Abstract

This chapter examines the delicate balance achieved by apex courts in new democracies when dealing with impunity for rights violations during times of transitional justice. While international law has clearly rejected amnesties for past rights violations, domestic politics sometimes incorporate amnesties as part of larger peace settlements. This puts courts in the difficult situation of balancing the competing demands of law and politics. Courts have achieved equipoise in this situation by adopting substantive interpretations and procedural approaches that use international law’s rights-based language but without implementing international law’s restrictions on amnesties. In many cases, courts do this without acknowledging the necessarily pragmatic nature of their decisions. In fact, oftentimes courts find ways of avoiding having to make any substantive decision, effectively removing themselves from a dispute that could call into question their adherence to international legal norms that transcend politics. In doing so, they empower political actors to continue down the road toward negotiated peace settlements, while at the same time protecting the courts’ legitimacy as institutions uniquely situated to protect international human rights norms – including those they have effectively deemphasized in the process.

Abstract

Purpose

This paper aims to contend that populism is damaging to both domestic and international politics; not only does it erode liberal democracy in established democracies but also fuels authoritarianism in despotic regimes and aggravates conflicts and crises in international system.

Design/methodology/approach

The research is divided into two main sections. First, it examines how populist mobilization affects liberal democracy, and refutes the claims that populism is beneficial and reinforcing to democracy. Second, it attempts to demonstrate how populism is damaging to domestic politics (by undermining liberal democracy and supporting authoritarianism) as well as international relations (by making interstate conflicts more likely to materialize). Theoretically, populism is assumed to be a strategy used by politicians to maximize their interest. Hence, populism is a strategy used by politicians to mobilize constituents using the main features of populist discourse.

Findings

The research argues that populism has detrimental consequences on both domestic and international politics; it undermines liberal democracy in democratic countries, upsurges authoritarianism in autocratic regimes and heightens the level of conflict and crises in international politics. Populism can lead to authoritarianism. There is one major undemocratic trait shared by all populist waves around the world, particularly democracies; that is anti-pluralism/anti-institutions. Populist leaders perceive foreign policy as the continuation of domestic politics, because they consider themselves as the only true representatives of the people. Therefore, populist actors abandon any political opposition as necessarily illegitimate, with repercussions on foreign policy.

Originality/value

Some scholars argue that populism reinforces democracy by underpinning its ability to include marginalized sectors of the society and to decrease voter apathy, the research refuted these arguments. Populism is destructive to world democracy; populists are reluctant to embrace the idea of full integration with other nations. Populists reject the idea of open borders, and reckon it an apparent threat to their national security. The research concludes that populists consider maximizing their national interests on the international level by following confrontational policies instead of cooperative ones.

Abstract

Purpose

International climate politics are gradually changing in terms of new and ground-breaking policies and decision-making spearheaded by national governments. The growing global demand to combat climate change reflects the current challenges the world is facing. India’s negotiations at United Nations Conference on Climate Change are based on “equity,” “historical responsibility” and the “polluter pays” agenda, until a shift in the voluntary reduction of carbon emissions takes place. The purpose of this study is to understand why India, a “deal breaker”, is seen as a “deal maker” in climate governance?

Design/methodology/approach

For a state like India, domestic preferences are equally important in introducing climate policies alongside its concerns over poverty reduction and economic development, which also stand with its sustainable development goals. This paper explains India’s decision-making using a two-level approach focusing on “domestic preferences.” This rationale is based on India’s historical background as well as new upcoming challenges.

Findings

This paper shows that India has both the domestic needs and long-term benefits of combating climate change to cut carbon emissions, which gives the responsibility primarily to domestic audiences and international societies.

Originality/value

This paper uses an international political lens to critically analyze India’s climate positions and politics from both domestic and international levels, demonstrating the importance of considering both short- and long-term goals. The outcome benefits not only the policymakers in India but also stakeholders in the Asia-Pacific and beyond.

Abstract

The attempt to recover the international origins of social and political thought is motivated by the unsatisfactory fragmentation of modern knowledge – by its failure to account for the intimate connections between theory and history in general and its international dimension in particular – and seeks to overcome these divides. This article provides an analysis of the theory/history divide and its role for the fragmentation of modern knowledge. Theoretically, it shows, this divide is rooted in, and reproduced by, the epistemic foundations of modern knowledge. Historically, the modern episteme arises from a crisis of imperial politics in the 18th century. This analysis suggests that theory, history, and the international are products rather than origins of modern social and political thought. These historical origins thus do not provide the basis for more integrated forms of knowledge. They do, however, reveal how the fragmentation of knowledge itself simultaneously serves and obscures the imperialist dimension of modern politics.

Abstract

Purpose – Since the mid-1980s, unemployment policy reforms in Europe and throughout the rich democracies have stressed publicly supported activation of the unemployed through both reductions in perceived disincentives to work as well as commitments for improved training, employment services, and related policies. In this chapter, I systematically explore the domestic and international political economic sources of these policy changes.

Methodology/approach – I test a set of hypotheses – original and derivative – about the domestic and international determinants of labor market policy change through pooled time-series cross-section analysis of 1980-to-2002 annual data from 18 capitalist democracies. The dependent variables consist of national spending on active labor market policy, measures of passive unemployment compensation benefits, and the ratio of active to passive unemployment program spending. Causal models account for spatial diffusion of policy reforms as well as core political and economic determinants of policy change.

Findings – I find that Left party governments and coordinated market institutions buoy resources for active labor market programs, maintain relatively generous passive unemployment supports and entitlements, and, at the same time, foster a shift to more active social policy. International trade openness promotes generous active labor market policies while more left-leaning voters and veto points within the polity significantly constrain reductions in unemployment benefits and entitlement rights. De-industrialization reinforces policy reforms toward activation while high unemployment rates engender cuts in passive unemployment benefits and eligibility conditions.

Originality/value – Overall, the chapter demonstrates that the economic effects on policy change notwithstanding, politics fundamentally matters: domestic political dynamics and variations in institutions explain the preponderance of the change (or lack thereof) in unemployment policy.

Abstract

Purpose

The purpose of this paper is to use the case of white immigrant women domestics’ experiences in migration to demonstrate that their work experiences are different due to their whiteness. While their racial identity provides them with white privileges, they still face discrimination based on their occupational and immigrant statuses. The case study adds to existing literature on domestic service.

Design/methodology/approach

The case study is based on several years of ethnographic work. The author conducted in‐depth interviews with Polish immigrant women and white female employers. The author also held focus groups with Polish women.

Findings

White immigrant women from Poland do not automatically assume the white racial identity in the USA. Their whiteness is constructed and reinforced through their interactions with their white female employers. Their whiteness renders their experiences different from racial minority women and immigrant women of color. However, Polish domestics construct their positive work identity to counteract the negative images about them and domestic service as an occupation.

Research limitations/implications

The main limitation the author sees is that the author could have conducted interviews with Mexican immigrant women to compare the differences in terms of their working conditions.

Practical implications

While Polish domestics seem to have better experiences than other groups of immigrant women, domestic workers are excluded from the labor law. They are thus without the protection of labor law. It is important for us to work for the right of immigrant workers to eradicate the inequality in society.

Social implications

This case shows that the transnational labor migration contributes to further inequality in society since it is usually the migrant workers who take up the low skilled or unskilled work that has few possibilities for promotion and has few benefits. The government needs to address the transnational migration process and the exploitation of migrant workers ensuing from the process.

Originality/value

Polish immigrant women are a unique group of women mainly because they are among the few white women who perform domestic service. Their experiences are different from racial minority women and immigrant women of color. Merging the whiteness approach and domestic service is an innovative approach.

Abstract

Purpose

Complex social interactions such as argumentation and persuasion are increasingly common in online communications. To better understand these interactions and their impacts on people and on the society, it is important for the authors to understand how people reason online such as when they need to justify themselves or convince others with their perspectives. Reasoning in online discussions is expectedly to be different from doing so offline, as one often communicates with others anonymously and asynchronously in such contexts (e.g. Reddit discussions). The purpose of this paper is to investigate people's reasoning behavior in online environments focusing on how they justify their perspectives.

Design/methodology/approach

In this study, the authors examined how a subreddit Change My View (CMV) users offer their opinions and justify them through the lens of argumentation and reasoning. The authors annotated, 330 Reddit discussion original posts (OPs) to identify claims, rationales and supports for reasoning, i.e. personal experiences, definitions, domain expertise and external sources. The authors investigated the correlations among the occurrences of these supporting statements and whether they are related to the topics of the posts.

Findings

The findings suggest that if people mention their domain expertise, they tend to provide related personal experiences as well. Additionally, if the participants talk about the topic of domestic politics, they tend to utilize their personal experiences.

Research limitations/implications

Further research may be conducted to help system designers. System designers (e.g. online debate systems, collective decision-making systems, etc.) may benefit from the findings to design systems by considering commonly used supporting statements, which may enhance people's reasoning and argumentation processes. The sample size is a small sample. The authors acknowledge that the small sample size of the study may limit the generalizability of the findings; however, it is still acceptable compared to the existing literature. One future study could be annotating a larger dataset to further probe the use of supporting statements in online reasoning.

Practical implications

The authors' findings might be useful to understand how Reddit users are justifying their opinions as the reflection of their reasoning processes. In order to contribute further research in argumentation and reasoning in online platforms, the authors make the annotated dataset publicly available.

Originality/value

To best of the authors' knowledge, this study was one of a few studies whose purpose is to understand Reddit CMV users' reasoning processes. To understand how online users offer their reasons while providing their ideas is important to have effective communication processes and to improve online discussion experiences which are very common in today's digital era.

Abstract

Purpose

The purpose of this paper is to analyse why Malta continues to show the highest level of turnout for European Parliament (EP) elections in a country where voting is not obligatory. By analysing the Maltese EP elections from 2004 to 2019, the paper seeks to understand why the Maltese engage with a second order election to the degree that they do.

Design/methodology/approach

The paper is a combination of qualitative and quantitative methods, first assessing the context of the 2019 elections, the historical trends and then the factors that help explain why the Maltese continue to engage with EP elections.

Findings

The paper finds that the Maltese political system, highly polarised and dominated by two parties, primarily galvanises people to engage with elections, that it is more about party leadership than actual engagement with Europe and that second order elections in Malta are often run as first order elections.

Originality/value

This paper is the only systematic evaluation of the 2019 EP elections in Malta, discusses categorically that EP elections are rarely about Europe while also showing clearly that political parties can make second-order elections appear as first-order elections should the stakes be high enough.

Abstract

China’s open‐market reform and rapid economic growth have generated a tremendous surge in activity and market investment by multinational corporations (MNCs). By 2000, 400 of the 500 most famous MNCs had invested in China. One distinctive feature of China’ s business environment, its authoritarian political system, requires MNCs to practise strategic public affairs to interact constantly with the different levels of Chinese government, respond to the policies and further influence business policy formation. This paper proposes a conceptual model of MNC‐government bargaining that is composed of international political economy, dependency theory and agency theory. It then examines (1) the international and domestic influences on MNC‐government bargaining in China and (2) the strategies MNCs employed to influence Chinese laws for foreign business in their interests. A case study of the Chinese ban on direct selling operations in 1998 and Amway’s strategies to remove the ban is presented. Results suggest that effective public affairs should engage in the following activities: (1) issues management, (2) constantly and systematically analysing the MNC’s bargaining power with the host government, (3) selecting public affairs strategies based on the analysis of MNC‐government bargaining, (4) exercising relationship management, and (5) being ethical in its practice.
