The first comprehensive guide to drafting and reviewing facilities management contracts was published recently. The new 40-page report from the publishers of Facilities Management Legal Update provides clients and contractors with a practical commentary and detailed explanation of when, how and why various contractual terms should be used in FM contracts.
The guide examines key issues such as: formation and tendering, drawing up services and specifications, contract duration, contractors' obligations, limitations on liability, insurance and indemnities, payments, assignment of rights, termination and dispute resolution. The guide takes full account of recent legislation under the Housing Grants, Construction and Regeneration Act 1996 and changes under TUPE case law.
Author Marc Hanson, of solicitors CMS Cameron McKenna, has extensive experience of drafting contracts for both FM contractors and clients. He is the co-author of the recently published Model Facilities Management Contract produced by the Chartered Institute of Building.
