Abstract

This paper analyzes the relationship between the Chilean student movement and state force action during the period 2000–2012, placing specific attention on three waves of student contention that took place at the turn of the century. During the decade under study, the Chilean students became more contentious, they broadened their demands beyond specific grievances to encompass a critique to the education system as a whole, their alliance system grew (gaining from these denser networks of collaboration more resources to mobilize), and they managed to win public opinion on their side. However, the relationship with state forces has not been static across time, and both students and state forces have experienced changes in how they interact with each other. The results of this paper are based on a mixed method approach that drew on a quantitative database of student contention in Chile (n = 491 student events) and 15 in-depth interviews with leader activists from the most salient recent Chilean student movements of three periods under study, in addition to some key informants. The findings confirm that when student protests target the government, when they use disruptive strategies that affect the status-quo, and when they mobilize alongside other challenging actors, they are more likely to be met with direct repression by authorities. The research shows that there is a “dialect of repression” at play by which state forces' direct repression of protest can be two-fold: on the one hand, it gives students visibility in the public opinion, but on the other, it can be negative for ushering support if the media and authorities are successful in portraying them as violent or a threat to public order. In this sense, the figure of the “encapuchado,” students who disguise their identity and purposefully seek confrontation with authorities during mobilizations is problematized by the movement itself. How to win public opinion and use that visibility in their favor is related to decision-making mechanisms that the movement puts at play but also to the calculations done on the part of the government and security forces about the leverage of the movement.

Abstract

Purpose – This is a comparison of the role of the police in the enforcement of immigration law in the interiors of three nations: Germany, the United Kingdom, and the United States.

Methodology – The study builds upon research the authors have already done as well as desk research on recent developments. It uses three dimensions of the problem to focus the report: the hardware, software, and culture of police involvement in this issue.

Findings – In Germany, the local police are responsible for the enforcement of immigration control and have relatively fast and reliable means to identify undocumented immigrants. This is not the case in the United Kingdom and the United States, but there are trends toward more local police involvement, both by institutional cooperation and by the development of better databases and documents for faster identification. These trends are highly controversial in an environment that values community relations and is highly sensitive to racial profiling. However, there are also indications that the differences in typical police work such as traffic controls and crime investigation may not be as pronounced as the differences between the countries would suggest.

Research implications – This study highlights the need for ethnographic work with the police and with unauthorized immigrants to empirically describe and assess the role that the police are playing and its impact on police–community relations.

Practical implications – The German experience supports the value of a comprehensive information system for rapidly determining the immigration status of suspects, but it may not work as expected in the United States and the United Kingdom, where registration and identification obligations apply to foreign citizens only. With the US and UK experiences, one could predict that discriminating identification practices may become more sensitive issues in a Germany with increasing numbers of immigrated citizens.

Abstract

This chapter reviews the new inspectorate, Her Majesty's Inspectorate of Constabulary and Fire & Rescue Services, and the new Inspection Framework for Fire and Rescue Services in England. It will look at the antecedents of the inspectorate and the history of inspections in both the police and in the fire and rescue services. Prior to the Policing and Crime Act 2017, Fire and Rescue Services in England were without a dedicated independent inspectorate for almost 10 years and the government promised a new independent and a rigorous inspection regime. This chapter critically evaluates the government's response and the early development of the new regime.

Abstract

Doxing refers to the intentional public release by a third party of personal data without consent, often with the intent to humiliate, intimidate, harass, or punish the individual concerned. Intuitively, it is tempting to condemn doxing as a crude form of cyber violence that weaponizes personal data. When it is used as a strategy of resistance by the powerless to hold the powerful accountable, however, a more nuanced understanding is called for. This chapter focuses on the doxing phenomenon in Hong Kong, where doxing incidents against police officers and their family members have skyrocketed since 2019 (a 75-fold increase over 2018). It contends that doxing for political purposes is closely related to digital vigilantism, signifying a loss of confidence in the ruling authority and a yearning for an alternative form of justice. The chapter therefore argues that public interest should be recognized as a legal defense in doxing cases when those discharging or entrusted with public duty are the targets. Equally, it is important to confine the categories of personal data disclosed to information necessary to reveal the alleged wrongdoer or wrongdoing. Only in this way can a fair balance be struck between privacy, freedom of expression, and public interest.

Abstract

Against the grain of the paradigmatic postcolonial analytics of the colonial state, this chapter presents a non-dichotomous comparison of two regimes within the late 18th century Danish empire, which are commonly presumed to be of essentially different kinds – namely the colonial state in Tranquebar in South East India and the metropolitan government of rural Danish society. By focusing, firstly, on practices of policing and, secondly, on the general technology of power that targeted these significantly different socio-political spheres, it is argued that these regimes were governing according to similar strategies: seeking, on one hand, to deploy societal mechanisms of self-regulation and, on the other, to provide a balance and order to the otherwise chaotic forces of the population. On the basis of a Foucauldian vocabulary of government, it is thereby argued that colonialism, at this time and place, had not yet clearly constituted itself as a particular form of rule.

Abstract

Purpose – Police violence involving minority citizens is a significant problem in the United States. Efforts to explain the disparate treatment of minorities have often relied on structural-level racial threat hypotheses. However, research framed by this macro-level approach fails to consider meso-level characteristics of spatially specified places within cities. The place hypothesis maintains that police see disadvantaged minority neighborhoods as especially threatening and, therefore, use more violence in them. Reconceptualizing the racial threat model to include meso-level characteristics of place is essential to better explain police violence.

Design/methodology/approach – The argument is investigated using literature drawn from quantitative analyses of structural predictors of police violence and qualitative/quantitative studies of the police subculture and police behavior within disadvantaged neighborhoods.

Findings – Research on the effects of city-level racial segregation on police violence supports the place hypothesis that the incidence of police violence is higher in segregated minority neighborhoods. City-level segregation is, however, only a proxy for the degree of concentrated minority disadvantage existing at the meso-level. Community-level studies suggest that the police do see disadvantaged places as especially threatening and use more violence in them. Plausibly, meso-level neighborhood characteristics of cities may prove to be better predictors of the incidence of police violence than are structural-level characteristics in cross-city comparisons.

Originality/value – This analysis builds on structural-level racial threat theories by demonstrating that meso-level characteristics of cities are central to explaining disparities in the use of police violence. A multilevel approach to studying police violence using this analytic framework is proposed.

Abstract

The study of policing in Anglo-American societies has been severely restricted in the last 20 years to quasi-historical overviews, studies of policing in times of stable, non-crisis periods in democratic societies that in turn had survived the crisis as democracies. Perhaps the epitome of this is the sterile textbook treatment of policing in Canada and the United States – a sterile rubble of functions, duties, training surrounded by clichés about community policing. Scholarly writing on democratic policing and its features is severely limited by lack of inclusiveness of the range of contingencies police face, and many respects this work is non-historical and non-comparative. In the present world of conflict and strife that spreads beyond borders and challenges forces of order at every level, the role of police in democratic societies requires more systematic examination. In my view, this cannot be achieved via a description of trends, a scrutiny of definitions and concepts, or citation of the research literature. Unfortunately, this literature makes a key assumption concerning police powers in democratic societies: that the police are restricted by tradition, tacit conventions, and doctrinal limits rooted in the law or countervailing forces within the society. While these constraints are sometimes summarized as a function of “the rule of law,” this assumption is much deeper and more pervasive than belief in the rule of law. It is possible to have a non-democratic police system that conforms to the rule of law and reflects the political sentiments of the governed. It is also possible to have non-democratic policing emerge from a quasi-democratic system as I show in reference to the transformation of the police in the Weimar Republic to the police system of the Third Reich. The complex relationship between policing and a democratic polity remains to be explored.

Abstract

In Seattle and other cities, recent expansions of trespass law make the regulation of public space easier and more extensive. A range of new tools allow police officials to clear spaces of those deemed undesirable; they define zones of exclusion and increase the police's power to make arrests. The use of these tools extends contemporary practices of using criminal law to address instances of urban “disorder.” We draw on data from Seattle to catalog some of these new tools, the capabilities they create, and the implications they generate. One important such implication is that they work to push undesirables so far to the margins – spatially, socially, politically, legally – as to render them far outside the body politic. The use of these techniques thus raises important questions about the advisability of addressing social problems by increasing the power of the criminal law.

Abstract

Purpose

This chapter examines how citizen journalism affects perceptions of legitimacy among local residents and police officers.

Methodology/approach

Qualitative data were collected through semi-structured in-depth interviews with residents and police officers.

Findings

Local residents are mostly willing to obey police commands, but a lack of trust in the police and fear of retaliation hinder willingness to cooperate with the police. Citizens’ willingness to follow police orders is mostly a way for them to end the encounter as quickly as possible so the contact will not extend for a prolonged period of time and cause even more serious consequences. Citizens have recorded the police in the past when they witnessed officers not following proper procedures. The police view citizens recording them as a form of defiance and while this makes policing challenging, police officers interviewed still hold high levels of self-legitimacy, most likely due to their organizational and occupational culture. Recording the police has emerged as a way for citizens to challenge police authority and legitimacy during encounters.

Originality/value

While recording the police has increased with recent technological advances, little empirical research has examined its impact on policing and police-community relations. This study connects three critical issues in policing – technology, citizen journalism, and police legitimacy – by assessing the impact of recording the police on police legitimacy in the eyes of the public and police officers. Not only does this study fill our gap in knowledge on citizens recording the police, but it also furnishes valuable implications for policy and future study.

Abstract

The vast majority of contemporary social scientists have distanced themselves from moral reflection and the academic disciplines that engage in it. Throughout his long career Philip Selznick took a different path, engaging deeply with the moral content of the concepts he employed. This paper argues that he had good reasons to do so. Value neutrality in social research can fatally sever inquiry’s connection to the practical concerns that originally motivated it, and it can distort our understanding of those concerns by recasting them in a scientific mold. To make this case I draw from a long tradition of philosophical thought about the relationship between facts and values, and I illustrate it by examining the limitations of recent social science research about procedural justice in organizations and the order maintenance function of the police.
