Abstract

Purpose

This paper aims to explore any potential link between the corporate issue of a Strategic Lawsuit Against Public Participation (SLAPP) with a changed environmental, social and governance (ESG) reporting focus as part of a complementary communicative legitimation strategy.

Design/methodology/approach

A longitudinal content analysis of the annual reports of three sample Australian corporations was undertaken, measuring changes in ESG disclosure levels and disclosure focus around the time a SLAPP was issued by each sample firm.

Findings

This paper provides support for the contention that both the number of ESG disclosures and the type of ESG disclosures changed after the sample firms issued SLAPPs.

Research limitations/implications

A number of limitations are identified within the paper, including difficulties identifying when SLAPPs are initiated.

Originality/value

To the authors’ knowledge, this is the first investigation of the relationship between SLAPPs and ESG reporting, and this study helps open up a new area of research into how ESG reporting is used by corporations in a strategic manner.

Abstract

Employers are now being sued for the crimes of their employees. These lawsuits are usually based on a claim of employer negligence for having hired a dangerous employee. However, similar lawsuits are also being brought over employer failings in post‐hiring decisions of supervision, retention, training and assignment. This paper examines an employer’s potential liability from post‐hiring decisions and offers measures for reducing that liability threat.

Abstract

Purpose

In this paper the authors seek to understand how academic conferences [re]produce deeply embedded gendered patterns of interaction and informal norms within the business disciplines.

Design/methodology/approach

Drawing on Acker's (2012) established and updated theory of gendered organisations, the authors focus on the role of academic conferences in the reproduction of gendered practices in the business disciplines. The authors surveyed academics at top universities in Australia and New Zealand who had attended international conferences in their discipline area.

Findings

Academic conferences in the business disciplines communicate organisational logic and act as gendered substructures that [re]produce gendered practices, through the hierarchy of conference participation. Even in disciplinary conferences with a significant proportion of women delegates, the entrenched organisational logic is manifest in the bodies that perform keynote and visible expert roles, perpetuating the notion of the “ideal academic” as male.

Practical implications

The authors call for disciplinary associations to formulate an equality policy, which covers all facets of conference delivery, to which institutions must then respond in their bid to host the conference and which then forms part of the selection criteria; explicitly communicate why equality is important and what decisions the association and hosts took to address it; and develop databases of women experts to remove the most common excuse for the lack of women keynote speakers. Men, question conference hosts when asked to be a keynote speaker or panelist: Are half of the speakers women and is there diversity in the line-up? If not, provide the names of women to take your place.

Originality/value

The contribution of this study is twofold. First is the focus on revealing the underlying processes that contribute to the [re]production of gender inequality at academic conferences: the “how” rather than the “what”. Second, the authors believe it to be the first study to investigate academic conferences across the spectrum of business disciplines.

Abstract

Purpose

Service users very often interpret and respond to their experiences of death, dying and bereavement through a religious or spiritual lens. However, recent trends in religion and belief have influenced how professionals respond to indicators such as faith. Since the post-war years in Britain, and due to the transfer of services from church to state, as well as the change in the religious landscape, language has largely secularized. When people start addressing religion and belief again, they lack the appropriate literacy to do so, this is termed religious literacy by Dinham (2015). The purpose of this paper is to explore how professionals in end of life (EOL) care respond to service users’ religious and spiritual indicators, through the lens of religious literacy.

Design/methodology/approach

The paper draws from an ethnographic study undertaken across hospices in England, UK. In this study, healthcare professionals (HCPs) were observed for one calendar year.

Findings

Results show that lack of religious literacy on the part of HCPs may lead to subtle and unintentional microaggression. Three types of indications of microinvalidation have been noted: verbal, non-verbal and environmental.

Originality/value

This paper innovates in offering a first-hand phenomenological interpretation of observations in the field. The research data capture visually the impact of lack of religious literacy, an achievement which adds to the dialogue about service user rights in EOL care.

Abstract

Investigates the differences in protocols between arbitral tribunals and courts, with particular emphasis on US, Greek and English law. Gives examples of each country and its way of using the law in specific circumstances, and shows the variations therein. Sums up that arbitration is much the better way to gok as it avoids delays and expenses, plus the vexation/frustration of normal litigation. Concludes that the US and Greek constitutions and common law tradition in England appear to allow involved parties to choose their own judge, who can thus be an arbitrator. Discusses e‐commerce and speculates on this for the future.

More than 100 macros have been written and made available on the Web since the debut of PFW in 1996. Evidently, OML has benefited many OCLC system users in automating their jobs. Nevertheless, finding the desired macros takes considerable time and effort because Web sites that provide macros present them in widely varied formats. This article presents the Web sites that currently provide macros for sharing, initiates the discussion on Web macro presentation guidelines, evaluates the presented Web sites based on these guidelines, and provides a source list of useful macros specifically for OCLC subsystem applications.

Abstract

This paper examines the changing merchant liability standards for criminal attacks occurring on business premises. Customer lawsuits seeking to hold businesses responsible for the criminal attacks of others are becoming more common. Selected cases illustrate the requirements to prove business negligence, the usual theory of merchant liability. Varying, sometimes conflicting, state court decisions set each state’s merchant liability standard for third party criminal attacks. Generally, state courts are now more willing to impose liability when merchants fail to protect customers from third party attacks. Four suggestions for merchant response to the varying standards are provided.

Several U.S. Courts of Appeals have recently decided cases involving the impact of employment application fraud on discrimination and wrongful discharge suits. These cases are initiated by a terminated employee who sues his former employer claiming the termination was discriminatory or in some other way wrongful. What if it is discovered that the employee, during the employment application process, lied about his work or education history? Should this fraud impact the employee’s discrimination or wrongful discharge suit? Terminated employees have argued that they should still be compensated while employers have countered that the employee,because of his fraud, was never rightfully employed and is owed nothing. The U.S. Courts of Appeals, which are one rung below the Supreme Court, have produced conflicting decisions. This paper examines those conflicting decisions and makes recommendations as to how employers can reduce their potential liability from these suits.
