CLAIM FOR INDUSTRIAL DISABLEMENT BENEFIT 14.3.66: Special hardship allowance — continuous condition, section 14(1) — effect of “gap” in periods of assessment
Abstract
Following a final limited assessment of disablement, a medical board, on an application for review, found that there had been unforeseen aggravation of the results of the relevant accident since the final assessment and made a provisional assessment for a period commencing on a date three months before the date of the claimant's application for a review but nine months after the end of the period covered by the previous final assessment. The Commissioner considered that the “gap” in the Periods of assessment was due solely to the effect of regulation 6A of the Determination of Claims and Questions Regulations 1948 which precluded the medical board from ante‐dating the assessment more than three months before the date of the application for review.
