Abstract

A distinction must be drawn between a dismissal on the one hand, and on the other a repudiation of a contract of employment as a result of a breach of a fundamental term of that contract. When such a repudiation has been accepted by the innocent party then a termination of employment takes place. Such termination does not constitute dismissal (see London v. James Laidlaw & Sons Ltd (1974) IRLR 136 and Gannon v. J. C. Firth (1976) IRLR 415 EAT).

Abstract

Purpose

The purpose of this paper is to describe how ordered pairs representing related objects in static state are used to create hierarchical structures yielding rapidly increasing choices of complex objects to be selected by objects in their environment and how “purposive systems” evolve for the production of such structures.

Design/methodology/approach

Basic notions transcending discipline boundaries and natural language formalised into one‐ and two‐place sentences are suggested as related constituents of complexity and hierarchy, the “systemic view”. This leads into sets of ordered pairs and sequences of qualified predicate logic statements forming dynamics of systems.

Findings

Hierarchies in general can be expressed as ordered pairs. An analytical method for showing how ordered pairs are organised into progressively more complex structures of objects and “products” with increased chances of being selected by environmental objects in evolution or design. Correspondingly, groups of purposive systems operating according to algorithms are needed for the production of products or their evolution is left to chance.

Research limitations/implications

The approach uses natural language as the primary model transformed into a formal language for reasoning about outcomes of scenarios with inanimate and animate components with predominantly qualitative properties, emotions and will. The desirability of such an approach, although it matches the generality of the systemic view, needs to be debated.

Practical implications

Once past the test of acceptability and software development, the approach can be used as part of “design methodology” for the design of “systems and products” in the context of human activity and technical scenarios.

Originality/value

The formal language exhibits properties, relations and interactions or impressions of objects of great diversity and variety. It exhibits the effects of these constituents on the production of outcomes based on semantic and mathematical relationships; it is widely applicable and may facilitate the appreciation of how “related objects evolve”.

Abstract

Purpose

The purpose of this paper is to analyze the order relation of existing in computer science, define and analyze macroscopical‐order and semi‐partial order in pansystems theory, and explored the relationship between macroscopical‐order and semi‐partial order. It is an attempt to analyze problems in computer science by using pansystem's philosophy with mathematics and technology (PMT)‐combination.

Design/methodology/approach

Sorting is an important operation in computer science. The main task of the sorting operation is to rearrange the random serial of records into an ordered serial of records according to some keywords. The authors know that there are many sorting methods in computer science. The authors discussed the essence of semi‐partial order and macroscopical‐order and the transformation between semi‐partial order and macroscopical‐order from the point of panscale's view; the essence of this transformation is revealed. By combining the PMT (PMT‐combination), it is easy for the authors to get a deep understanding of the technology in computer science.

Findings

The need for application of the order relation, the authors explored the relationship between macroscopical‐order and semi‐partial order. Combined with PanScale, the authors analyzed the essence of the transformation between macroscopical‐order and semi‐partial order. And applied it to the computer science.

Research limitations/implications

The order relation is an important problem in computer science, as well as existing in our daily life, at the same time this problem has a scale concept in it, the authors need to further research and study.

Practical implications

A very useful method for research of the order relation in computer science.

Originality/value

To explore the relationship between macroscopical‐order and semi‐partial order. Combined with PanScale, the authors analyzed the essence of the transformation between macroscopical‐order and semi‐partial order. And applied macroscopical‐order and semi‐partial order to the computer science.

Abstract

This discussion treats relational analysis as an alternative to the ‘categorical’ view of syntactic structures in indexing. It is suggested that the relational characterization of syntactic structures by reference to the meaning of the spaces between constituent terms may point the way to classification structures which are stable to new knowledge and discipline‐independent. Conversely the meaning‐protecting role of disciplinary domains has in the past relegated relational ideas to a peripheral significance in classification structures. General properties of syntactic strings, logical articulation, disarticulation, and linearization of branching relationships are discussed, together with the role of relational symbolism as noise in significant‐word based searches. Attention is next given to certain derivative relations which arise out of an inclusion relation between an isolated concept and the relation‐linked combination of which it forms a part. One class of these derivative relations is an explicit syntactic relation and its affiliation to other syntactic relations may throw light on the little understood nature and development of the content of personality facets.

Abstract

This paper attempts to critically question present IPE approaches and analyses that aim at assessing China’s role within the international political economy. Thus, unlike common theorizations that see the country as being integrated within US hegemony (Panitch and Gindin) or those accounts that claim that we are already witnessing the “terminal crisis” of US hegemony accompanied by a hegemonic transition toward China (Arrighi), the paper will argue that China was able to gain “relative geopolitical autonomy” as a result of the revolutionary processes it went through and eventually assert itself as a contender state, now just in the process of challenging US hegemony. Dissatisfied with existent theorizations of hegemony, I will be drawing on the critical edition of Gramsci’s Quaderni and attempt to offer a new perspective regarding the conceptualization thereof. Thus applying the elaborated framework of analysis to the current situation, I argue that unlike the US’s ability to counter the challenge of its traditional imperial rivals Germany and Japan as they developed under the grip of US hegemony, the country is facing difficulties in countering China’s ascent. However, while maintaining that China does indeed represent a challenge to US hegemony, particularly in East Asia, I will argue that the idea of a “crisis of US hegemony” is premature as China remains distant from fully realizing hegemonic relations, even at the regional level.

Abstract

Purpose

The object of this research is the reconstruction of the existing legal response by European Union states to the phenomenon of immigration. It seeks to analyse the process of conferral of protection.

Design/methodology/approach

One main dimension is selected and discussed: the case law of the national courts. The study focuses on the legal status of immigrants resulting from the intervention of these national courts.

Findings

The research shows that although the courts have conferred an increasing protection on immigrants, this has not challenged the fundamental principle of the sovereignty of the states to decide, according to their discretionary prerogatives, which immigrants are allowed to enter and stay in their territories. Notwithstanding the differences in the general constitutional and legal structures, the research also shows that the courts of the three countries considered – France, Germany and Spain – have progressively moved towards converging solutions in protecting immigrants.

Originality/value

The research contributes to a better understanding of the different legal orders analysed.

Abstract

This paper presents a new solution for conceptually modeling the training‐domain knowledge of intelligent computerassisted instructional (ICAI) systems. Various cognitive demands from learners impose various modalities of presenting and structuring the knowledge to be taught. This paper is presenting a theoretical framework allowing to develop coherent, flexible models for the training‐domain knowledge of an ICAI system. A case study and an authoring‐system are also presented, in order to describe the main features of the modeling methods. This new approach in ICAI systems’ domain‐knowledge structuring and representation can offer a solution to the problem of adapting the instructional system interaction to users with different learning styles and needs.
