Abstract

Purpose

Many European-level networks and regulatory constellations in different sectors (e.g., energy, telecommunications) without clear anchorage into the European Union (EU) institutional landscape have been subject to increasing efforts by the EU institutions to tie them closer to the EU. They are serving increasingly as platforms for preparing EU policy or for implementing EU decisions, which may result in closer institutional bonds with the EU. This chapter aims at examining the differences and similarities between the process towards more EU-integration in two different domains (i.e., telecommunications and patents) and regulatory constellations (i.e., supranational and intergovernmental).

Methodology/approach

The chapter analyzes the evolution in the European telecommunication sector and the European Patent System and juxtaposes this analysis with the literature on institutionalization, Europeanization of regulatory network-organizations, and multilevel governance (MLG). It focuses on the role of the European Commission and the interaction with the national regulatory agencies (NRAs) and networks within the institutional framework.

Findings

Irrespective of the particular regime (intergovernmental/supranational) in a certain domain or sector, a common trend of closer coordination and integration prompted by the Commission is taking place, which triggers a certain resistance by the national bodies regulating that domain. As long as a specific competence is considered instrumental in the creation of the single market, the Commission has strong incentives to strengthen its influence in this field, even if those competences have been regulated through an independent intergovernmental regime.

Research implications

The dynamic described in this chapter allows us to reflect upon the MLG conception as developed by Marks and Hooghe (2004), which distinguish between two types of MLG. Type I MLG refers to different levels of governments, more specifically to the spread of power along different governmental levels and the interactions between them. Type II MLG refers to jurisdictions that are both task-specific and based on membership that can intersect with each other. They respond to particular problems in specific policy fields (Marks & Hooghe, 2004). Our analysis shows that the increase in coordination and integration are the outcome of both MLG Type II processes (coordination between two issue-specific bodies) and of MLG Type I processes (tensions between two governmental levels). Furthermore, the negotiation dynamics regarding this increased coordination and integration reveal that the tensions typical of MLG Type I took place as a consequence of the increased coordination between Type II bodies. Put differently, multi-level coordination and integration mechanisms in the EU can be seen as both Type I and Type II processes. They combine features of both categories and reveal that their Type I and Type II features are interdependent.

Practical implications

The analysis in this chapter shows a need for further strengthening the MLG Type I and II conceptual framework by balancing the analytical distinction between the two types with developments about how Type I and Type II are often entangled and intertwined with each other rather than separated realities.

Social implications

The chapter describes and compares the dynamics in the European telecommunications sector and the European patent system with interesting observations for NRAs and the European Commission with respect to coordination and integration.

Originality/value

The original nature of the current chapter relates to the two selected areas and the addition to the literature on MLG.

First, with respect to the areas investigated the dynamics of the European telecommunications sector have been analyzed also by other authors, but the European patent system is an area which is relatively unexplored in terms of governance research. The combination of the two sectors with a detailed analysis of similarities and differences is highly original and generates interesting lessons with respect to coordination and integration in supranational and intergovernmental regimes.

Second, Marks and Hooghe (2004) distinguish between the two types of MLG as if they are two different constructs that are not related to each other. Our cases and argument cover both types of MLG and show the interconnection between the dynamics taking place in the two types of MLG.

Abstract

Purpose

This chapter provides an overview of the findings and chapters of a thematic volume in the International Perspectives on Education and Society (IPES) series. It describes the common dataset and methods used by an international research team.

Design/methodology/approach

The chapter synthesizes the results of a series of country-level case studies and cross-national and regional comparisons on the growth of scientific research from 1900 until 2011. Additionally, the chapter provides a quantitative analysis of global trends in scientific, peer-reviewed publishing over the same period.

Findings

The introduction identifies common themes that emerged across the case studies examined in-depth during the multi-year research project Science Productivity, Higher Education, Research and Development and the Knowledge Society (SPHERE). First, universities have long been and are increasingly the primary organizations in science production around the globe. Second, the chapters describe in-country and cross-country patterns of competition and collaboration in scientific publications. Third, the chapters describe the national policy environments and institutionalized organizational forms that foster scientific research.

Originality/value

The introduction reviews selected findings and limitations of previous bibliometric studies and explains that the chapters in the volume address these limitations by applying neo-institutional theoretical frameworks to analyze bibliometric data over an extensive period.

Abstract

Social network theory and analytic tools have been increasingly used to examine the interaction between science and technology. Recently, researchers have paid attention to the role of publishing inventors, that is, individuals bridging the collaborative networks between authors (co-authorship network) and inventors (co-invention network). Building on this research, we study how publishing inventors’ structural position in the joint co-authorship and co-invention network affects the quality of the inventions to which they contribute. Specifically, we identify publishing inventors who play a pivotal role in holding the two networks together: their removal not only increases the network fragmentation but also disconnects the joint co-authorship and co-invention network. We define these publishing inventors as cutpoints and find them to contribute to inventions of greater quality. We situate the analysis within the context of the emerging field of nanotechnology. The theoretical and managerial implications of the results are discussed.

Abstract

This study explores the thematic relationships within the field of sustainability of agri-food chains oriented toward Industry 4.0, focusing on the analysis of scientific production, through research articles and technological output according to patents worldwide. Agri-food Industry 4.0 is an expanding interdisciplinary field in which science and technology interactions are increasingly intensifying with a strong link to sustainable development.

This study has used high impact indexed publications (Web of science) and patents as proxy indicators of innovation, which are transformed into two sets of data, reflecting the scientific and technical backgrounds, respectively. On the one hand, both quantitative and qualitative analysis methodologies were used to examine the scientific papers through descriptive analysis, focused on collaborations networks by authors, institutions, and countries, as well as a content analysis of keywords. On the other hand, the analysis of technical background on patent families shows the temporal evolution of technologies with future challenging trends, text mining, main applicants, and geographical examination.

The results show that in the field of sustainability in agri-food chains oriented to Industry 4.0, most research is in the agricultural field in scientific articles, with high impact in climate-smart agriculture. Patent analysis reveals a marked increase in the patenting rate from 2012 and 2013, coinciding with the start of scientific production in this field of knowledge. In spite of the fact that China is the leader country in this technological field, India shows a significant change. Moreover, India is a country that is currently showing significant progress, both in the field of scientific production and in its categorization as an innovative country due to its growth in patent filings.

Abstract

In the network strategy view, relative competitive advantage stems not merely from opportunity structures embedded in networks but also from the distribution of ability and motivation among firms. Thus, there is a need to “bring the firm back in” to the network strategy narrative. We demonstrate that a mixed-methods design, blending large-sample data with micro-data on specific firms and their networks, can increase our understanding of the interplay of network structure and actor mechanisms, thus bridging the chasm between theory and practice in network strategy. We believe this is a critical step toward the “strategic design of networks.”

Studies have shown that actors who affiliate with multiple categories generally do so at their own peril. Still, category spanning is routinely observed, although it is less understood. We address this gap by a longitudinal study of category spanning among nanotube technology inventors. Our results highlight the importance of the evolving structure of category relationships, actor embeddedness within the structure, and interactions with other factors, including the attractiveness of related categories. When a category is relationally similar to others, associated inventors are more likely to engage in category spanning, whereas when a category is dissimilar, inventors are more likely to remain within it.

Abstract

An emerging stream of literature has observed that project-based organizations rely increasingly on a network of collaborations originating from the ongoing process of creating and dissolving relationships that bring new project opportunities. Project-based networks are widespread in knowledge-intensive and creative industries, such as life-science and biotechnology, nanotechnology, and software, film, and music industry. This chapter examines the structural characteristics of project-based network-ties in German biotech. We focus on the consequences of local versus international network ties for the innovative success of German biotechnology firms. The findings of our longitudinal event history analysis indicate that the most valuable learning drivers are international research alliances and centrality within the international research network. Surprisingly, we do not find any local effects: neither the density of a local research cluster, nor its diversity or age is of significance. Our results shed new light on the relevance of international linkages for firms that are engaged in project-based learning networks.

Abstract

Israel, characterized by various knowledge-intensive entrepreneurial firms, provides an interesting case study for examining sector-based differences and “small country” regional patterns. This chapter has a dual goal of exploring sector and regional differences of knowledge-intensive firms in Israel. The first goal is to depict similarities and differences between firms in three knowledge-intensive sectors: Life Sciences, information technology, and Cleantech. The second goal questions whether the geographical distribution of these firms across regions is associated with different levels of knowledge concentration and organizational homogeneity. Regional and sector-based differences were measured by firm-level network structures, funding patterns, and innovation proxies. One way analysis of variance tests were conducted for attaining these research goals. The main findings show that while most regions exhibit similar patterns of firm and network characteristics, many differences exist on the sector level that are associated with sector-specific attributes. These findings support the notion of a “small country inter-regional homogeneity effect.”

Abstract

The benefits of network relations for firms’ competitive advantage are increasingly acknowledged in the strategic management literature. Yet, the cost implications of engaging in network-specific relations, stemming from the irreversibility of sunk costs invested in creating network relations, are largely ignored. Such costs tend to be especially pronounced in high technology firms. It follows that the costs of creating network relations may mask the benefits of such relations, suggesting that networks can be a competitive risk for firms in cases where network relations unexpectedly terminate. This chapter adopts a cost-benefit approach to an empirical analysis showing that while in the long term, network relations enhance high technology firms’ performance, short-term efforts in creating network relations may hamper their performance. Furthermore, we show that greater technological intensity intensifies the negative performance implications of short term network participation and the positive performance implications of long term network participation.

This paper focuses on two related questions at the intersection of antitrust and intellectual property law. First, under what circumstances must the holder of a patent or a copyright or the owner of a trade secret allow others to use that intellectual property? Second, under what circumstances can the holder of an intellectual property right use that right to make it difficult for another party to succeed in a related market? These questions have vexed antitrust and intellectual property scholars alike ever since the Federal Circuit ruled in 2000 that patent holders “may enforce the statutory right to exclude others from making, using, or selling the claimed invention free from liability under the antitrust laws,” a ruling that directly contradicted the Ninth Circuit ruling that antitrust liability could be imposed for almost identical conduct, depending on the motivations of the patent holder. The various proceedings in United States v. Microsoft only added fuel to the firestorm of controversy.After briefly retracing the jurisprudential path to see how this situation arose, we propose a solution that primarily involves a variation on the real property concept of adverse possession for the intellectual property space along with a slight extension of the Essential Facilities Doctrine for industries that exhibit network effects. We examine, both for firms with and without market power, how our proposal would resolve the situations presented by large fixed asset purchases, the introduction of entirely new products, and operating systems with network effects. We also demonstrate how our proposal could be applied in the European antitrust enforcement context.
