Abstract

Purpose

The purpose of this paper is to identify factors that affect farm acceptance of the new seeds. This paper develops a Bivariate Probit model with adjusted sample selection bias to analyze Chinese farmers' sequential decision‐making process in their adoption of plant new varieties (new seeds) under the new Variety Property Right Protection System.

Design/methodology/approach

Face‐to‐face interviews with farm households in 22 provinces were used to gather questionnaire information. A total of 341 surveys were collected and analyzed using a Bivariate Probit model adjusted for sample selection bias problems. Descriptive statistics for each selected variable used in the model are also presented.

Findings

This study concluded that farm location, land size, farm perceived dealer reputation, and farmer‐to‐farmer word‐of‐mouth information were found to be important factors that affect farm adoption of new seeds.

Originality/value

This study is based on first‐hand survey information collected by the researchers. Thus, the results are original and were not published elsewhere.

Abstract

Purpose

Since the start of seed and other market reforms in the 1990s, the annual number of improved varietal releases for maize in Kenya has increased substantially. Prior to the reforms, private firms were restricted in introducing new varieties, could not protect their intellectual property and farmers had to rely exclusively on improved seeds developed and marketed by the public sector. Reforms have resulted in not only private firms entering the market and releasing improved varieties, but also an increase in varietal releases by the public sector. The purpose of this paper is to review some of the key policy reforms related to maize in Kenya, and their impacts on varietal development and yields.

Design/methodology/approach

The authors estimate a yield model that relates national maize yields to a number of input policy variables. The authors employ a two-stage least square regression, as one of the explanatory variables – the number of varietal releases – is likely endogenous with yield. The authors use policy variables such as public R&D, the number of plant breeder’s rights issued, and the years since private varieties have been introduced as instrument variables to estimate their influence new varietal releases directly, and then new varieties, inputs and other policies to measure their impact on yields.

Findings

The results show that policy changes such as the introduction of intellectual property rights had an important impact on the number of improved maize varieties released. However, the outcomes of the policy change such as the number of varieties and the share of area under improved varieties has no impact on increasing maize yields. The authors argue that this is because farmers continue to use older improved varieties because of the dominance of a parastatal in the maize, seed market and that newer improved varieties may not have the assumed yield advantage. Future policy and programs should be directed toward increasing the adoption of improved varieties rather than simply releasing them.

Originality/value

This paper provides evidence that while policy change may lead to new varietal development and release, its aggregate productivity impacts may be limited without additional reforms and intervention.

Abstract

Purpose – The objective of this chapter is to examine and provide new perspectives on the contributions of public and private R&D to biotech crop improvement.

Methodology/approach – The chapter examines a set of topics that have affected the way that research is undertaken on plant germplasm improvement and how it has changed with the genetically modified (GM) trait revolution.

Findings – Although the basic science providing the foundations for GM crops was undertaken in the public sector, GM traits and GM crop varieties have been developed almost exclusively by the private sector. The biotech events leading to GM traits are currently being developed largely by five companies – all having ties to both the chemical and the seed industries. The GM crop revolution started in North American in 1996 and has spread slowly to the largest developing countries that have large agricultural sectors, including Argentina, China, Brazil, and India, but not to Europe or Japan.

Practical implication – To shed new light on the economic reasons for private sector dominance in GM crop varietal development in selected crops but not in others.

Social implication – Shows how GM traits have contributed to technical change and declining real food prices.

Abstract

Purpose

This paper seeks to provide an in‐depth discussion on the impact of agricultural biotechnology in developing and least developed countries (LDCs) as well as the concomitant biosafety concerns that might have an impact on trade and the environment whilst highlighting the importance of choosing development pathways that are conducive to the specific needs of these nations without endangering the biodiversity and affecting people's health.

Design/methodology/approach

The paper adopts a socio‐legal approach by undertaking a content analysis of decided cases, relevant treaties and existing studies conducted in areas related to agricultural biotechnology within the framework of sustainable development imperatives.

Findings

The paper suggests that developing countries venturing into agricultural biotechnology need to enrich the technology according to their needs and capabilities in order to be able to weigh the benefits against the risks in the production and import of genetically modified organisms (GMOs) specifically via the implementation of the “precautionary principle” and viable “risk assessment” techniques which conform to their existing international law obligations in view of the findings that most of these nations have not formulated adequate legal and institutional frameworks supported with the necessary expertise to regulate, monitor, and ensure safety of agricultural GMOs produced and/or imported by them.

Practical implications

The issues and suggestions in this paper will enable the development process of developing and least developed economies to conform to the tenets of sustainable development and minimize the loss of Earth's biodiversity.

Originality/value

The paper is of practical use to stakeholders and policymakers alike venturing into agricultural biotechnology. It pools the findings of a cross‐section of studies to look at the implications therein and the arising biosafety and trade issues with special reference to developing and LDCs.

Abstract

Purpose

To provide philosophical discussions of various works, thinking of globalisations and new thoughts on how the developing countries might take benefit of globalisation.

Design/methodology/approach

A wide range of published works, which contain the recent thoughts and debates of the globalisation to developing nations are reviewed, analysed and then critiqued. The authors take some case study examples and evidence from developing worlds, most notably in Indonesia.

Findings

At present, the impact of globalisation will benefit mostly to industrialised countries or MNC's operating in developing countries. Globalisation will bring prosperity to developing world only if industrialised countries and MNC's are willing to adopt a code of conduct, which permits their profit motives to be harmonised with the self‐reliant interest of developing nations. The global rule must be changed in favour of developing countries.

Research limitations/implications

Globalisation is a very wide issue. This paper only highlights issues related to trade, labour, intellectual property and environment. Not many developing and industrialised countries are taken as case example. Thus, there are still a lot of further research needed to prove its usefulness.

Practical implications

Provide a useful source to the global players like industrialised countries, MNC's. It highlights how industrialised countries might contribute to assist developing countries to catch up in line with globalisation. Also useful to MNC's CEO wants to increase their corporate social responsibility.

Originality/value

Provide new taught and suggestion to developing countries, MNC's and industrialised countries. Some evidence, arguments and recommendations have not been discussed in the globalisation debate.

The Green Revolution was a singular event in world history; because of the Green Revolution, world prices for all crops declined. The agricultural mechanization issue was also driven by intellectual property rights (i.e., the right to patent products), as was the agricultural chemical revolution. The livestock industrialization revolution sharply lowered the prices for all livestock products. The Gene Revolution (i.e., the recombinant DNA revolution) further lowered the cost of producing farm products. The Gene Revolution was based on three events. The first was the discovery that DNA (Delbrook) was the carrier of genetic information. The second was the discovery by Watson and Crick of the double helix structure of DNA. The third was the method of stable insertion of DNA into a host genome (Cohen and Boyer). The future of agricultural research depends on the capacity of countries to invent and imitate.

Abstract

Learning outcomes

The objectives of the case study are to provide an overview of intellectual property rights and intellectual property rights in Indian context; understand the intellectual property rights implementation and challenges for implementing it in emerging economies; understand what would be the best approach that companies can adopt when the companies face backlash in such circumstances; and explore the scope for redefining the intellectual property rights in the changing global environment.

Case overview/synopsis

In December 2021, the Protection of Plant Varieties and Farmers’ Rights Authority (PPV&FRA) in India revoked the plant variety protection (PVP) certificate granted to PepsiCo India Holding (PHI) for its Lays variety potato (FL-2027, known as FC-5). The FC-5 variety possessed low moisture content which made it suitable for making potato chips. The controversy started with Pepsi suing the small and marginal farmers of Gujarat for alleged patent infringement and cultivating the patented variety. Pepsi’s legal suit against nine marginal potato farmers in Gujarat initiated the dispute over how intellectual property (IP) rights are used to intimidate small, marginal farmers and its infringement of farmers’ rights. But, on the other side, the interesting aspect was how IP infringement could be a setback for the companies that made the capital investment to develop the variety. The case study discusses the backlash Pepsi faced due to this IP rights legal suit and the punitive aspects of IP rights (IPR) law. Moreover, in the context of the global pandemic, the case study helped discuss the need to redefine the intellectual property rights regime keeping in mind global welfare.

Complexity academic level

The case is intended for use in postgraduate-level management courses in agricultural marketing, agribusiness, international business and economics. This study can help management students understand how IPR is defined, the apparent complexities associated with it and the adverse effect of it on small and marginal farmers in emerging economies.
