Abstract

Purpose

Often, the application of specific relief to Islamic banking is unspoken and unwritten. However, few studies suggest that legislation on specific relief needs amendment to cater for the effective application of Islamic banking and finance in the country and proposing the idea to introduce an Islamic Specific Relief Act. This paper aims to understand the application of specific relief to Islamic banking in Malaysia. This paper will look at the application of specific relief in Malaysia and discuss the extent of its application to Islamic banking cases reported in Malaysia from 1983 to 2015. The study will shed light on the general types of specific relief from Malaysian and Islamic law perspectives to conclude whether the provisions of Malaysian specific relief law invoked in courts in Islamic banking cases are in line with the general principles of Sharīcah. To further support this, evidence from various commercial civil codes of Muslim countries have been discussed to analyse these provisions from a more practical perspective.

Design/methodology/approach

This is a legal exploratory study primarily focussed on library research.

Findings

When it comes to Islamic banking, federal legislations dealing with commercial matters are applicable. For example, in Islamic banking products, if the land is the subject matter, then National Land Code 1965 shall be applied, and when dealing with Islamic banking agreements, the provisions of Contracts Act 1950 shall be followed. This has been highlighted as a problem faced by Islamic financial services in the case of Tan Sri Abdul Khalid Ibrahim v. Bank Islam Malaysia Berhad and other cases where the judge referred Engku Rabiah and quoted that in Islamic banking transactions, “the transactions entered by the parties may be Sharīcah-compliant in the first place, but upon enforcement of the contracts, the court may make orders and decisions that may side line the Islamic legal principles”. This happens when the substantive laws applicable to Islamic banking are incompatible with Islamic law. Fortunately, the analysis of the relevant sections of Specific Relief Act 1950 in this research proves that the provisions reviewed are in line with Sharīcah. However, to further enhance the operation of specific relief, the granting of specific relief could be made a general rule rather than an exceptional rule available with stringent rules. The research revealed that Specific Relief Act (1950) is expressly referred and discussed only in three cases reported from 1983 to 2015. There are only two specific sections of Specific Relief Act (1950) that have been deliberated in the reported case law on Islamic banking: provisions related to granting of a mandatory injunction and specific performance of contracts.

Originality/value

It is anticipated that this paper will assist to comprehend the importance of converging law and Sharīcah in legislations to attain Sharīcah compliance and will help to realise that not all conventional legislations are Sharīcah non-compliant.

Purpose

The purpose of this paper is to examine the community recovery efforts undertaken by Houston, Texas, sport organizations following Hurricane Harvey in 2017.

Design/methodology/approach

Forty-eight media articles, 138 social media posts from Houston athletes and five semi-structured interviews with Houston sport organization executives underwent a content analysis to categorize responses of disaster relief activities. All eleven categories were identified. Three themes emerged from additional analysis: organizations serving as communication hubs, earned trust and internal organizational support. Benchmark examples in key categories are also discussed.

Findings

This paper provided focused analysis of the reactions of several Houston area sport organizations during the immediate disaster recovery period. Organizations participated in both tangible and emotional recovery efforts. The long-term impacts of these efforts will require additional investigation. The findings of this case study are specific to the relief efforts in Houston, Texas, following Hurricane Harvey in 2017 and may not be generalizable beyond this scope.

Practical implications

Sport organizations and community leaders can better prepare for future disaster responses by gaining insight into the roles and procedures enacted by the Houston teams following the Hurricane in 2017.

Originality/value

This study provides a detailed examination of the responses of several Houston sport organizations following Hurricane Harvey, including perspectives from executives inside of the organizations. Utilizing social anchor theory, this paper expands our understanding of the impacts sport organizations may produce in their roles as social anchors during disaster relief and recovery.

Abstract

Purpose

The aim of this study is an exploration of the behavioural addictions to work (workaholism) and to use of technology (technolophilia), particularly as they overlap in managers' work routines and expectations placed on their employees.

Design/methodology/approach

The paper presents a qualitative analysis of managers' comments from structured interviews and focus groups in several countries.

Findings

This research culminated in a model of various adaptations to both work pressure and need to use technology in today's business work, including the potential to over‐adapt or lapse into a pattern of addiction.

Research limitations/implications

The consolidation of multi‐disciplinary literature and the framework of the model will serve as a reference points for continuing research on behavioural addictions related to work and technology.

Practical implications

Human resource professionals concerned with employee well‐being can utilize the components of this model to proactively recognize problems and generate remedies. Specific suggestions are offered to offset undesirable adaptations.

Originality/value

This is the first study to focus on the mutually reinforcing addictions to work and use of technology – an important step forward in recognizing the scope of the issue and generating further research with practical application in business world.

Abstract

Investigates the differences in protocols between arbitral tribunals and courts, with particular emphasis on US, Greek and English law. Gives examples of each country and its way of using the law in specific circumstances, and shows the variations therein. Sums up that arbitration is much the better way to gok as it avoids delays and expenses, plus the vexation/frustration of normal litigation. Concludes that the US and Greek constitutions and common law tradition in England appear to allow involved parties to choose their own judge, who can thus be an arbitrator. Discusses e‐commerce and speculates on this for the future.

Abstract

Purpose

The purpose of this paper is to explore disaster relief activities implemented by high-profile sport organisations and athletes.

Design/methodology/approach

In total, 70 newspaper and magazine articles reporting the disaster relief efforts of sport organisations and athletes in various regions were identified and analysed through a content analysis.

Findings

The authors find 11 forms of activities that sport organisations and athletes have implemented to provide social support in post-disaster situations. These forms are classified based on type of post-disaster social support: eight forms are categorised as tangible support, while the other three are categorised as emotional support.

Research limitations/implications

The findings are based on the analysis of the news media that predominantly reported North American cases, and the current list of disaster relief activities may exclude some activities ignored by these specific data sources. Using the forms of disaster relief activities identified in this study as an initial framework, future studies should engage in the focused analysis of disaster response among sport organisations and athletes.

Practical implications

The comprehensive list of the disaster relief activities identified by this study should aid the decision-making of sport organisations and athletes in facing disasters and enable them to better prepare for their disaster response.

Originality/value

This study reveals the extensiveness and uniqueness of disaster relief activities currently implemented by sport organisations and athletes.

Abstract

Purpose

This paper aims to examine the issues faced by cities known for their struggles with over-tourism, before and during the Covid-19 pandemic. Opportunities to overcome over-tourism in a post-Covid-19 world are discussed.

Design/methodology/approach

This paper is a review of the fundamental issues of over-tourism before and during the Covid-19 pandemic.

Findings

The pandemic has turned the state of tourism in many cities from “over-tourism” to “no tourism”, prompting massive state intervention from governments, regardless of their political ideology. The pandemic has also been more effective than top-down governmental orders and ground-up green initiatives to reduce pollution within a short span of time.

Practical implications

Many have been left behind by the competitive nature of globalisation, and the Covid-19 pandemic could present a case for governments to play a larger role in improving their citizens’ quality of live. These would include a fundamental shift in focus to jobs (instead of gross domestic products) by governments, increased investment in public works and environment-friendly infrastructure and expanding public regulatory and enforcement roles in areas such as crowd control and inspection of home rentals for regulatory compliance.

Social implications

When normalcy returns and tourists begin to flock to destinations and attractions, there should be a much higher awareness amongst both tourists and locals of the maintenance of personal hygiene and of the need for safe distancing while in dense crowds. A new social norm should emerge.

Originality/value

A heightened sense of material, community, emotional and health and safety well-beings of local residents would ease concerns and perceptions of over-tourism.

To develop and test three different inventory management strategies as applied to the complex emergency in south Sudan.

Design/methodology/approach

Quantitative modeling, simulation, and statistics.

Findings

This research identified critical system factors that contributed most significantly to inventory system performance, and identified strengths and weaknesses of each inventory management strategy.

Research limitations/implications

This research represents a first step in developing inventory management systems for humanitarian relief. Future work would include modeling correlation among relief items, multiple items, and considering the impact of information.

Practical implications

In a domain that has seen limited application of quantitative models, this work demonstrates the performance benefits of using quantitative methods to manage inventory in a relief setting.

Originality/value

This research has value for relief organizations by providing a real‐world application of quantitative inventory management strategies applied to a complex emergency, and demonstrated performance advantages of quantitative versus ad hoc methods. This research has value for researchers by providing a new application of simulation and mathematical modeling (humanitarian relief).

Abstract

Purpose

The purpose of this paper is to compare performance measurement in the humanitarian relief chain with performance measurement in the commercial supply chain, develop performance metrics for the humanitarian relief chain, and present a framework that can be used as a basis for a performance measurement system in the relief sector.

Design/methodology/approach

The performance measurement analysis is developed through extensions on an existing performance measurement framework. Details regarding relief chain system were obtained through off‐site and on‐site interviews with relief professionals from World Vision International.

Findings

The paper finds that this work yielded: a comparison of performance measurement in the humanitarian relief chain with performance measurement in the commercial supply chain, new performance metrics for the humanitarian relief chain, and a performance measurement framework for the relief chain.

Research limitations/implications

The paper shows that future work includes performance measurement in community involvement and empowerment, performance measurement in community development, performance measurement in the combined relief and development mission, and understanding the role and impacts of cooperation and coordination in the relief chain.

Practical implications

This paper provides a practical procedure for developing effective performance measurement systems for relief logistics processes.

Originality/value

The paper presents to humanitarian relief professionals a new approach to performance measurement for relief logistics and to researchers in supply chain performance a comparison and contrast between performance measurement for relief and performance measurement in the commercial chain, new performance metrics for the relief chain, and implications for modern, quick‐response supply chains.

Abstract

Purpose

This study seeks to provide insights into corporate achievements in supply chain management (SCM) and logistics management and to detail how they might help disaster agencies. The authors aim to highlight and identify current practices, particularities, and challenges in disaster relief supply chains.

Design/methodology/approach

Both SCM and logistics management literature and examples drawn from real‐life cases inform the development of the theoretical model.

Findings

The theoretical, dual‐cycle model that focuses on the key missions of disaster relief agencies: first, prevention and planning and, second, response and recovery. Three major contributions are offered: a concise representation of current practices and particularities of disaster relief supply chains compared with commercial SCM; challenges and barriers to the development of more efficient SCM practices, classified into learning, strategising, and coordinating and measurement issues; and a simple, functional model for understanding how collaborations between corporations and disaster relief agencies might help relief agencies meet SCM challenges.

Research limitations/implications

The study does not address culture‐clash related considerations. Rather than representing the entire scope of real‐life situations and practices, the analysis relies on key assumptions to help conceptualise collaborative paths.

Practical implications

The study provides specific insights into how corporations might help improve the SCM practices by disaster relief agencies that continue to function without SCM professional expertise, tools, or staff.

Originality/value

The paper shows that sharing supply chain and logistics expertise, technology, and infrastructure with relief agencies could be a way for corporations to demonstrate their good corporate citizenship. Collaborations between corporations and disaster agencies offer significant potential benefits.

Abstract

Disaster relief workers experience psychological and physical needs as a direct consequence of their disaster involvement. While this impact has been acknowledged, relatively little is known about the nature of the psychosocial demands generated by prolonged exposure. Developing both comprehensive preparatory and support programmes for relief workers will require that the nature of these demands, their impact on personnel, and their implications for disaster management are documented. Describes the experiences of a group of nurses who provided relief care in Romanian orphanages in the aftermath of the 1989 revolution in that country. Suggests that prolonged disaster exposure creates specific personal demands and operational problems. Problems were described in relation to operational practices and national issues (e.g. political and cultural factors). Describes the implications of these factors for relief worker wellbeing and relief operation effectiveness, together with suggestions for managing these demands.
