Abstract

One effect of the policy of deinstitutionalisation has been to increase police contact with people, who are experiencing the effects of acute mental illness. Policy documents such as Home Office circular 66/90 recognise that adults with mental health problems are especially vulnerable within the criminal justice system. The overall aim of policy is that vulnerable adults should be diverted to mental health services at the earliest opportunity unless the offence is so serious that this would not be in the public interest. However, there is little concrete evidence of the success of this policy. The result is that police officers have an increasing role to play in working with individuals experiencing acute mental health problems. In this process, custody officers have a key role to play as decision‐makers as to whether the protections that PACE (1984) offers to vulnerable adults should apply. This article is based on a small‐scale indicative research study, which examined how officers make these decisions and the training that they receive relating to mental health issues.

Abstract

Purpose

The purpose of this paper is to summarise the findings of a desk-based international review investigating the checking of staff and volunteers working with adults who are vulnerable or at risk (or similarly defined) receiving social care in their own homes, or in day centres or residential care.

Design/methodology/approach

In England, as part of the government’s attempts to prevent harm to vulnerable people, employers must check if their staff or volunteers are barred from working with vulnerable adults in the health and care sectors or if they have a relevant criminal record. This review sought to explore practices elsewhere, with a view to informing policy and practice debates. The review was undertaken in winter 2014-2015. It mainly involved a search of internet-based material and databases. This was further informed by communications with experts and practitioners from different countries.

Findings

The review found a variety of practices, ranging from no checks to substantial checks involving fingerprinting. Reasons for checks identified in different national contexts extend from efforts to stop fraudulent use of government subsidies to minimising the risk of harm to vulnerable adults, and more positively to enhance user and public trust in care providers. A small number of countries place particular emphasis on the rights of individuals to privacy and rehabilitation and this moral imperative overrides other policy goals. This review highlighted a lack of clarity in publicly available documents about the potentially multiple policy goals of different schemes and suggests that there may be advantages to clarifying the options available from other countries.

Research limitations/implications

This review was confined to English language material and to material located through internet searching. Some material may not have been updated on internet sites.

Originality/value

The details of the processes have not previously been collated to the best of the authors’ knowledge.

Purpose

The purpose of this paper is to explore the nature of both charitable and religious fundraising amongst vulnerable older adults. It is a practice that is hidden and opaque. The circumstances surrounding the death of Olive Clarke in spring 2015, however, suggest that it is a practice that involves “intrusive” and “excessive” practices. Fundraising amongst vulnerable older adults is largely unregulated and independently monitored. This paper argues that ensuring the protection of vulnerable older adults requires substantial change and new accountabilities.

Design/methodology/approach

This paper explores current approaches to financial abuse and the focus on family and professional carers as the main likely perpetrators. However, using literature from both the USA and Australia, it considers notions of “trust” and professional behaviour, and the way that vulnerable older adults are subject to new forms of abuse as a result of financial technology such as online and telephone banking. It links this with the practices of charitable fundraisers using techniques such as cold calling and direct mail.

Findings

The circumstances surrounding the death of Olive Clarke suggest that charities, and those fundraise for charities appear to engage in a practice whereby they sell the names of likely donors to each other. This practice opens opportunities for abusive relationships to take place. At the same time many clergy operate like the single GP surgeries that allowed Shipman to practice unnoticed and unaccountable. The relationship between clergy and their aging congregation, who are relied upon to raise funds for church activities, open up the opportunity for abuse to take to place. Few records on charitable giving exist that permit regulation and independent scrutiny.

Research limitations/implications

Current research in this area is limited by the focus on family and professional carers as likely perpetrators of financial abuse, and through attention on child sexual abuse in general. There is a lack of research on charitable giving, and the focus tends to be on altruism rather than the practices and motivations of fundraisers themselves. This paper intends to begin an academic debate to the context in which Olive Clarke took her own life.

Practical implications

In the wake of the death of Olive Clarke the Fundraising Standards Board has been tasked with reviewing the way charities raise funds amongst vulnerable older adults. No one has yet used the language of financial abuse, choosing to opt for the terms “excessive” and “intrusive” there is a need to shift this debate and encourage greater regulation and accountability.

Social implications

This paper seeks to explore how some of the organisations that are supposed to protect and care for vulnerable people engage in practices that exploit and abuse. It is timely as debates about charitable giving are beginning to increase, and the role of the church and the religious groups in the abuse of children is being considered by the new independent inquiry in the UK. It has significant implications for accountability, trust and regulation.

Originality/value

The financial abuse of older adults is rarely considered outside of the family – carer nexus. However, changes in the banking and financial systems means that opportunities for abuse are greater than ever before. Prior to the death of Olive Clarke in spring 2015 very little attention on the nature of charitable and religious fundraising amongst older adults has taken place, and consequently this paper is highly original, but equally timely.

Abstract

Purpose

This paper presents an overview of research and practice literature on the use of Mediation (M) and Family Group Conferences (FGC) in the context of adult safeguarding in the UK.

Design/methodology/approach

This paper describes the main features of M and FGC and explores how such “family led” approaches to adult safeguarding fit within the wider agenda of personalisation and empowerment, including the Mental Capacity Act 2005 and its associated Code of Practice. It also considers the main implications for best practice and future research and service priorities.

Findings

M and FGC in an adult context are inclusive processes that enable people to explore choices and options in a supportive environment, assuring maximum possible independence and autonomous control over basic life decisions, while still addressing the person's need for assistance. When used appropriately, both approaches can be a valuable response to safeguarding concerns, promoting choice and control at the same time as protecting people from risk of abuse and harm. However, there are few robust evaluation studies currently available and no systematic research studies were found on cost‐effectiveness.

Originality/value

The paper shows that there is a clear need for further pilots of M and FGC in adult safeguarding. If such research and pilot evaluations find M and/or FGC to be effective, then more consideration will need to be given as to how to integrate such approaches into mainstream social work practice. There is also currently wide variation in the training and experience of mediators and FGC co‐ordinators, and further work is required to ensure that there are appropriate training and accreditation models in the UK for mediators and FGC co‐ordinators working with at‐risk adults.

Purpose

Local serious case reviews (SCRs) (now Safeguarding Adults Reviews (SARs)) may be held in England when a vulnerable adult dies or is harmed or at risk of being so, and local agencies may not have responded to the abuse or neglect. The purpose of this paper is to present findings from a documentary analysis of these reviews to ascertain what recommendations are made about pressure ulcer prevention and treatment at home, setting these in the context of safeguarding, and assessing what lessons may be learned by considering them as a group. This analysis is presented at a time of increased interest of the risks of pressure ulcers among frail and very ill populations; and debates about the interface of neglect and safeguarding systems.

Design/methodology/approach

Identification of SCRs from England where the person who died or who was harmed had been suffering from pressure ulcers or their synonyms in their home; termed home acquired pressure ulcers. Narrative and textual analysis of documents summarising the reports was undertaken to explore the reviews’ observations and recommendations. The main circumstances, recommendations and common themes were identified.

Findings

The authors located 18 relevant SCRs, one of which was a case summary and two SARs covering pressure ulcers that had been acquired or worsened when the individual was living at home. Most of these inquired into the individual’s circumstances, their acceptance of care and support, the actions of others in their family or professionals, and the events leading up to the death or harm. Failures to have followed guidance were noted among professionals, and problems within wider health and care systems were identified. Recommendations include calls for greater training on pressure ulcers for home care workers, but also greater risk communication and better adherence to clinical guidelines. A small number focus on neglect by family members, others on self-neglect, including some vulnerable adults’ lack of capacity to care for themselves or to access help. In some SCRs the presence of a pressure ulcer is only mentioned circumstantially.

Research limitations/implications

The value of this documentary analysis is that it draws on case examples and scrutiny at local level. Future research could consider the related findings of SARs as they emerge, similar documents from the rest of the UK, and international perspectives

Practical implications

This analysis highlights the multitude of complex social and health situations that gives rise to pressure ulcers among people living at home. Several SCRs observe problems in the wider communications with and between health and care providers. Nonetheless poor care quality and negligence are reported in some SCRs. Cases of self-neglect give rise to challenging practice situations. While practices and policies about poor quality care and safeguarding in the form of prevention of wilful neglect are emerging, they often relate to hospital and care home settings. Preventing and treating pressure ulcers may be part of safeguarding in its broadest sense but raises the question of whether training, expertise and support on this subject or wider self-neglect and neglect by others are sufficiently robust for home care workers and community-based professionals.

Originality/value

The value of having a set of SCRs is that they lend themselves to analysis and comparison. This analysis is the first to focus on home acquired pressure ulcers and to address wider considerations related to safeguarding policy and practice. Pressure ulcers feature in several SCRs either as contextual information about the vulnerable adults’ health-status or as indications of poor care. The potential value of examining home acquired pressure ulcers as a key line of enquiry is that they are “visible” in the system, with consensus about what they are, how to measure them and what is optimal care and treatment. In the new Care Act 2014 context, they may still feature in safeguarding inquiries as symptoms of failings in systems or of personal culpability for poor care. Learning from them may be of interest to other parts of the UK.

Abstract

In many if not most areas of England, there has been a significant change in the language used to describe work with vulnerable adults. Most local councils have evolved their language from ‘protecting’ to ‘safeguarding’ vulnerable adults. This paper will argue that unless this is accompanied by a change in practice and focus, this will be a hollow change in semantics and will not improve the life chances of disabled people. By defining safeguarding as opposed to protection, it is suggested how Coventry City Council could frame the change process needed to ensure that the move from protection to safeguarding is real and not hollow.

Purpose

Opportunities to gamble have boomed in the UK in recent years, since the passing of the Gambling Act 2005. The implications of this for adults with care and support needs and for safeguarding services have not been greatly investigated. The purpose of this paper is to address the interface of how gambling affects adults with care and support needs in England and adult safeguarding.

Design/methodology/approach

This paper reports on the scoping review which focussed on adults with care and support needs and gambling-related harm. It also included literature on perpetrators who exploit adults with care and support needs to fund their own or others’ gambling. The overall aims of this scoping review were to explore what is known about gambling-related harm affecting adults with care and support needs, the gaps in the evidence base, and specifically to refine the interview questions for the wider study.

Findings

There is some evidence that adults with care and support needs experience or are at risk of gambling-related harm. There is, however, lack of data from safeguarding services about this affecting adults at risk and safeguarding practice and systems. A public health approach to gambling is advocated by some, as well as effective regulation and support for people who have problems with their own or others’ gambling.

Originality/value

Industry operators, practitioners, and policymakers are increasingly paying attention to gambling-related harm but there is a lack of focus on adults with care and support needs or implications for adult safeguarding.
