The chapter elaborates a critical theoretical narrative about the political economy of European capitalism. It illustrates how precariousness has been exacerbated by the impact of the global financial crisis and the emergence of a new system of European governance. Theoretical accounts in the sociology of work and labor studies have demonstrated the complexity of the outcomes and widely discussed the role of national labor market institutions and employment policies and practices, political ideology, and cultural frameworks impinging upon precarious work as a multidimensional concept. The chapter’s core concern is to illustrate how shifts in power resources, and particularly the weakening and deinstitutionalization of organized labor relative to capital, has acted as a central social condition that has brought about precariousness during the years leading up to and following the 2007–2008 crisis. In so doing, the chapter aims to overcome the existing theoretical accounts of precariousness which have often been limited by one or another variant of “methodological nationalism,” thereby exploring the transnational apparatuses that are emerging across national economies to date, and which impinge upon the structures and experiences that workers exhibit in an age of growing marketization.

We examine the translation of the concept of privacy in the advent of digital communication technologies. We analyze emerging notions of informational privacy in public discourse and policymaking in the United States. Our analysis shows category change to be a dynamic process that is only in part about cognitive processes of similarity. Instead, conceptions of privacy were tied to institutional orders of worth. Those orders offered theories, analogies, and vocabularies that could be deployed to extrapolate the concept of privacy into new domains, make sense of new technologies, and to shape policy agendas.

Ever since Robert Ezra Park and Ernest Burgess published their classic research on Chicago which described “how” residential neighborhoods follow a distinct ecological pattern, generations of urban practitioners and theoreticians have been arguing about “why” they are spatially distributed. This essay is designed to demonstrate the utility of Visual Sociology and the study of Vernacular Landscapes to document and analyze how the built environment reflects the changing cultural identities of neighborhood residents. It is strongly suggested that a visual approach can also help build a bridge between various theoretical and applied disciplines that focus on the form and function of the metropolis. While discussing some of these often-competing models, the text is illustrated by a selection of photographs taken in Brooklyn, New York whose neighborhoods over the past century have been a virtual Roman fountain of ethnic transitions. Although many of the oldest and newest residents of Brooklyn such as Chinese, Italians, Jews, and Poles would be familiar to Park and Burgess, others such as Bangladeshis, Egyptians, and Koreans would not. Ideas about Old and New cities from the “classical” to the “post-modern”; from Park and Burgess to Harvey and Lefebvre are also synthesized via the insights of J. B. Jackson.

Some theories about urban ethnics are synthesized here by looking at “ethnic vernacular landscapes.” Since 1965, the diversity of American cities has drastically changed. It might appear at first glance that the new elements are blending together, but a closer look reveals a complex multicultural mosaic. In the wake of the 21st century, new and old ethnic landscapes co-exist, overlap, and compete with one another, and in the process they define the essence of the new American city. A visual approach can be an important tool in studying this complex and rapidly changing social reality.

Zerbe has elsewhere developed a concept of economic efficiency that has implications for common law efficiency. Here we explore aspects of this concept of efficiency for the relationship between common law efficiency and considerations of distributive justice. In particular, we consider examples from criminal law — the law of rape, from contract law-exculpatory clauses, and from tort law-contribution. We find that including considerations of distributive justice better explains common law efficiency than traditional Kaldor-Hicks effficiency.
