Abstract

Purpose

The paper aims to explore the extent to which the legal experience of minority shareholder actions in Hong Kong supports the sociological model of the Chinese family firm as developed by Wong Siu‐lun and reports some preliminary findings for the period 1980‐1995.

Design/methodology/approach

This paper is based upon the analysis of 275 minority shareholder petitions in the High Court of Hong Kong between the years 1980 and 1995 inclusive. It also draws upon material from a questionnaire sent to law firms involved in those petitions and interviews with members of the Hong Kong judiciary with experience of hearing minority shareholder cases, members of the legal profession and accounting and company secretarial professions directly or indirectly involved in the administration of companies in Hong Kong and regulators.

Findings

The findings indicate that the problematic early, emergent stage of the model as described by Wong Siu‐lun is quite accurate. Whilst there is considerable support for some aspects of the model of the Chinese family firm, the experience indicates a number of complex dynamics at play, some of which the model does not take into account. However, the findings, at least by implication, do point to the cohesive strength of the Chinese family firm with occasional fault lines resulting in some “disputes” of earthquake proportions which may rumble on in some cases for years.

Practical implications

The findings demonstrate the usefulness of lifecycle modeling of the family and other type of corporate firm. It also demonstrates some of the complex subtleties at play. The findings also have implications for the law matters thesis of La Porta et al.

Originality/value

This is one of the first studies to actually examine the legal experience of minority shareholder protection in a particular jurisdiction (Hong Kong) by examining the petitions and writs actually filed and relating them to a sociological model of the Chinese Family firm.

Purpose

The social venture (SV) is an increasingly popular form of organization to pursue social goals using a commercial approach. Although marketing plays an important role in SV research and a key driver of the performance of SVs, how and the extent to which market conditions play a role remains understudied. This study examines if market turbulence can moderate marketing capabilities and performance relationships.

Design/methodology/approach

The authors developed several hypotheses rooted in the marketing literature and tested them using data collected from a sample of 109 SVs from East Asia (i.e. Hong Kong and Taiwan). Using multiple regression analysis and structural equation modeling, the authors analyzed the marketing capabilities and financial and social performance relationships and the positive moderating role of market turbulence.

Findings

The results suggested that market turbulence is a positive moderator which influences the effect of the marketing capabilities–financial performance relationship, but not the marketing capabilities and social performance relationship.

Originality/value

This paper attempts to interrogate the SV's marketing capabilities–performance relationship in the East Asian context and how market turbulence may enhance or weaken the relationship. This is one of the earliest papers in this research area. The key findings from this research offer valuable theoretical contribution to the study of SV performance.

Abstract

Purpose

When organizations implement a new information system (IS), they often experience users' resistance behaviors. This study explored the effects of IS self-efficacy, perceived ease of use, perceived usefulness, and anxiety on resistance to IS change within the hospitality domain. It also compared these relationships before and after completing e-learning courses for a new IS.

Design/methodology/approach

Survey responses were gathered from current and future hospitality employees. All hypotheses were tested via confirmatory factor analysis and structural equation modeling.

Findings

The results demonstrated that (1) IS self-efficacy had significant effects on both perceived usefulness and perceived ease of use of IS; and (2) IS anxiety had a significant impact on resistance to IS change, both before and after completing the e-learning courses. The results also showed that self-efficacy had a significant effect on anxiety and, in turn, resistance to change, after completing the e-learning courses, but not prior to the training.

Research limitations/implications

This study addressed the lack of theory-driven empirical research on predictors of user resistance to IS change, based on social cognitive theory, technology acceptance models, and user resistance research.

Practical implications

Based on the findings, hospitality operators and vendors can focus on improving factors influencing user adoption of a new IS when they design and implement it. Operators can design better change management strategies to reduce resistance to IS change.

Originality/value

Few investigations have been conducted to explain the relationships among the aforementioned factors, before and after completing e-learning for a hospitality IS.

Hannah King occupies a unique place in missionary and colonial history, the history of education, cross‐cultural relations and material culture in New Zealand. She was the only woman from the first 1814 Missionary settlement of the Church Missionary Society (CMS) in New Zealand to remain in New Zealand for the rest of her life, yet she does not have an entry in the Dictionary of New Zealand Biography, and is rarely indexed in either New Zealand’s general historical works or even works more specifically related to the Missionary era. John and Hannah King were one of three artisan missionary couples who sailed with the Revd Samuel Marsden on his ship, the missionary brig ‘Active’, from Port Jackson, Australia to Rangihoua, in the Bay of Islands, in late 1814. Marsden’s 1814 Christmas Day service on the beach at Rangihoua is recognised as the beginning of missionary activity and planned European settlement on New Zealand soil.

Purpose

The purpose of this paper is to investigate similar and different wayfinding strategies used by novice and expert patrons at an academic library.

Design/methodology/approach

The study employed a usability study approach. In total, 12 people, places, or things were identified as important for students to be able to locate within an academic library. Students from one of three groups (high school, freshmen, and seniors) were randomly assigned a scenario requiring them to find the indicated person, place, or thing. Student researchers video recorded participants and took field notes during the wayfinding activity and conducted an interview about participant’s experience following the exercise.

Findings

Total and average time needed to locate the person, place, or thing indicated in the scenario were determined for each group. In addition, wayfinding tools (signs, maps, help desks, technology, and experience) used by participants were identified.

Originality/value

The research compares novice and expert wayfinding strategies. It is unique in its use of student researchers as part of a sociology class project, to collect and analyze the data.

The Daily Telegraph has recently published several articles and a considerable amount of correspondence relating to malt whisky and the tricks of the whisky trade. As is usually the case when a daily newspaper takes up a subject of this kind, a number of well ‐ meaning people make a variety of suggestions as to what ought to be done to secure the purification of the particular Augean stable under discussion and to ensure the reception by the purchaser of the article which he really desires to have. But what ought to be done and what can be done are two very different things, and the question of what it is possible to do in the present state of scientific knowledge—and under the existing law as it is at present administered— is, as a rule, avoided by the writers referred to. It has been suggested, for instance, that it should be made compulsory that all vessels in which spirits are sold should bear a label distinctly stating the exact nature of the contents of such vessels. This would be an excellent suggestion if it could be effectively carried out, but, before this can be done, it is necessary to devise a method of compulsion. A man who sells as malt whisky an article mainly or entirely composed of spirit to which that title should not be applied would not have any very serious scruples as to the truth of the statements which appear on his labels. He must be compelled to act honestly by some sufficient force, and, short of a law which would permit the manufacture and “blending” of whisky to be carried out by certain persons only, according to specified rules, and under strict Government supervision in every case, no legislative enactments whatever would have the effect of preventing the various forms of this particular fraud. At present there are no legal definitions whereby the composition and characters of the articles described as “malt whisky” and “whisky” are laid down, excepting the definitions which may be held to be implied in the application of the 6th section of the Sale of Food and Drugs Act of 1875 to the case. This section requires that an article shall be of the “nature, substance, and quality demanded by the purchaser.” On the strength of this section it is quite unjustifiably assumed that the compulsion referred to can be effectively secured by the operation of the Sale of Food and Drugs Acts. According to our legal system it is essential under the criminal Acts— and the Food Adulteration Acts are criminal Acts—for the prosecuting authority to prove beyond all possibility of question that a person charged with an offence is guilty of that offence, and, in regard to the matter under consideration, it would therefore be necessary to absolutely prove by scientific evidence that any given mixed spirit, for the sale of which as malt whisky a prosecution had been instituted, was not of the nature, substance, and quality of the article demanded. Under the present conditions relating to sampling under the Acts this would be impracticable, except, possibly, on very broad lines; and, assuming that scientific investigation resulted in the possibility of fixing clear and definite points of distinction between the true and the false, there would still be the enormous difficulties and the heavy expenses attending the proving of offences of this character to the satisfaction of the Courts—difficulties and expenses which local authorities cannot fairly be expected to face. If, after the lengthy and expensive investigations that would be necessary, and which could only be properly carried out with Government aid, by a scientific Commission appointed by the Government, it were found possible to establish working definitions and standards, these would necessarily be only applicable to a limited extent, just as is at present the case in regard to milk and butter; while the question of quality can never be dealt with under repressive Acts of, Parliament of any kind. Assuming the establishment of standards of some kind we fully admit the possibility, under altered legal conditions, of checking the grosser forms of whisky sophistication by the employment of legal machinery, as is done with various other products; but vast amounts of various spirit mixtures could still be sold under false names with impunity. We should still have with us the legalised inferiority and the legalised adulteration of comparatively minor type which we have in the case of milk and butter. What is required and what alone can be effective, in dealing with sophistications which the law can never reach, is the provision of adequate and entirely independent guarantees which are based both on permanently‐applied analytical investigations carried out upon quantities of material which are not absurdly limited, and on a system of permanent and independent inspection,—both being supplied by some authority or authorities of sufficient standing. While the statements made by a reputable firm ought to carry weight, and ought, no doubt, to be accepted as valuable so far as they go, there is always necessarily and obviously a great element of weakness in the declarations put forward by a firm with respect to its own products. Particularly in view of modern commercial conditions something very much stronger than a personal asseveration as to the purity and excellence of one's own goods is now in reality required. That this is the case is shown by the fact that the demand for independent guarantees has recently been repeatedly voiced in the general press. The public are badly in want of education on all such questions and the Daily Telegraph is entitled to the thanks of the community for having initiated a discussion which can only be productive of good results in this direction.

Abstract

Purpose

The purpose of this article is to investigate the effectiveness of accountability mechanisms employed in financial management practices of school principals in the Eastern Cape Provincial Department of Education. The strengths and weaknesses of the systems and mechanisms of the processes to hold school principals accountable are explored in detail in this study. The argument that this article seeks to advance is that accountability of the school principal to the school governing body (SGB) does not yield the best results in terms of efficiency. It creates a loose arrangement in terms of which the school principal takes part in financial mismanagement in schools.

Design/methodology/approach

Data collection was made through semi-structured interviews whose purpose was to draw experiences from SGBs, particularly the finance committees who are in fact the sub-committees of the SGBs; as well as literature review. The finance committee is made up of the chairperson of the SGB, the secretary of the SGB, the treasurer of the SGB, and the financial officer who is a clerk responsible for the keeping and the management of financial records of the school. The process started with semi-structured interviews, then transcribing, coding, developing themes, making meaning of the themes and subsequently developing a principle.

Findings

Mechanisms employed by schools and the Department of Education to hold principals accountable for their financial management practices fail to make them fully accountable and effectively face the consequences of acts on their part that are illegal and unlawful. The mechanisms need a great deal of overhauling. The argument that this article seeks to advance is that this account of the school principal to the SGB does not yield the best results in terms of efficiency. It creates a loose arrangement in terms of which the school principal easily gets away with a crime when financial mismanagement occurs in the school.

Research limitations/implications

Participants could possibly not be comfortable and willing, to tell the truth as it is. Participants might have the fear that telling the truth could land them in trouble with the law. Whilst participants were assured by the researchers of their anonymity and the confidentiality of the information given by them, there was no guarantee that the fear of being exposed would subdue completely. There was also a possibility that some participants would not be willing to say the truth as it is for fear of being victimised by other participants for exposing the status quo in their schools.

Practical implications

The findings and recommendations from this study may be used by the Department of Basic Education as a source of information for policymakers and stakeholders to understand the effectiveness of their mechanisms to ensure the accountability of school principals on issues of financial management. On the basis of this study, policymakers will then be able to revisit their policies for the purpose of strengthening them. The principal is therefore responsible for the day-to-day administration and management of school funds because of this mandatory delegation. However, when things go wrong, it is the SGB that is held liable.

Social implications

School principals hold dual accountability in terms of which they are accountable to the employer only in so far as their professional responsibilities are concerned on financial management in the first instance. They are by no means accounting officers in schools. In the second instance, they are fully accountable to the SGB for issues relating to financial management. Section 16A of SASA lists the functions and responsibilities for which the principal as an employee of the Department of Basic Education, and in his official capacity as contemplated in Sections 23(1) and 24(1) (j) of the same Act, is accountable to the head of department (HOD).

Originality/value

The study provides a theoretical and empirical contribution to the existing literature on the effectiveness of the mechanisms employed to ensure the accountability of school principals in their financial management practices in schools. It offers practical recommendations putting in place mechanisms that effectively hold school principals wholly accountable for their financial management practices in schools. Most of the time, it is easy for the principal to get away with a crime even in instances where he or she is called upon to account for alleged financial mismanagement.

THE EMOTIVE term ‘over‐supply’ has been used for some years' in the library profession, particularly by those senior librarians who have experienced large numbers of applicants for each junior professional post they have advertised. The existence of an over‐supply has also been denied from time to time—not too recently, perhaps—or, at best, misgivings have been soothed by the feeling that unemployment in librarianship might not compare unfavourably with unemployment in other professions, and the general problem of graduate unemployment is a national factor quite unrelated to specific professions.

Abstract

Purpose

E-government development (EGD) is vital in enhancing the institutional quality and sustainable public service (SPS) delivery by eradicating corruption and cybersecurity crimes.

Design/methodology/approach

The present study applied econometric fixed-effect (FE) regression analysis and random forest (RF) algorithm through machine learning for comprehensive estimations in achieving SPS. This study gauges the nexus between the EGD as an independent variable and public service sustainability (PSS) as a proxy of public health services as a dependent variable in the presence of two moderators, corruption and cybersecurity indices from 47 Asian countries economies from 2015 to 2019.

Findings

The computational estimation and econometric findings show that EGD quality has improved with time in Asia and substantially promoted PSS. It further explores that exercising corruption control measures and introducing sound cybersecurity initiatives enhance PSS's quality and support the EDG effect much better.

Practical implications

The study concludes that E-Government has positively impacted PSS (healthcare) in Asia while controlling cybersecurity and institutional malfunctioning made an E-Government system healthier and SPS development in Asia.

Originality/value

This study added a novel contribution to existing E-Government and public services literature by comprehensively applied FE regression and RF algorithm analysis. Moreover, E-Government and cybersecurity improvement also has taken under consideration for PSS in Asian economies.
