Abstract

Purpose

To analyze the impact of recent legislation that amended the Securities Exchange Act of 1934 to expressly empower the U.S. Securities and Exchange Commission (SEC) to seek disgorgement in federal district court proceedings and to codify applicable statutes of limitations.

Design/methodology/approach

This article provides an overview of the authors’ prior work analyzing courts’ treatment of SEC disgorgement and summarizes how the scope of the remedy has evolved since Kokesh v. SEC (2017). Then, the article analyzes the changes to the Securities Exchange Act of 1934 contained in Section 6501 the 2021 National Defense Authorization Act (NDAA), which statutorily empowered the SEC to seek and obtain disgorgement in federal court actions. Finally, the authors discuss the impact of the legislation on the Supreme Court’s decisions in Kokesh and Liu v. SEC (2020).

Findings

The availability and appropriateness of SEC disgorgement have been the subject of vigorous debate. Just as courts began to iron out the contours of SEC disgorgement in the wake of Kokesh and Liu, Congress intervened by granting to the SEC explicit statutory authority to seek a remedy traditionally obtained at equity. In passing this legislation, Congress answered some questions that remained after Liu but also raised many new ones. These new questions will likely take years to resolve through subsequent litigation and potentially additional legislation.

Originality/value

Original, practical analysis and guidance from experienced lawyers in financial services regulatory and enforcement practices, many of whom have previously worked in the SEC’s Division of Enforcement.

Abstract

Purpose

The purpose of this paper is twofold. First, it investigates the relationship between television, its audiences and Twitter around the creation of social TV events. Here it contributes to knowledge by charting usage in relation to different types of programmes and by comparing Twitter to Facebook data. Second, it evaluates the way in which student-led research can be used to conduct audience studies with the help of Twitter.

Design/methodology/approach

The research applies a quantitative approach, measuring the volume of Twitter messages before, during and after two different types of television programmes, i.e. Reality TV (The X Factor and The Only Way is Essex) and sports broadcasts (football and Formula One). Brief comparisons are also drawn with data collected from Facebook. The pedagogical evaluation of the research is based on self-reflection by the author/tutor.

Findings

The research established similar trends and patterns of viewer engagement for both types of television programming, with key activity during and towards the end of a broadcast which points to viewers using Twitter, or Facebook, while watching the event. The findings are compared to previous studies on television programmes and Twitter use. The study also identified that student research using Twitter can lead to a valuable learning experience as it allows students to use their own knowledge of social media to inform the research process.

Originality/value

This research makes a contribution to the small yet growing body of studies examining Twitter activity in relation to TV events. It also contributes to knowledge on the educational use of social media by providing an account of how Twitter can be applied as a research tool by students.

Abstract

Purpose

This study empirically tests the impact of the Dark Triad personality traits (narcissism, Machiavellianism, psychopathy) and co-worker competitiveness on knowledge sabotage.

Design/methodology/approach

A model was constructed and tested by means of Partial Least Squares with data from 150 participants recruited via Amazon’s Mechanical Turk.

Findings

The individual personality traits of narcissism, Machiavellianism, and psychopathy are significant predictors of individual knowledge sabotage behavior, whereas co-worker Machiavellianism and psychopathy trigger co-worker knowledge sabotage. Out of the three Dark Triad traits, individual and co-worker psychopathy emerged as the strongest knowledge sabotage predictor. Co-worker competitiveness has a positive effect on co-workers’ knowledge sabotage behavior. There is a relatively strong relationship between co-worker and individual knowledge sabotage which suggests that knowledge sabotage is a form of contagious workplace behavior. Individuals underestimate their negative behavior and traits and/or overestimate those of their fellow co-workers.

Practical implications

Managers should realize that the Dark Triad personality traits could predispose certain individuals to engage in extremely harmful counterproductive knowledge behavior. They need to ensure that individuals with these traits are not hired or are identified during their probation periods. It is recommended that organizations include knowledge sabotage measures in their periodic employee surveys. Organizations should help their employees objectively re-evaluate their own traits and knowledge behavior as well as those of their colleagues to ensure that their reciprocating knowledge behavior is more aligned with the reality in their organization.

Originality/value

This study offers a reliable and valid quantitative survey instrument to measure the presence of knowledge sabotage.

Abstract

This paper attempts to evaluate the literature of the field of history through a multi‐decade reference analysis of the American Historical Review. Reference analysis, a subsection of the larger field of bibliometrics, is a method of determining the characteristics of a field or subject by careful examination of the literature of that area. This study will analyze references from one issue of the AHR from the years 1950, 1970, 1990, and 2002 in five areas: total citations, age of the citations, language of the citations, format of the citations (e.g. monograph, journal, etc.), and the number of authors per citation. Hopefully, this analysis will help to define the patterns (if any) that have characterized the field of history through time.

Abstract

Purpose

How do dark personality traits impact workplace bullying (WB)? How can organizations mitigate it? This study aims to explore the relationship between the Dark Tetrad (DT) (narcissism, psychopathy [PY], Machiavellianism and sadism [SM]) and WB, proposing the mediation role of moral disengagement (MD) and the moderation role of emotional stability (ES).

Design/methodology/approach

The proposed mediated-moderation model was tested on 404 employees working in the hospitality sector in Pakistan. Data have been analyzed through regression analysis and PROCESS macros to test the study’s hypotheses.

Findings

PY, Machiavellianism and SM positively relate to WB and MD mediates this relationship. A high level of ES reduces the intensity of the mediated influence of PY, Machiavellianism and SM on WB.

Practical implications

Developing targeted policies and practices (e.g. personality tests to build a good psychological architecture of the firm) and reviewing processes that support the moral justification of antisocial conduct can be beneficial for limiting WB. In addition, meditation, mindfulness training and supporting trust and cooperation within organizations can increase the mitigating effect of ES and, in turn, reduce WB.

Originality/value

To the best of the authors’ knowledge, this is the first study that explicitly verifies a mediated-moderation model on DT-WB while proposing a further explanation (i.e. mediation of MD) and a novel solution (i.e., moderation by ES).

Abstract

Purpose

The aim of this paper is to explore the development of the North American Society for Sport Management (NASSM) and to map the foundation that specific individuals, historical works, and historians provided the founders of that organization and the field of sport management in general. The paper also aims to track the early beginnings of sport management and present sport as a viable area for business and management historians to conduct their research and discuss theory.

Design/methodology/approach

Following the initial work started by deWilde et al., this study drew on a wide range of primary and secondary sources and took an antiquarian and reconstructionist approach. Specifically, time-specific sport-related/focused dissertations, research articles, and archives from NASSM, along with published books and archives, were used to work toward the purpose of the study.

Findings

This paper illustrates that some of the critical founding members of sport management and NASSM drew upon the training of historians, with special emphasis from business history, and reacted to specific prompts to create the field (i.e. sport management). “History” and trained historians directly impacted the field of sport management by helping to establish NASSM, the Journal of Sport Management, and graduate study programs, in addition to fashioning the first field accreditation standards and seminal textbooks needed to educate the generalist or specialist sport management student.

Research limitations/implications

This research only tracks the beginnings of sport management and focuses on the contribution of “history” toward its development. This work recognizes there were other influences that were critical to the development of sport management.

Practical implications

Over time, sport management scholars have moved away from their small historical base and more toward true quantitative preferences. While this has helped the field gain some respectability within contemporary preferences, the re-utilization of historical methods and/or perspectives can help serve the future of sport management and business/management history research toward the study of emerging topics. Through collaboration sport management's leadership can realize the potential of the historical approach/orientation and management historians can enjoy another outlet to communicate their thoughts regarding management topics and theories.

Originality/value

The paper highlights that sport is rich in context and available to use for the study of management theory and behaviors.

Abstract

Purpose

This study aims to examine the relationships between handlers and (canine) K9. Understanding the influence of well-being and stress (general, occupational and home) is a first step in understanding the performance of K9 units in law enforcement.

Design/methodology/approach

A mixed-methods approach employing semi-structured interviews and quantitative surveys. This approach assessed the relationship between handlers and K9s, while capturing context and the nuanced nature of these partnerships.

Findings

Handlers agree that K9 can detect handlers' general stress, which potentially impacts K9 performance. Occupational stress influences handler/K9 abilities, however, handlers did not agree on all individual behaviors contributing to this stress. Finally, handlers stressed the importance of K9 units training together and suggested supervisors do not always appreciate the importance of joint training sessions.

Originality/value

As specialized units, K9s are often overlooked in policing scholarship, but serve a substantial large role in the missions of safety and security. Little is known about the dynamics of handler/K9 relationships.

Abstract

Purpose

During the past decade, there has been a steep increase in the scholarly literature on Machiavellian leadership. However, no systematic literature review has been conducted to synthesise, analyse and identify the trends, tensions and gaps in Machiavellian leadership. Therefore, the authors examine empirical studies published in peer-reviewed journals since 2000, with an impact factor of Q2 or above in the SCImago ranking list. This paper aims to discuss the aforementioned objective.

Design/methodology/approach

Using the systematic literature review approach, a review protocol was developed to define the focus of the study, the search strategy and the criteria for inclusion and exclusion of studies in the review process. The authors developed a keyword search query using terms “Machiavellian” OR “Dark Triads” and “leadership”. The authors’ search was limited to publications in the English language and with the search terms in either the abstract or keywords of the publication. The review consisted of 576 peer-reviewed scholarly journal articles, out of which 53 articles were selected for the final analysis.

Findings

The analysis reveals how the unidimensional nature of most studies and limited contextual and ontological orientations curtail the development of the relational perspective of Machiavellian leadership. The authors propose a way forward, new insights and opportunities for future research in the field.

Originality/value

This is the first systematic literature review on Machiavellian leadership. Although the research in Machiavellian leadership is reaching a stage of maturity, this review exposes limitations and gaps in research.

Abstract

Purpose

Work–life programs research has been conducted at the individual and organizational levels, yet one important question remains unanswered: Do work–life programs improve organizational outcomes?

Design/methodology/approach

This paper presents a systematic literature review of the impact of work–life programs (bundles versus separate programs) on outcomes at the organizational level. A systematic selection process was adopted, resulting in a final sample of 35 articles published in 26 peer-reviewed journals from 1990 to 2019.

Findings

The findings suggest that these programs can result in positive, negative or no impact on organizational outcomes, depending on the study design, industry, organization size and country/region.

Originality/value

This review draws on quantitative and qualitative empirical studies to summarize, explain and refine the business case for work–life programs. The resulting framework provides directions for future research.

Abstract

Purpose

The purpose of this study was to obtain an immediate and deeper understanding of apparel import intermediaries' (AII) secrets to success in the hyper‐dynamic US apparel market environment.

Design/methodology/approach

Personal in‐depth interviews were conducted with 13 US apparel industry experts who provided an insider's lived experience of the industry. Within a holistic hermeneutic analysis, emergent themes were classified into two broad theme categories: the meaning of success and secrets to success.

Findings

The study's informants defined success as a long‐term presence, a platform from which they could impact the industry through creative expression. AIIs' secrets to success emerged as immersion knowledge management; simultaneous dual relationship management; and flexibility saturation.

Research limitations/implications

Although qualitative research methods are designed for a deeper understanding of the topic of interest, the study findings of an immediate and lived experience within the apparel industry should be viewed within a narrower context than survey research.

Practical implications

These findings offer timely best practices for apparel firms' success and furnish insights into some of the rarely accessible elements of firm management. The study's results may also offer guidelines for firms in other industries moving toward the apparel industry model of hyper‐dynamism.

Originality/value

The study offered a definition and description of a new type of industry environment‐hyper‐dynamism. The study also revealed for the first time the reality of AIIs, especially how these firms defined success and took action to achieve it. Finally, the findings suggested a possible extension of resource‐advantage theory.
