Abstract

In this article, we focus on alternative dispute resolution procedures, in particular third party procedures. We describe eight different procedures and provide examples of how these procedures are used in different cultural contexts. We then evaluate the procedures in terms of how they impact four key criteria that have been noted in the literature related to negotiation: process criteria, settlement criteria, issue-related criteria, and relationship criteria. We subsequently explore the potential impact of culture on evaluations of these criteria. We finish with a discussion of future directions for research and practice, emphasizing that procedural recommendations should be made carefully when the criteria for effectiveness and applicability are derived from US-centric research. In other words, there is not “one best choice” for third party procedures universal to the myriad cultures on our planet.

Abstract

Purpose

The purpose of this paper is to provide insights into cross‐cultural conflicts and their management in ecclesiastical organizations in Tanzania. It aims at increasing the understanding of these complexities from an emic perspective of employees with a Christian background, thereby providing in‐depth information on the topic. These new insights provide fresh ideas for further research on this topic in the Tanzanian context.

Design/methodology/approach

Qualitative data were selected from a more comprehensive case study carried out in multiple governmental, educational, ecclesiastical and economic organizations in Tanzania. The case study was based on phenomenological and interpretative paradigms and hermeneutical interpretations using qualitative methodology including in‐depth interviews and observation during field stays, as well as documentary and secondary analysis.

Findings

The findings show that senior management staff of ecclesiastical organizations function as mediators for conflicting parties to regain harmony and peace through third‐party intervention and spiritual self‐development. Mediation in ecclesiastical organizations is mainly used in relationship conflicts, employment conflicts and church re‐structuring processes. It supports the resolution of value conflicts between the conflict parties and the environment and at the same time re‐constructs religious and Christian values and concepts, such as the concept of “Shalom” and “creating lobe” and thereby re‐enforces spiritual integrity and the reality of the church.

Research limitations/implications

The findings are not generalizable and are limited to this specific research context. Findings should be verified by follow‐up studies which expand the content, the context and the methodological approach of this study. These findings should be viewed as exploratory research findings and as highly contextual and sample‐bound.

Practical implications

The paper describes the practical implications for further research relating to future research topics for researchers interested in the field of cross‐cultural conflict management in ecclesiastical organizations in Tanzania.

Originality/value

The authors present original data and provide new insights into managing conflicts in Tanzanian ecclesiastical organizations through mediation.

Abstract

Purpose

The purpose of this research is to paint a picture of the current utility of mediation in the Scottish construction sector; determine the willingness of Scottish construction lawyers to shift away from traditional dispute resolution approaches towards mediation; and ascertain the drivers towards the adoption of mediatory techniques and the barriers to change.

Design/methodology/approach

Drawn from a questionnaire survey, this paper seeks to add to the dispute resolution literature by identifying the attitudes of construction lawyers on the use and effectiveness of mediation to resolve construction disputes in Scotland.

Findings

The findings suggest that there is a core of Scottish construction lawyers in Scotland that recognize the promise of mediation as a useful dispute resolution tool. Respondents generally profess knowledge of the process and some measure of positive practical experience and espouse positive views on mediation. Their response to mediation then does not appear to be one of cultural conservatism or fear of the unknown as opposed to traditional dispute resolution mechanisms, which for all their imperfections lawyers understand unequivocally.

Research limitations/implications

It is recognized that the introduction of mediatory techniques into construction disputes will have a cumulative effect on the Scottish legal fraternity over time. Cross‐sectional studies are often unable to yield information about the direction of causal relationships between variables that are interrelated in a complex way. Neither do cross‐sectional studies permit researchers to assess the effectiveness of intervention strategies.

Originality/value

This is the first empirical work ascertaining the views and experiences of Scottish construction lawyers on mediation. While the research reveals evidence of a modest bottom‐up growth of construction mediation in Scotland, it also provides insight into key policy issues which will require to be resolved if mediation is to move from the margins to the mainstream of construction disputing practices in Scotland.

Abstract

Purpose

The purpose of this study is to examine the determinants of career satisfaction of professional accounting returnees who have studied and/or worked abroad and then returned to work in different types of international workplaces in their home country.

Design/methodology/approach

A survey of professional accounting returnees in Vietnam was undertaken and multiple regression analysis was applied to test the proposed relationships.

Findings

This study finds that career satisfaction is affected by career fit, career sacrifice, types of international workplaces (domestically headquartered firms versus globally headquartered firms) and cross-cultural work readjustment. Further, cross-cultural work readjustment partially mediates the effect of career fit and career sacrifice on career satisfaction.

Practical implications

The research provides the basis for designing career-related employee experiences to support career satisfaction of professional accounting returnees.

Originality/value

This study integrates dimensions of career embeddedness with cross-cultural work readjustment and employee experiences, which are normally studied separately, in different types of international workplaces. It contributes to the limited research on contributors to well-being in the form of career satisfaction among professional returnees in an emerging economy.

Abstract

This chapter describes the situation of the two ‘official’ linguistic communities within the province of Quebec, Canada, whose primary language is either English or French and who attend post-secondary pre-university colleges. It examines the point of view of young Anglophones learning French as a Second Language (FSL), for whom French instruction is mandatory. A random probability sample of 974 students was selected in 11 colleges. The authors conducted 22 individual interviews and met with 48 students during four focus group sessions. The interviews and the quantitative data show that students at all levels have low levels of motivation for FSL and negative attitudes towards the Francophone community. How students perceive FSL education has a statistically significant impact on motivation: the more positive their perceptions, the higher their motivation. Moreover, the reported number of Francophone friends and the number of hours students reported speaking in French with these friends, has a significant impact on their perceptions. Based on the importance of this friendship dynamic, the authors propose that Second Language Acquisition should not focus primarily on language code proficiency and communication skills, but rather encourage students from different linguistic groups to meet and develop productive relationships, which is scarce in language instruction settings.

Abstract

Purpose

This paper attempts to explore the relativity of unique Chinese culture in the process of knowledge search, knowledge transfer and knowledge integration and put forward policy suggestions for practitioners.

Design/methodology/approach

A conceptual framework is proposed in order to analyze the influence of different dimensions of culture on knowledge flow. Foundational support for this framework is drawn from existing researches. Policy suggestions are presented based on the framework.

Findings

Ten propositions are demonstrated concerning how to facilitate knowledge flow efficiently with the mediation of cultural variations.

Research limitations/implications

This paper concerns culture at national level only. Culture that varies at a lesser level, such as organizational or occupational culture, also has an influence on knowledge management.

Originality/value

Although cultural relevance in knowledge management is recognized, there is a lack of research with specific reference to the Chinese cultural context. This paper contributes in conceptualizing the analyzing framework and providing further insight into the complexity of cultural relevance in knowledge management in China.

Abstract

Purpose

Sourcing intermediaries, commonly known as agents or trading companies, represent a useful organisational solution for assisting companies to manage supply risks and to overcome the liability of foreignness. However, the landscape of global business is experiencing rapid and fundamental changes, which leads us to ask whether intermediaries will continue to play a role in global sourcing. This paper aims to understand how sourcing intermediaries ensure a lasting position in the changing setting of global sourcing and information sharing.

Design/methodology/approach

This paper investigates the operations of both Chinese and Nordic (Finnish and Swedish) intermediaries in sourcing from China by analysing qualitative data collected over a period of four years.

Findings

Through the lens of information asymmetry, this paper identifies four distinct informational roles that are used by intermediaries to reduce information asymmetry between suppliers and buyers located in different countries. The paper also examines intermediaries’ signalling activities under these roles in a cross-border triad.

Originality/value

The paper contributes to the scientific debate on the usefulness of intermediaries by underlining intermediaries’ informational advantage, which provides a new explanation for the survival of intermediaries in a rapidly changing business context. Additionally, this study contributes to research on intermediation strategies by empirically examining both Chinese and Western intermediaries, highlighting the importance of institutional contexts in affecting intermediaries’ informational roles.

Abstract

In the context of intense intercultural experience, the individual’s identity is often transformed by the forces of acculturation. Unexpectedly powerful demands, influences, and resistances buffet the values, beliefs, and behaviors of the sojourner, leading to confusion, and eventually resolution of profound identity issues. The resulting sense of being between two cultures or more, living at the edges of each, but rarely at the center, can be called cultural marginality. When these issues remain unresolved, the person is often confounded by the demands, and feels alienated in a state called encapsulated marginality. The constructive marginal resolves these questions by integrating choices from each culture of which the person is a part, choosing the appropriate frame of reference, and taking action appropriate for the context.

Global leaders need to recognize the characteristics of the marginal identity and leverage the skills the marginal brings to the organization. The mindset of hybrid professionals fosters increased creativity, culturally appropriate problem solving, and collaboration with other culture partners. Educators, trainers, and coaches can design developmental opportunities for sojourners to acculturate to new environments in a way that potentiates their intercultural competence and comfort with their bicultural mindset. By viewing a complex cultural identity as an asset to the organization, global leaders can avoid the common pitfall of overlooking cultural marginals and instead maximize their contribution to globalization.

Abstract

Purpose

This study aims to delve into the interplay between didactic audiovisual translation (DAT) and computer-assisted language learning (CALL), exploring their combined impact on the development of intercultural competence (IC) among learners of English as a foreign language (EFL).

Design/methodology/approach

Using a quasi-experimental approach with a quantitative research design, the study analyses the outcomes of a questionnaire answered by 147 students across 15 language centres in Spanish Universities. These participants actively engaged in completing the lesson plans of the Traducción audiovisual como recurso didáctico en el aprendizaje de lenguas extranjeras project, a Spanish-Government funded research initiative aimed at assessing the effects of DAT on language learning.

Findings

The current study confirms the reliability of the instrument developed to measure students’ perceived improvement. Beyond validating the research tool, the findings of the current study confirm the significant improvement in intercultural learning achieved through DAT, effectively enhancing students’ motivation to engage in language learning.

Research limitations/implications

The current research solely examines students enrolled in higher education language centres. This paper closes with a CALL for additional research, including participants from other educational stages, such as primary or secondary education. In the broader context of CALL research, this study serves as a valuable contribution by exploring the potential of DAT in fostering IC in EFL settings.

Originality/value

This research confirms the potential of DAT and CALL to promote students’ learning process, as the combination of these approaches not only yields linguistic benefits but also intercultural learning.

Abstract

Purpose

The purpose of this paper is to frame Khaled Hosseini's novels, The Kite Runner and A Thousand Splendid Suns, as literature to expand and enhance the American secondary curriculum with multicultural themes based on Afghanistan as a geographical and cultural place in a dynamic, diverse, and complex world more mediated than ever before by computer technologies.

Design/methodology/approach

The methodological approach to the study is a synthesis of geographic education grounded in the concept of place and diversity pedagogy.

Findings

Khaled Hosseini's web site has become the cyber place where hundreds of readers from around the world come to express their deep emotional reactions to The Kite Runner and A Thousand Splendid Suns. At the same time, that so many diverse international readers are responding favorably to Hosseini's novels, his works are being censored in classrooms in the USA. The research outlines geographical and cultural geographic features of Afghanistan – a place torn by military efforts of several nations. In the context of diversity pedagogy, the power of the novels portrays “difference,” yet humanity in need of understanding. Further attention is given to the censorship of ideas in American education, with Hosseini's books as one example.

Originality/value

This paper frames Hosseini's novels as place‐based literature illustrating the homeland of Afghanistan now more accessible than ever before to international and US classrooms.
