Abstract
Investigates the differences in protocols between arbitral tribunals and courts, with particular emphasis on US, Greek and English law. Gives examples of each country and its way of using the law in specific circumstances, and shows the variations therein. Sums up that arbitration is much the better way to gok as it avoids delays and expenses, plus the vexation/frustration of normal litigation. Concludes that the US and Greek constitutions and common law tradition in England appear to allow involved parties to choose their own judge, who can thus be an arbitrator. Discusses e‐commerce and speculates on this for the future.

Abstract
Purpose
Inclination angle has been reported to have an enhancing effect on the thermal-hydraulic characteristics and entropy of some thermal systems. Therefore, this paper aims to numerically investigate the effects of inclination angle, volume concentration and Reynolds number on the thermal and hydraulic characteristics and entropy generation rates of water-based Al2O3 nanofluids through a smooth circular aluminum pipe in a turbulent flow.
Design/methodology/approach
A constant heat flux of 2,000 Watts is applied to the circular surface of the tube. Reynolds number is varied between 4,000 and 20,000 for different volume concentrations of alumina nanoparticles of 0.5%, 1.0% and 2.0% for tube inclination angles of ±90o, ±60o, ±45o, ±30o and 0o, respectively. The simulation is performed in an ANSYS Fluent environment using the realizable kinetic energy–epsilon turbulent model.
Findings
Results show that +45o tube orientation possesses the largest thermal deviations of 0.006% for 0.5% and 1.0% vol. concentrations for Reynolds numbers 4,000 and 12,000. −45o gives a maximum pressure deviation of −0.06% for the same condition. The heat transfer coefficient and pressure drop give maximum deviations of −0.35% and −0.39%, respectively, for 2.0% vol. concentration for Reynolds number of 20,000 and angle ±90o. A 95%–99.8% and 95%–98% increase in the heat transfer and total entropy generation rates, respectively, is observed for 2.0% volume concentration as tube orientation changes from the horizontal position upward or downward.
Originality/value
Research investigating the effect of inclination angle on thermal-hydraulic performance and entropy generation rates in-tube turbulent flow of nanofluid is very scarce in the literature.

Abstract
The strategic management literature emphasizes the concept of business intelligence (BI) as an essential competitive tool. Yet the sustainability of the firms’ competitive advantage provided by BI capability is not well researched. To fill this gap, this study attempts to develop a model for successful BI deployment and empirically examines the association between BI deployment and sustainable competitive advantage. Taking the telecommunications industry in Malaysia as a case example, the research particularly focuses on the influencing perceptions held by telecommunications decision makers and executives on factors that impact successful BI deployment. The research further investigates the relationship between successful BI deployment and sustainable competitive advantage of the telecommunications organizations. Another important aim of this study is to determine the effect of moderating factors such as organization culture, business strategy, and use of BI tools on BI deployment and the sustainability of firm’s competitive advantage.
This research uses combination of resource-based theory and diffusion of innovation (DOI) theory to examine BI success and its relationship with firm’s sustainability. The research adopts the positivist paradigm and a two-phase sequential mixed method consisting of qualitative and quantitative approaches are employed. A tentative research model is developed first based on extensive literature review. The chapter presents a qualitative field study to fine tune the initial research model. Findings from the qualitative method are also used to develop measures and instruments for the next phase of quantitative method. The study includes a survey study with sample of business analysts and decision makers in telecommunications firms and is analyzed by partial least square-based structural equation modeling.
The findings reveal that some internal resources of the organizations such as BI governance and the perceptions of BI’s characteristics influence the successful deployment of BI. Organizations that practice good BI governance with strong moral and financial support from upper management have an opportunity to realize the dream of having successful BI initiatives in place. The scope of BI governance includes providing sufficient support and commitment in BI funding and implementation, laying out proper BI infrastructure and staffing and establishing a corporate-wide policy and procedures regarding BI. The perceptions about the characteristics of BI such as its relative advantage, complexity, compatibility, and observability are also significant in ensuring BI success. The most important results of this study indicated that with BI successfully deployed, executives would use the knowledge provided for their necessary actions in sustaining the organizations’ competitive advantage in terms of economics, social, and environmental issues.
This study contributes significantly to the existing literature that will assist future BI researchers especially in achieving sustainable competitive advantage. In particular, the model will help practitioners to consider the resources that they are likely to consider when deploying BI. Finally, the applications of this study can be extended through further adaptation in other industries and various geographic contexts.

Abstract
Purpose
This paper aims to address the performance of different subgrid-scale models (SGS) for hydro- (HD) and magnetohydrodynamic (MHD) channel flows within a collocated finite-volume scheme.
Design/methodology/approach
First, the SGS energy transfer is analyzed by a priori tests using fully resolved DNS data. Here, the focus lies on the influence of the magnetic field on the SGS energy transport. Second, the authors performed a series of 18 a posteriori model tests, using different grid resolutions and SGS models for HD and MHD channel flows.
Findings
From the a priori analysis, the authors observe a quantitative reduction of the SGS energy transport because of the action of the magnetic field depending on its orientation. The a posteriori model tests show a clear improvement because of the use of mixed-models within the numerical scheme.
Originality/value
This study demonstrates the necessity of improved SGS modeling strategies for magnetohydrodynamic channel flows within a collocated finite-volume scheme.

Effective discussion is inextricably linked to democracy. Social studies curriculum and instruction should engage students in practicing democratic skills and habits of mind. This case study provides a microanalysis of one U.S. History teacher’s commitment to fostering discussion in her classroom as a theorized pedagogical practice. A better understanding of what motivates teachers to engage students in classroom discussions paralleled with rich descriptions of how this teacher plans and implements discussion could encourage others to try this approach to teaching and learning.

A history of the intellectual origins of the debate over the astructural bias is presented. The chapter summarizes both the emergent bias thesis and the charge of an astructural bias. The major works within this debate are reviewed. It has been found that the astructural bias still exists within the work of contemporary interactionists. The conclusion is that if interactionists want their work to be taken seriously, then they must seriously confront the distinguishing concept in sociology: social structure.
