Abstract

Purpose

The paper aims to identify issues in broadcasting and telecommunications regulation and law arising from technological convergence and to suggest a new framework for an integrated approach to policy and regulation.

Design/methodology/approach

A set of South African laws, regulations, bills and policy papers is reviewed to establish to what extent they promote, or at least adapt to, technological convergence using three tests: technological neutrality, integration of policy processes and a “level playing field” for competition.

Findings

It is suggested that current law and regulation fails to meet the South African Government's stated aim of promoting convergence. It is suggested that a reason for this may be the difference in the public interest “rationales” for broadcasting and telecommunications regulation, with the former being largely social and political and the latter largely economic. A new paradigm based on the constitutional principle of freedom of expression is suggested as providing a means of establishing a neutral public interest framework for developing and adapting regulation under conditions of technological convergence.

Research limitations/implications

The research methodology is qualitative. Further research on the economic, social and political welfare costs of regulatory failures to adapt to convergence may be helpful in informing policy, legal and regulatory debates in the future.

Originality/value

This paper suggests a new rights‐based means of direct comparison of public interest costs and benefits across broadcasting and telecommunications using a principle that is present in the South African constitution as well as in international law.

Abstract

Purpose

The purpose of this paper is to find the problems in the establishment of Chinese digital publishing policies and regulations system.

Design/methodology/approach

The research is through analysis the digital publishing policies and regulations in China referring to digital publishing macro policies, e-book policies, digital music policies, network animated cartoon policies, network game policies, as well as through examining the legal system (law, administrative regulation, departmental rules, judicial interpretation) in China.

Findings

The paper concludes that the framework of this system should contain three layers, and Chinese digital publishing policies and regulations system will continue to be improved and digital publishing market will be standardized operation. The digital publishing industry policies, digital publishing resource policies, digital technology policies, copyright policies and personnel training policies need for further investigation and research.

Research limitations/implications

Because of the coverage of digital publishing industry is so wide, the policies and regulations which the paper analyzed were not so comprehensive.

Practical implications

It can help the Chinese government make more comprehensive and rational policies and regulations for digital publishing industry and ensure the sustainable development of digital publishing industry.

Social implications

The sound of digital publishing policies and regulations system could create a regular and healthful environment for social community participating spiritual creating and sharing.

Originality/value

The paper proposes that the government should first make clear the basic objectives of the digital publishing policies and regulations system in China and then determine the content of the system. It has a positive significance to promote the establishment the system of policies and regulations in China and can ensure the sustainable development of digital publishing industry.

Abstract

Purpose

This paper aims to explore the dynamic context of the sharing economy in the transportation sector. This paper looks into the development of government regulations on the growing business of transportation network companies in Indonesia, the Philippines (represented as middle-income countries) and Taiwan (high-income country). How do government regulations and policies respond to the growing online-enabled transportation service (OETS) in Indonesia, the Philippines and Taiwan?

Design/methodology/approach

This study is qualitative-comparative research. Data on the transportation sector of each country have been gathered from reputable online sources.

Findings

Authors found evidence that the policy responses made by the Governments of Indonesia, Philippines and Taiwan to the sharing economy in the transportation sector are incremental and trial-error based policies.

Research limitations

This paper has not addressed the policy issues’ relationship between driver and platform companies.

Practical implications

The future of the relationship between sharing firms and local governments suggests that the focus should be on stronger consumer protections, deeper economic redistribution and achievement of other policy aims (Rauch and Schleicher, 2015).

Originality/value

This is a comparative study on different levels of economy, particularly between low- or middle-income and high-income country.

Abstract

This research explores the relevance of the Austrian tradition within the field of public policy studies. Policy studies is a research field about what governments can do. Austrian economics, conversely, mostly highlights the shortfalls of government intervention: as such overlapping seems limited. However, broadly speaking Austrian principles have indirectly influenced two aspects of policy studies: the conceptualization of the policy cycle as an imperfect process driven by actual individuals with limited knowledge and bounded rationality, and the creation of a regulatory framework that forces policy makers to reflect upon unintended consequences, by using evidence and data. This regulatory framework, assessed in this chapter by reading several regulatory guidelines through Austrian lenses, provides a new window of opportunities for Austrian economics to be relevant in the policy process. Austrian economist can be taking part in the regulatory process and also help select regulatory tools and institutional infrastructures that minimize the unintended consequences of government intervention, while contributing to the definition of social problems that enter the policy agenda from an individualistic perspective.

Abstract

Purpose

In recent years, with the gradual differentiation of economic and financial cycles, it has been increasingly difficult for monetary policies to remain balanced in stabilizing both economy and finance. Taking the period of 1999–2017 as a sample, the purpose of this paper is to find whether the synergy between the growth cycle and the price cycle is constantly improving in the economic cycle is more appropriate.

Design/methodology/approach

The key to stabilizing the economic cycle lies in the monetary policy and it should abandon the goal of boosting growth in a timely manner and turn into the goal of maintaining steady growth. At present, quantitative monetary policy is still more effective than price-oriented monetary policy in smoothing the economic cycle.

Findings

The impact of quantitative regulation on the financial cycle is more neutral, whereas price regulation will increase the volatility of price and financial cycles in the course of smoothing the growth cycle. In view of the continuous differentiation between the economic and financial cycles, it is realistic and reasonable to accelerate the establishment of a sound dual-pillar regulatory framework of “monetary policy and macro-prudential policy.”

Originality/value

The macro-prudential policy is specially used to smooth the financial cycle, so as to reduce the burden and increase the efficiency of the monetary policy on regulating economic cycle. Moreover, the transformation of monetary policy to price-oriented regulation must keep pace with the construction of the dual-pillar regulation framework and complement each other to prevent undesirable consequences in the financial sector. On the other hand, monetary policy still needs to rely on quantitative regulation in the future. The research in this paper also provides a new perspective for understanding the internal and external reform of China’s monetary policy in recent years.

Abstract

Purpose

Regulations to promote sanity in microfinance institutions and improve their operational problems yielded some results but lacked equal voice for effective implementation for its full realization. Much therefore has not changed in sub-Sahara African countries, though various types of regulation for microfinance exist. The nature and implementation of such policies therefore matter more than their mere presence. This paper aims to evaluate the nature of microfinance financial policies, given their social nature and the dynamism of their operational environment, and explores factors mitigating effective implementation of microfinance policy in Ghana.

Design/methodology/approach

A structured questionnaire was used to obtain data from the management and other officials of 63 microfinance institutions, and the outcome was organized into graphs and tables for descriptive analysis.

Findings

The results identified adequate adapted prudential regulation for microfinance institutions, but the formulation process lacked user input and adequate supervision, hindering effective sector policy implementation. The author therefore recommends a more inclusive and participatory policy formulation approach, creation of information platform for complete microfinance data through semi-autonomous supervisory body for microfinance services and regular full stakeholder engagement.

Research limitations/implications

Though the study is limited to tier-two microfinance institutions in Accra, it is evident that the results can be applied to the entire sector and across national borders because microfinance institutions exhibit similar or same characteristics.

Abstract

Purpose

To examine the determinants of smoking cessation and tobacco consumption in the European Union (EU) countries. Specifically, the paper seeks to examine the role of smoking risk perceptions and anti‐smoking regulation.

Design/methodology/approach

The paper utilizes multivariate analysis of an EU representative survey.

Findings

From all anti‐smoking policies examined, regulatory and information policies seem to show some influence on the cessation decision. Furthermore, once individuals decide to quit smoking they tend to perceive smoking risks differently.

Research limitations/implications

The main policies influencing smoking cessation in the EU are informational campaigns and regulation policies. However, tobacco price does not seem to influence smoking cessation such as advertising.

Practical implications

Regulation is largely associated with smoking cessation due to the role of social interactions of smoking and thus we might expect risk regulation policies to continue to impose constraints on the capacity of smokers to freely smoke.

Originality/value

The use of a common questionnaire for a sample representative of EU countries. The specific consideration of regulatory variables and risk perceptions.

Abstract

This paper provides a perspective on the field of nonmarket strategy. It does not attempt to survey the literature but instead focuses on the substantive content of research in the field. The paper discusses the origins of the field and the roles of nonmarket strategy. The political economy framework is used and contrasted with the current form of the resource-based theory. The paper argues that research should focus on the firm level and argues that the strategy of self-regulation can be useful in reducing the likelihood of challenges from private and public politics. The political economy perspective is illustrated using three examples: (1) public politics: Uber, (2) private politics: Rainforest Action Network and Citigroup, and (3) integrated strategy and private and public politics: The Fast Food Campaign. The paper concludes with a discussion of research issues in theory, empirics, and normative assessment.
