Abstract

The WTO dispute settlement process is an improvement to the original GATT dispute settlement mechanism. However, it fails to assure a timely implementation and enforcement of the dispute settlement body (DSB) recommendations. To this date, the issue of mandatory enforcement is still open to interpretation. The number of ‘matters’ that have been subject to WTO dispute settlement stands at 266 over the 1995–2006 period. The number of implementation disputes has increased since 1998 and stand at 34 as of January 1, 2007. This chapter reviews the process of dispute settlements and enforcements since 1995 and to argue for the interpretation of ‘WTO agreements’ as ‘binding contracts’ whose breach must be evaluated as either ‘efficient’ or ‘non-efficient’ when discussing enforcement. In this context the non-compliance issue may be viewed as an ‘efficient breach’ where the only efficient remedy is a ‘fine’ rather than the usual practice of ‘suspension of concessions or other obligations’ to the Respondent. What sets our approach apart from earlier discussion is that it does not view ‘suspension of concessions’ as a sufficiently burdensome and efficient sanction. A ‘fine’ on the other hand may serve as a ‘buy out’ of a Respondents WTO obligations, and can be transferred to the negatively affected domestic producers in the Complainant's market as compensation for losses.

Reducing Level of Alcohol in Inks ‐ A medium‐sized US ink manufacturer recently needed to reduce the level of alcohol in its bases for water‐based inks. Ciba Geigy Pigments Division's Inks Technical Centre developed an improved formulation, containing half the alcohol of the previous one and 40 per cent more pigment to allow the ink producer to meet VOC limits and increase production efficiency, at no additional cost.

Abstract

Purpose

The purpose of this paper is to apply a market efficiency theoretical framework to analyse and postulate solutions to the challenges confronting China in engaging smallholders in higher value, specialty, agricultural product markets. A marketing experiment/trial to test these ideas is evaluated.

Design/methodology/approach

The case of fine‐wool marketing is used to illustrate issues associated with specialty product marketing. The market efficiency approach highlights the difficulties involved in relaying accurate product prices and values (exchange efficiency) while aligning the logistical requirements of higher value market segments with the small, dispersed and locationally remote smallholders (operational efficiency). The marketing experiment/trial was conducted in three fine‐wool‐growing counties in Western China in 2008.

Findings

The fine‐wool case study highlights that modernization of the marketing system is required not only so that smallholders can access the premium prices potentially available but also to improve international competitiveness.

Originality/value

Engaging smallholders in specialty agricultural product markets poses significant challenges for China. The market efficiency approach (exchange efficiency versus operational efficiency) provides a new perspective on these challenges and offers new insights about appropriate policy settings both at a macro‐ and micro‐level.

Abstract

The objective of this study is to investigate how country risk, different political actions from the government and bureaucratic behavior influence the activities in industry supply chains (SCs) in emerging markets. The main objective of this study is to investigate the influence of these external stakeholders’ elements to the demand-side and supply-side drivers and barriers for improving competitiveness of Ready-Made Garment (RMG) industry in the way of analyzing supply chain. Considering the phenomenon of recent change in the RMG business environment and the competitiveness issues this study uses the principles of stakeholder and resource dependence theory and aims to find out some factors which influence to make an efficient supply chain for improving competitiveness. The RMG industry of Bangladesh is the case application of this study. Following a positivist paradigm, this study adopts a two phase sequential mixed-method research design consisting of qualitative and quantitative approaches. A tentative research model is developed first based on extensive literature review. Qualitative field study is then carried out to fine tune the initial research model. Findings from the qualitative method are also used to develop measures and instruments for the next phase of quantitative method. A survey is carried out with sample of top and middle level executives of different garment companies of Dhaka city in Bangladesh and the collected quantitative data are analyzed by partial least square-based structural equation modeling. The findings support eight hypotheses. From the analysis the external stakeholders’ elements like bureaucratic behavior and country risk have significant influence to the barriers. From the internal stakeholders’ point of view the manufacturers’ and buyers’ drivers have significant influence on the competitiveness. Therefore, stakeholders need to take proper action to reduce the barriers and increase the drivers, as the drivers have positive influence to improve competitiveness.

This study has both theoretical and practical contributions. This study represents an important contribution to the theory by integrating two theoretical perceptions to identify factors of the RMG industry’s SC that affect the competitiveness of the RMG industry. This research study contributes to the understanding of both external and internal stakeholders of national and international perspectives in the RMG (textile and clothing) business. It combines the insights of stakeholder and resource dependence theories along with the concept of the SC in improving effectiveness. In a practical sense, this study certainly contributes to the Bangladeshi RMG industry. In accordance with the desire of the RMG manufacturers, the research has shown that some influential constructs of the RMG industry’s SC affect the competitiveness of the RMG industry. The outcome of the study is useful for various stakeholders of the Bangladeshi RMG industry sector ranging from the government to various private organizations. The applications of this study are extendable through further adaptation in other industries and various geographic contexts.

Abstract

Purpose

This study aims to adopt a systematic review approach to examine the existing literature on law and LLMs.It involves analyzing and synthesizing relevant research papers, reports and scholarly articles that discuss the use of LLMs in the legal domain. The review encompasses various aspects, including an analysis of LLMs, legal natural language processing (NLP), model tuning techniques, data processing strategies and frameworks for addressing the challenges associated with legal question-and-answer (Q&A) systems. Additionally, the study explores potential applications and services that can benefit from the integration of LLMs in the field of intelligent justice.

Design/methodology/approach

This paper surveys the state-of-the-art research on law LLMs and their application in the field of intelligent justice. The study aims to identify the challenges associated with developing Q&A systems based on LLMs and explores potential directions for future research and development. The ultimate goal is to contribute to the advancement of intelligent justice by effectively leveraging LLMs.

Findings

To effectively apply a law LLM, systematic research on LLM, legal NLP and model adjustment technology is required.

Originality/value

This study contributes to the field of intelligent justice by providing a comprehensive review of the current state of research on law LLMs.

Purpose

The purpose of this paper is to develop a new finite difference method for solving the seismic wave propagation in fluid-solid media, which can be described by the acoustic and viscoelastic wave equations for the fluid and solid parts, respectively.

Design/methodology/approach

In this paper, the authors introduced a coordinate transformation method for seismic wave simulation method. In the new method, the irregular fluid–solid interface is transformed into a horizontal interface. Then, a multi-block coordinate transformation method is proposed to mesh every layer to curved grids and transforms every interface to horizontal interface. Meanwhile, a variable grid size is used in different regions according to the shape and the velocity within each region. Finally, a Lebedev-standard staggered coupled grid scheme for curved grids is applied in the multi-block coordinate transformation method to reduce the computational cost.

Findings

The instability in the auxiliary coordinate system caused by the standard staggered grid scheme is resolved using a curved grid viscoelastic wave field separation strategy. Several numerical examples are solved using this new method. It has been shown that the new method is stable, efficient and highly accurate in solving the seismic wave equation defined on domain with irregular fluid–solid interface.

Originality/value

First, the irregular fluid–solid interface is transformed into a horizontal interface by using the coordinate transformation method. The conversion between pressures and stresses is easy to implement and adaptive to different irregular fluid–solid interface models, because the normal stress and shear stress vanish when the normal angle is 90° in the interface. Moreover, in the new method, the strong false artificial boundary reflection and instability caused by ladder-shaped grid discretion are resolved as well.

Abstract

The Foreign Corrupt Practices Act (FCPA) of 1977 and its amendment – the Trade and Competitive Act of 1988 – are unique not only in the history of the accounting and auditing profession, but also in international law. The Acts raised awareness of the need for efficient and adequate internal control systems to prevent illegal acts such as the bribery of foreign officials, political parties and governments to secure or maintain contracts overseas. Its uniqueness is also due to the fact that the USA is the first country to pioneer such a legislation that impacted foreign trade, international law and codes of ethics. The research traces the history of the FCPA before and after its enactment, the role played by the various branches of the United States Government – Congress, Department of Justice, Securities Exchange commission (SEC), Central Intelligence Agency (CIA) and the Internal Revenue Service (IRS); the contributions made by professional associations such as the American Institute of Certified Public Accountants (AICFA), the Institute of Internal Auditors (IIA), the American Bar Association (ABA); and, finally, the role played by various international organizations such as the United Nations (UN), the Organization for Economic Cooperation and Development (OECD), the World Trade Organization (WTO) and the International Federation of Accountants (IFAC). A cultural, ethical and legalistic background will give a better understanding of the FCPA as wll as the rationale for its controversy.

Abstract

Purpose

The purpose of this paper is to introduce efficient methods for solving the 2D biharmonic equation with Dirichlet boundary conditions of second kind. This equation describes the deflection of loaded plate with boundary conditions of simply supported plate kind. Also it can be derived from the calculus of variations combined with the variational principle of minimum potential energy. Because of existing fourth derivatives in this equation, introducing high‐order accurate methods need to use artificial points. Also solving the resulted linear system of equations suffers from slow convergence when iterative methods are used. This paper aims to introduce efficient methods to overcome these problems.

Design/methodology/approach

The paper considers several compact finite difference approximations that are derived on a nine‐point compact stencil using the values of the solution and its second derivatives as the unknowns. In these approximations there is no need to define special formulas near the boundaries and boundary conditions can be incorporated with these techniques. Several iterative linear systems solvers such as Krylov subspace and multigrid methods and their combination (with suitable preconditioner) have been developed to compare the efficiency of each method and to design powerful solvers.

Findings

The paper finds that the combination of compact finite difference schemes with multigrid method and Krylov iteration methods preconditioned by multigrid have excellent results for the second biharmonic equation, and that Krylov iteration methods preconditioned by multigrid are the most efficient methods.

Originality/value

The paper is of value in presenting, via some tables and figures, some numerical experiments which resulted from applying new methods on several test problems, and making comparison with conventional methods.
