THE LOOMING MASS OF BLACK COMBE, and the sky‐line of the central fells that he can see from his window—Scafell, Scafell Pike, Great End, Harter Fell, Bowfell, Crinkle Crags, Coniston Old Man—are among the great shaping influences in the work of Norman Nicholson. The fells, the rocks that make the fells, the becks and the rivers that flow down the fells all speak to him and through him. The other great influence on his writing is his religious belief. As he himself said recently in a radio broadcast: ‘The universe is not just a huge mechanical coffee‐grinder, ticking over and over without aim or purpose. It works to a pattern; it works to a plan. And part of the sheer enjoyment of being among mountains comes from our sometimes feeling swept up in the plan, where every end is a new beginning and every death a new birth.’

This article discusses the perils of electronic communication, the regulators' response to its proliferation, the findings of a recent survey by Orchestria, and the traditional solutions most companies are adopting.

Discusses results of a survey that illustrates the uncontrollable nature of electronic communication; recent financial services regulations concerning document retention, activity supervision, and communication approval; archiving and other costs of electronic communication; the inadequacy of many companies' risk mitigation strategies; and a recommended active policy management approach.

The challenge that management and compliance staff face with unstructured communication is twofold: 1. the speed and informality with which messaging systems are used by employees to make assertions and promises and to transfer data, and 2. the almost total absence of management visibility and control over the content of such communications. In the current regulatory climate, not knowing what employees are communicating to each other, clients, suppliers, and other contacts is a significant risk.

The authors contend that quality and thorough documentation is as important as the quality of the care that is delivered to patients, since medical records are legal documents and serve as valuable evidence as to what transpired between patients and the healthcare providers.

Practical documentation strategies are described in a manner that will inform physical therapists of their legal obligations relating to patient care.

The October edition of Industrial Management featured the Nader‐style ‘consumerism’ building up in Britain with pressure groups harassing companies over the pollution issue. In November, this was followed by interviews with Environment Secretary Peter Walker, and with senior management men, defending the company role in the environment. Continuing the theme, five leading industrialists have written to Industrial Management, commenting on the articles. Here are their views.

The Department of Homeland Security (DHS) states in 2018 that safeguarding “civil liberties is critical” to their official duties. The Office for Civil Rights and Civil Liberties within DHS, as its website explains,

reviews and assesses complaints from the public in areas such as: physical or other abuse; discrimination based on race, ethnicity, national origin, religion, gender, sexual orientation, or disability; inappropriate conditions of confinement; infringements of free speech; violation of right to due process … and any other civil rights or civil liberties violation related to a Department program or activity.

My chapter tracks the centrality of deportability in shaping the civil liberties and rights that DHS is tasked with enforcing. Over the course of the twentieth century, people on US soil saw an expanding list of civil liberties and civil rights. Important scholarship concentrates on the role of the courts, state and federal governments, advocacy groups, social movements, and foreign policy driving these constitutional and cultural changes. For instance, the scholarship illustrates that coming out of World War I, the US Supreme Court ruled that the First Amendment did not protect something the Justices labeled “irresponsible speech.” The Supreme Court soon changed course, opening up an era ever since of more robust First Amendment rights. What has not been undertaken in the literature is an examination of the relationship of deportability to the sweep of civil liberties and civil rights. Starting in the second decade of the twentieth century, federal immigration policymakers began multiplying types of immigration statuses. A century later, among many others, there is the H2A status for temporary low-wage workers, the H2B for skilled labor, and permanent residents with green cards. The deportability of each status constrains access to certain liberties and rights. Thus, in 2016, when people from the Office for Civil Rights and Civil Liberties within DHS act, they are not enforcing a uniform body of rights and liberties that applies equally to citizens and immigrants, or even within the large category of immigrants. Instead, they do so within a complicated matrix of liberties and rights attenuated by deportability, which has been shaped by the history of the twentieth century.

The position of these Irish agitators is illogical and untenable; the remedy they propose is no remedy at all – nevertheless they are talking about the tenure of land and the right to land; and thus a question of worldwide importance is coming to the front.³

In Marx, a commodity is a thing brought to the market for sale at a profit where it satisfies a want rather than a need and embodies labour power and is purchased by the consumer as if it were a fetish. The term commodification did not come into usage until late in the 1970s but is now thrown around with some frequency, sometimes casually with imprecise meaning, sometimes more pointedly. Frequently it is used to indicate the shift of social activity previously conducted outside the market or commercial world generally, into the world of trade, money or exchange. Typical are these resolutions emanating from the headquarters of the ESIB, The National Unions of Students in Europe. The ESIB resolves to:Promote on an international level increased consciousness as to the current and possible future negative implications of commodification.Analyse in further detail the implications and consequences of commodification of education as well as the manner in which ESIB may positively contribute towards ensuring that education remains a public good.Encourage student unions and decision makers in higher education to involve themselves in the discussion relating to the commodification of education.³

The term ‘exploitation’ is much used both in common parlance and as a research term when examining environmental phenomena. However, when examining the plethora of writings on the environment it quickly becomes obvious that neither is there a commonly accepted definition of the term, nor has there been a critical examination of the concept. Consequently, the term ‘environmental exploitation’ is currently poorly understood, left unexplained or undertheorized. The failure to properly comprehend the concept is a serious gap in the environmental literature which needs to be addressed since it leads, inevitably, to normative confusion and policy errors.
