from the objective of liberating wildlife and the land they inhabit from human exploitation.

Abstract

Purpose

This paper analyzes changes in property rights, land uses, and culturally based notions of ownership that have emerged following privatization of communal land in a Samburu pastoralist community in Northern Kenya. The research challenges the strict dichotomy between private and collective rights often found in property rights literature, which does not match empirical findings of overlapping and contested rights.

Design/methodology/approach

Part of a long-term ethnographic project investigating the process of land privatization and its outcomes, this paper draws on in-depth interviews and participant observation conducted by the author in Samburu County in 2008, 2009, and 2010. Interviews focused on how land is being used post-privatization as well as emerging social norms regulating its use.

Findings

Privatization privileges male household heads with powers including rental, sale, and bequeathal of land. However, informal rights to land extend to women and other household members. Exercise of legal rights is frequently limited due to knowledge and resource gaps. New rules regulating land use have emerged, some represent sharp divergences from past practice while others support shared access to land. These changes challenge Samburu cultural notions of individuality, reciprocity, and shared responsibility.

Practical implications

This research illuminates complex changes following legal shifts in property rights and demonstrates the interactions between formal laws and informal social norms and cultural beliefs about land. The result is that privatization does not have easily predictable outcomes as some theories of property would suggest.

Originality/value

Empirical investigation of the effects of legal changes enables fuller understanding of the implications of policy changes that many governments are pursuing privatization with limited understanding of the likely effects.

Abstract

Legal and Sharīʿah issues abound in creating security to finance waqf property development in Malaysia, for it involves integrating the Sharīʿah concept of waqf with requirements of Malaysian land law as well as the requirements of modern finance under civil law. Banks and financial insti­tutions will not generally finance property development without any form of security for the loan. The best type of security transaction under Malaysian land law is to create a charge on the land under the National Land Code 1965, rendering the land liable as a security which upon default of the chargor, would entitle the chargee to seek statutory remedies including sale of the land. Such may not be feasible for waqf properties due to the inalienable nature of such properties. Due to the remedy of sale of the land upon default, the same issues would arise in regard to other types of securities like a lien and a loan agreement cum assignment. There is therefore a need to diversify the available options in creating security over waqf property. What are the existing Sharīʿah restrictions on waqf property? Do these restrictions affect the creation of security over waqf lands under conventional Malaysian land law? What are the legal and Sharīʿah issues relating to creating a charge over waqf lands? What are some feasible options? Initial findings are that creating a charge on a lease of waqf land as well as resorting to a hybrid form of a traditional security transaction in Malaysia, called ‘Jualjanji’, may hold some answers. Through doctrinal legal research and content analysis, this chapter explores these issues and recommends feasible solutions.

Abstract

Using the notion of sustainable impactful strategies for waqf management, this study examines the governance and best practices on idle waqf management by the Malaysian States Islamic Religious Councils (SIRCs) in selected states like Penang, Perak and Kuala Lumpur. The waqf management of the SIRCs is also assessed based on the model framework countries such as Singapore, Kuwait and United Arab Emirates (UAE). The findings of this chapter indicate that ineffective administration and management on waqf have hindered its development and expansion in Malaysia. Also, an effective and robust governance framework based on Shariah could and should be implemented to ensure that waqf in Malaysia are managed effectively to gain socio-economic sustainability of Muslim communities. The findings of this chapter will fill the research gap on good governance and best practices in waqf administration and management as a way forward for Malaysia by providing a way forward for SIRCs and policymakers in Malaysia, to enhance the performance of waqf entity using selected other countries as model framework of good governance and best practices. Furthermore, an emphasis on good governance and best practices is important to attract waqf donors. It is imperative to note that to date, there is no qualitative study that compare the impact of good governance and best practices on the management of waqf by selected SIRCs in Penang, Perak and Kuala Lumpur to Singapore, Kuwait and UAE as model framework countries.

Abstract

While land management can be a subject of conflict in places where the composition of landowners is socially and culturally diverse, it also holds the potential of bringing landowners together across social groups. This chapter uses the case of a peri-urban area near Copenhagen, Denmark, to examine the relations landowners have through their use and management of land within and across social groups. To elaborate the analysis and discussion of social groups, social coherence and fragmentation, this chapter introduces the concepts of homophily and self-categorisation. Interviews with 40 landowners from two parishes addressed four types of land-based relations: (1) exchange of help and services; (2) debate of farming/management; (3) shared interests and (4) friendship. While the pattern of relations overall supported the idea that people interact more with their own social group, the analysis also showed areas of interaction across groups as well. Three overall themes summarise important areas of cohesion/fragmentation: (1) Rented land and contracting, (2) Common interests between landowners including hunting, farming and horses, (3) Urgency and geographic proximity.

Land bank distribution in India is a complex subject and with the family size reduction, the average land holding is going down. Maintenance of the land records in physical format is very difficult. There are thousands of court disputes for different land parcels and managing the same is becoming a complex task. The aim of the chapter is to design a conceptual framework with electronic landbank records in dematerialized form, so that they can be easily maintained and traded. Associated benefits of implementing such system are also discussed. Authors have used secondary data published in previous research work in the area of Geographical Information System (GIS) and business analytics to analyze the prospects of land bank dematerialization and its possible applications. The chapter focuses on the need of regulatory support and associated IT infrastructure to put the plan in action. If implemented, this change can help India to transform its land management process and will also enable to explore commercial utilization of agricultural land and urban land plots for planned development.
