Abstract

Purpose

The purpose of this paper is to help people understand innovation and related policies in China over the past 25 years by using and analyzing patent data retrieved from State Intellectual Property Office (SIPO) of the People's Republic of China, at: http://www.sipo.gov. cn/sipo2008/tjxx/. Innovation in China attracts attention all over the world. The patent is considered as the fountain of innovation and is widely applied to measure innovation of a country or a region.

Design/methodology/approach

This study analyzed the trends of both patent filings and patent grants/registrations during 1985‐2009 and explored the ratio change between them by using data statistical method. Based on the statistically analysis, patent law and related policies were further analyzed. The paper also gives some suggestions on Chinese innovation policy.

Findings

The paper drew the following conclusions: both total patent filings and total patent grants/registration in SIPO appear to have an increase of exponential trends, especially during the years of 2005‐2009; patent filings and patent grants/registration in SIPO also appear to have an increase of exponential trends, but the gap between patent filings and patent grants/registration seems to be widening in recent years; the two revisions of Chinese patent law in the years 1992 and 2000 have had some positive impacts on patent filings and patent grants/registration to some degree; the ratios of patent filings to total patent filings and patent grants/registration to total patent grants/registration in SIPO during the years of 1985‐2009 are comparatively lower by 31.60 percent and 16.37 percent; and Japan and USA are the two leading countries in terms of non‐resident patent grants/registration in SIPO.

Research limitations/implications

This study is still macroscopic, more detailed analysis should be done in future studies.

Practical implications

This study takes an overall view of innovation in China in the past 25 years by analyzing patent data and related law and policies. It proposes related institutions perfection, which will enhance innovation development in China.

Originality/value

Research on innovation in China via patentometrics has not been found thus far using all patent data during the period of 1985‐2009 in SIPO.

This chapter provides an overview of the five main modes of intellectual property (IP) protection – patents, copyrights, trademarks, trade secrets, and designs – available in the United States, the European Union, and Japan. After describing the purposes of and principal differences among the five types of IP protection and outlining the advantages of each form, the chapter provides country- and region-specific information. The authors highlight the aspects of IP law in which international harmonization has, or has not yet, occurred, and offer insights into the relative advantages of various national and regional IP protection systems.

Abstract

Purpose

This research aims to examine a number of legal sources for evidence that US marketers were interested in protecting their brand identities in the 1800s.

Design/methodology/approach

The research examines historical legal records including registrations for commercial prints and labels, design patents and trademarks as well as other legal records. The work discusses the evolution of the concept of brand identity by examining various legal methods that were used to try to protect brand identity from imitation.

Findings

The research suggests that marketer interest in the development and protection of brand identity preceded the US Civil War and confirms that this interest was led by marketers of patent medicines, tobacco and liquor. However, the study also demonstrates strong interest by marketers of many other types of products from disposable products to durable manufactured items.

Research limitations/implications

Many original records were lost in the 1836 Patent Office fire or have been simply lost. Some of the databases examined are too large to be comprehensively examined.

Originality/value

The examination of legal records from this period of uncertainty shows how the practice of brand identification led to the concept of brand identity: the legal data examined offer a wealth of information for marketing historians.

Abstract

Purpose

The purpose of this paper is to expose the impact of innovation and patent registration, as a strategy that contributes to business success in the current competitive and globalized market conditions.

Design/methodology/approach

This paper presents a study on the innovation and contribution of the patent registry in the growth of economic sales of 1,746 companies in the Colombian manufacturing sector, whose applied methodology was a statistical correlation analysis and a binary logistic regression.

Findings

The results reveal a positive relationship among incremental product innovations with the achievement of sales success, although it is evident that patent registration negatively influences business success as a factor in innovation.

Originality/value

This study allows organizations to understand the importance of developing innovation processes and patent registration as a competitive factor that drives sales growth and success.

Purpose

Researchers have pointed out that product packaging in the food industry has a significant influence on consumer decision-making. However, the impact of package development on firm performance has not been investigated due to the limited availability of analyses on package design. The purpose of this study is to investigate the relationship between package development and firm performance in the Japanese food manufacturing industry.

Design/methodology/approach

This study empirically analyzed the relationship between package development and firm performance in the Japanese food manufacturing industry by using design patents data.

Findings

As a result of multiple regression analysis, it became clear that the number of design patents related to packaging is significantly linked to the operating profit ratio, growth rate of sales and increase in operating profits of firms. Moreover, the results show inverse U-shaped effects between design patents and firm performance.

Research limitations/implications

The results imply the importance of effective package design management.

Originality/value

This study provides novel insight on both marketing strategy and intellectual property management in the food industry, and it also provides a new method for empirical analysis using design patent data.

Abstract

Purpose

The purpose of this paper is to examine how important technology transfer offices (TTOs) – which in Portuguese are called “industrial property support offices” or GAPIs – are in terms of fostering patent applications and technology transfer in countries characterized by low performance records in these activities.

Design/methodology/approach

Among the existing 23 Portuguese GAPIs, only eight agreed to provide answers to a semi-structured questionnaire survey. Content analysis was performed on the data collected using NVivo software.

Findings

The results show that GAPIs play an important role in the innovation life-cycle, speeding up the transfer of knowledge and technology to society. The regulation of intellectual property (IP) ownership and royalty sharing with inventors was identified as a major result, strengthening entrepreneurial universities’ role. In addition, after the GAPIs were created, networks were formed that facilitate the sharing of knowledge and experience and promote the development of further collaborative partnerships.

Practical implications

This study’s results offer new insights into how GAPIs contribute to socio-economic growth by fostering more entrepreneurial universities and increasing the transfer of technology to society. In addition, these offices promote the creation of networks between GAPIs, enabling them to leverage universities’ potential for participation in socio-economic development.

Originality/value

No previous research has focused on GAPIs/TTOs’ point of view regarding policies that enhance IP and technology/knowledge transfer.

Abstract

Purpose

This study aims to find technologically important patent identification methods and indicators early and efficiently to grasp the technical qualitative level of patents, which are output indicators of research and development (R&D) results.

Design/methodology/approach

This paper reports on two methods for distinguishing important patents and the indicators obtained from those methods. One of the discrimination methods is Heckman's two-step estimation procedure. The second method is to find the centrality of each patent by network analysis of the citation relationship between publications and to find the importance from the magnitude of the centrality value.

Findings

In Heckman's analysis, the number of citations within three years after publication and the applicant's right acquisition/maintenance motivation index had positive effects on patent importance. The discriminative indicators of important patents by network analysis were degree centrality, mediation centrality, proximity centrality and transit values in the aggregated subnetworks. These two analytical methods are in a relationship that can complement each other's shortcomings. To efficiently evaluate the qualitative importance of patents, it is recommended to use these two methods together.

Research limitations/implications

The indicators of important technical patents might change depending on the technical field. Future studies can apply this research to multiple technical fields to improve robustness and to construct an algorithm that can efficiently evaluate the quality of patents.

Practical implications

This study's results can be useful for grasping the patent position of the company or competitors numerically and for quantitatively evaluating the quality of R&D activities. Furthermore, it is possible to streamline the routine for an exploratory search of a huge number of patents. For example, it could be useful for detecting changes in the paradigm of specific technical knowledge, evolving the genealogy of technical knowledge and creating patent maps for new R&D. These methods greatly increase the effectiveness of technical knowledge information, which is the basis of R&D. In addition, the results of this study can help in evaluating patented assets.

Social implications

This study confirmed the development process of technical knowledge. It is a fact that sharing, sympathy and mutual trust for technical issues and technical values are created among professional engineers and researchers inside and outside the organization, and their preferences and interactions develop and expand technical knowledge. Understanding the process of development and the evolution of this technical knowledge gives hints, such as expanding the discretionary power of engineers and researchers regarding corporate secrets, or reviewing the balance between control and independence, to solve Japanese management problems, which are often closed and monetized in R&D activities.

Originality/value

This study presents a scoring of the technical significance of patents by combining the two analytical methods. In addition, there are proposals as a method for detecting changes in the genealogy and paradigm of technical knowledge. As an analysis method, it is a new proposal that has never existed before.

Abstract

Purpose

In today’s economy, intangibles have become more important than physical assets for firm success. In particular, small and medium enterprises (SMEs) registered an increasing trend in patenting, exceeding large firms in the number of patent registrations. In this context, the purpose of this paper is to investigate the association between patents and SME sales performance, taking into consideration also patent quality.

Design/methodology/approach

The approach uses panel regression model to investigate the relationship between patenting and sales, controlling for firm size and firm age. The authors adopt a purposive sampling technique focusing on a sample of Italian SMEs in the mechanical industry.

Findings

The results show that the count of patents do not have any effect on sales performance, while the number of jurisdictions where the protection is extended produces a positive and significant result.

Practical implications

The main implication for SME entrepreneurs and managers is that relying on a large number of patents does not automatically lead to higher performance; instead, filing those patents which protect particularly valuable innovations could be more productive in terms of SME sales performance Moreover, the results suggest that a longer time lag between patent filing and SME sales performance might be possible.

Originality/value

This paper is one of first attempts to shed light on the issue regarding SMEs patent quality. It is notable that the quality of patents in terms of geographical scope is positively associated to SME sales performance.
