Abstract

Purpose

The World Trade Organization (WTO) is one of the best dispute settlement mechanisms in the world. Under WTO rules, aggrieved parties must establish a “prima facie” case before the panel can call on the offending party to respond to the claims. The objective of the present study is to critically evaluate the application of the concept of burden of proof under WTO dispute settlement mechanism.

Design/methodology/approach

The paper examines the rule of “prima facie” in WTO jurisprudence. To do so, the first part will focus on the development of dispute settlement within WTO. The second part is divided into several subsections that will focus on the burden of proof concept, burden of proof in common law, burden of proof in civil law and the prima facie standard.

Findings

The DSU does not explicitly regulate how to allocate the burden of proof, but panels and the AB needed to address that issue early in their history. Despite this, all aggrieved parties to establish a prima facie case before the case can become the subject of a panel hearing. There is a need to adopt a burden of proof standard that assesses evidence on the basis of preponderance of the available evidence rather than on the basis of a party’s failure to adduce evidence to back up or dispute a claim.

Originality/value

The paper is an attempt to address an important issue on the presentation of evidence and proof in international litigation, i.e. WTO.

Abstract

Purpose

The paper aims to advance knowledge by investigating the main factors that impact on innovation through the co-development process between researchers and firms at the very early stage of proof of concept.

Design/methodology/approach

The authors developed an empirical analysis on the proof of concept network project, through a mixed empirical analysis. They explored the main factors that affect the enactment of the co-development process and tested the impact of such factors on the probability for partners to enact a co-development project and generate innovation.

Findings

From the quantitative analysis comes out that the trust of the research team into the potentiality of the technology, the commitment of researchers concerning the scalability of technology and the IP value issued by external experts have a positive impact on the probability to create a match among partners and generate innovation.

Research limitations/implications

Even if all the population of technologies (108) considered in the project implementation are analyzed, the development of the empirical analysis on a specific project within a single country represents a limitation. Future analysis will concentrate on a larger panel of proof of concept experience across Europe.

Practical implications

The success of a co-development process between researchers and companies at the embryonic phase of the technology considers the opportunity to exploit the technologies into real products for the market.

Originality/value

This is an empirical analysis of the first Italian proof of concept implementation that deeply investigates which critical factors can enable innovation by enacting a co-development process between researchers and small and medium-sized enterprises (SMEs).

Abstract

Purpose

The purpose of this paper is to examine how rural entrepreneurship is discussed by analyzing articles in the leading journals of the two main research fields, entrepreneurship studies, and rural studies, through the concept of rural proofing.

Design/methodology/approach

The systematic literature review centers on the two main fields where rural entrepreneurship is studied and covers papers in nine leading journals in entrepreneurship studies and two leading journals in rural studies, between the years 1989 and 2020. In total, 97 papers were reviewed and we utilize and operationalize the rural proofing concept based on Fahmy et al.'s (2004) 3 characteristics of rural: remoteness, accessibility, and rural locale and sense of place. The authors take stock of the dimensions of rural proofing addressed within each of the research fields to find similarities and differences; that is, if articles are rural proofed (or not) when discussing rural entrepreneurship.

Findings

The classification of articles across the three dimensions of rural proofing shows that the field of rural entrepreneurship is being addressed mainly in the dimensions of remoteness and accessibility, while few authors in rural studies journals give priority to the rural locale and sense of place dimension. The results of the authors' review reveal that out of a total of 97 articles on rural entrepreneurship, 56 articles address at least one dimension of rural proofing and 41 articles do not address any dimension. Among the 41 articles not rural proofed, rurality is not problematized when discussing rural entrepreneurship. Instead, the authors focus on specific topics such as social capital, community entrepreneurship/networks, entrepreneurs'/farmers' identity, illegality in rural areas, and institutional framework. The number of non-rural-proofed articles in entrepreneurship journals is almost double that in rural studies journals. This means that authors in entrepreneurship journals do not problematize rurality to the same extent as authors in rural studies journals when addressing rural entrepreneurship.

Research limitations/implications

The authors emphasize the need for increased cross-fertilization between the fields of entrepreneurship and rural studies as an avenue to develop the entrepreneurship field in the direction towards rural proofing. A close collaboration with academia and policymakers is essential to promote interdisciplinary research in order to make a distinctive contribution to rural development. Scholars in either of the two fields will benefit from our review and identification of similarities and differences in the research. The review is one step towards promoting a closer dialog between the two fields.

Originality/value

Previous reviews have focused mainly on what rural entrepreneurship entails (e.g. what topics are discussed) rather than how rural entrepreneurship is discussed. This paper centers on the differences and similarities of the two main fields and provides an in-depth qualitative analysis of how rural entrepreneurship is discussed by utilizing the rural proofing concept.

Abstract

Purpose

This paper aims to describe an effort to provide for a robust and secure software development paradigm intended to support DevSecOps in a naval aviation enterprise (NAE) software support activity (SSA), with said paradigm supporting strong traceability and provability concerning the SSA’s output product, known as an operational flight program (OFP). Through a secure development environment (SDE), each critical software development function performed on said OFP during its development has a corresponding record represented on a blockchain.

Design/methodology/approach

An SDE is implemented as a virtual machine or container incorporating software development tools that are modified to support blockchain transactions. Each critical software development function, e.g. editing, compiling, linking, generates a blockchain transaction message with associated information embedded in the output of a said function that, together, can be used to prove integrity and support traceability. An attestation process is used to provide proof that the toolchain containing SDE is not subject to unauthorized modification at the time said critical function is performed.

Findings

Blockchain methods are shown to be a viable approach for supporting exhaustive traceability and strong provability of development system integrity for mission-critical software produced by an NAE SSA for NAE embedded systems software.

Practical implications

A blockchain-based authentication approach that could be implemented at the OFP point-of-load would provide for fine-grain authentication of all OFP software components, with each component or module having its own proof-of-integrity (including the integrity of the used development tools) over its entire development history.

Originality/value

Many SSAs have established control procedures for development such as check-out/check-in. This does not prove the SSA output software is secure. For one thing, a build system does not necessarily enforce procedures in a way that is determinable from the output. Furthermore, the SSA toolchain itself could be attacked. The approach described in this paper enforces security policy and embeds information into the output of every development function that can be cross-referenced to blockchain transaction records for provability and traceability that only trusted tools, free from unauthorized modifications, are used in software development. A key original concept of this approach is that it treats assigned developer time as a transferable digital currency.

Abstract

Purpose

This paper aims to present a novel proof-of-concept framework for implementing building information modeling (BIM) Digital Objects (BDO) to automate construction product manufacturers’ processes and augment lean manufacturing.

Design/methodology/approach

A mixed interpretivist and post-positivist epistemological lens is adopted to pursue the proof-of-concept’s development. From an operational perspective, a synthesis of literature using interpretivism provides the foundation for deductive research inquiry implemented within a case study approach. Within the case study, participatory action research (PAR) is implemented to test the proof of concept via three “waterfall” research phases, namely, literature diagnosis and BIM package selection, BDO development and validation and evaluation.

Findings

The findings illustrate that a BDO (which represents the digital twin of manufacturing products) can augment and drive automation processes and workflows for construction product manufacturers within a contractor’s supply chain. The developed framework illustrates the benefits of a BDO, by reducing the number of manufacturing processes to effectively eliminate early errors in the model, generates financial savings and reduces material wastage.

Originality/value

This research provides a seminal case study that implements BDO to automate construction product manufacturing processes and demonstrates the utilisation of BDO at an operational (vis-à-vis theoretical) level. Future research is proposed to implement a longitudinal approach to measure and report upon the success (or otherwise) of the proof of concept when implemented on fabrications and shop floor procedures.

Abstract

Purpose

This paper aims to develop and then evaluate a novel consolidation and powder transfer mechanism for electrophotographic 3D printing, designed to overcome two longstanding limitations of electrophotographic 3D printing: fringing and a build height limitation.

Design/methodology/approach

Analysis of the electric field generated within electrophotographic printing was used to identify the underlying causes of the fringing and build height limitations. A prototype machine was then designed and manufactured to overcome these limitations, and a number of print runs were carried out as proof of concept studies.

Findings

The analysis suggested that a machine design which separated the electrostatic powder deposition of the print engine from the layer transfer and consolidation steps is required to overcome fringing and build height limitations. A machine with this build architecture was developed and proof of concept studies showed that the build height and fringing effects were no longer evident.

Research limitations/implications

Electrophotography (EP) was initially seen as a promising technology for 3D printing, largely because the potential for multi-material printing at high speed. As these limitations can now be overcome, there is still potential for EP to deliver a high-speed 3D printing system which can build parts consisting of multiple materials.

Originality/value

The analysis of EP, the new method for the transfer and consolidation of layers and the proof of concept study are all original and provide new information on how EP can be adopted for 3D printing.

Abstract

Purpose

This paper aims to propose a conceptual model of policy components for software that supports modularizing and tailoring of information security policies (ISPs).

Design/methodology/approach

This study used a design science research approach, drawing on design knowledge from the field of situational method engineering. The conceptual model was developed as a unified modeling language class diagram using existing ISPs from public agencies in Sweden.

Findings

This study’s demonstration as proof of concept indicates that the conceptual model can be used to create free-standing modules that provide guidance about information security in relation to a specific work task and that these modules can be used across multiple tailored ISPs. Thus, the model can be considered as a step toward developing software to tailor ISPs.

Research limitations/implications

The proposed conceptual model bears several short- and long-term implications for research. In the short term, the model can act as a foundation for developing software to design tailored ISPs. In the long term, having software that enables tailorable ISPs will allow researchers to do new types of studies, such as evaluating the software's effectiveness in the ISP development process.

Practical implications

Practitioners can use the model to develop software that assist information security managers in designing tailored ISPs. Such a tool can offer the opportunity for information security managers to design more purposeful ISPs.

Originality/value

The proposed model offers a detailed and well-elaborated starting point for developing software that supports modularizing and tailoring of ISPs.

Purpose

The purpose of this paper is to show how to employ complex event processing (CEP) for the observation and management of business processes. It proposes a conceptual architecture of BPM event producer, processor, and consumer and describes technical implications for the application with standard software in a perfect order scenario.

Design/methodology/approach

The authors discuss business process analytics as the technological background. The capabilities of CEP in a BPM context are outlined an architecture design is proposed. A sophisticated proofofconcept demonstrates its applicability.

Findings

The results overcome the separation and data latency issues of process controlling, monitoring, and simulation. Distinct analyses of past, present, and future blur into a holistic real‐time approach. The authors highlight the necessity for configurable event producer in BPM engines, process event support in CEP engines, a common process event format, connectors to visualizers, notifiers and return channels to the BPM engine.

Research limitations/implications

Further research will thoroughly evaluate the approach in a variety of business settings. New concepts and standards for the architecture's building blocks will be needed to improve maintainability and operability.

Practical implications

Managers learn how CEP can yield insights into business processes' operations. The paper illustrates a path to overcome inflexibility, latency, and missing feedback mechanisms of current process modeling and control solutions. Software vendors might be interested in the conceptualization and the described needs for further development.

Originality/value

So far, there is no commercial CEP‐based BPM solution which facilitates a round trip from insight to action as outlines. As major software vendors have begun developing solutions (BPM/BPA solutions), this paper will stimulate a debate between research and practice on suitable design and technology.

Current practice when specifying and developing manufacturing software leads to enterprise systems that are difficult to change. With the purpose of improving current practice a model‐driven, component‐based approach to engineering change capable manufacturing systems is described. Application of the approach is supported by a number of proofofconcept system design and construction environments. Each environment organises the use of modelling tools that function to formally capture and apply the results of systems engineering activities carried out by members of project teams. In this way the development of multi‐perspective enterprise (enterprise: a group of organisations sharing a set of goals and objectives to offer products, services or both (ISO 14258)) models is enabled in a computer executable form and means are provided to reconfigure manufacturing systems by using the models to change the way that system components interoperate. Collectively the proofofconcept environments have demonstrated a capability to engineer a variety of types of manufacturing system and by so doing implement a system structure that accommodates rather than inhibits subsequent change, even where that change is of an unforeseen nature.

Abstract

Purpose

The commercialization of research produced by universities constitutes a core facet of academic entrepreneurship (AE). Academic literature reveals the need to shed light on entrepreneurial processes in higher education institutions (HEIs). This study intends to fill this gap by researching the mechanisms for facilitating AE and the variables that can moderate the relationship between such mechanisms and AE in Portuguese HEIs.

Design/methodology/approach

Our research model aims to assess the mechanisms of academic entrepreneurship (AE) within a sample of 125 Portuguese public higher education institutions (HEIs). To test our research hypotheses, we employed a structural equation model (SEM) using the partial least squares (PLS) method. Additionally, our evaluation examines the potential moderating effects of incubator programs, support initiatives, and proof-of-concept programs (PoCs). Our research model seeks to evaluate the mechanisms for facilitating AE and explore the effects of including incubator programs, support initiatives, and PoCs as moderators. The seven variables (Research mobilization, Unconventionality, Industry collaboration, University policies, Incubator programs and support initiatives, Proof-of-concept programs, and academic entrepreneurship) were measured using a 7-point Likert scale.

Findings

The results revealed that different drivers of AE influence the creation and development of entrepreneurial activities. Our findings also show the moderating effects of incubator programs, support initiatives, and proof-of-concept programs on AE. We find that incubator programs, other support initiatives, and PoCs maintain a moderating effect on AE and benefit their respective HEIs.

Research limitations/implications

The study examines only the Portuguese HEI context. Therefore, generalizing these results necessitates reservations. However, the responses came from various actors in HEIs, from different academic backgrounds and research interests. This makes the results more generalizable. Limitations are evident in external validity, given that we gathered the data over a relatively short period.

Practical implications

Observed factors are explored to gain a deeper understanding of their influence on the mechanisms of AE. The implications arise from the new perspective presented and the methodology used to identify mechanisms capable of fostering AE. We hope this research will encourage other researchers to study this topic further.

Social implications

the engagement of universities at the global level should be emphasised in future policy. While universities in innovation systems often have a local focus, their engagement in innovation ecosystems transcends the boundaries of geographic locations.

Originality/value

PoCs had a significant positive moderating effect on the impact of research mobilization and university policies on AE. Thus, we find interactions between universities and industry boost AE. This study demonstrates how AE benefits HEIs by extending orientation towards mobilizing research, unconventional approaches, cooperation with industry, and university policy implementation. We thus advocate a new approach, demonstrating the influence that the mobility of research, unconventionality, industry collaboration, and university policies hold over AE.
