Abstract

Purpose

The purpose of this paper is to explore the impact of changes to the Arkansas budget process brought about when the people of Arkansas voted to move from a biennial to an annual budget period in 2008. The paper describes the legislative changes necessary for annual budget review and explores the impact of annual budget review on revenue forecasting, supplemental appropriations, special sessions, legislative staff workload, executive branch oversight and state spending. This research assesses legislative perceptions of annual budget review across several factors including knowledge of the state budget, ability to check the powers of the governor and overall efficacy of annual budget review.

Design/methodology/approach

This exploratory research uses interview data from the Legislative Fiscal Director and data from an online survey of Arkansas state legislators. The interview and survey data were supplemented by an analysis of documents produced by legislative staff regarding supplemental appropriations, special sessions and state general revenue.

Findings

The Legislative Fiscal Director interview indicates that the change in budget period had little impact on revenue forecasting, special sessions and state government spending, with the exception that supplemental appropriations for Big 6 agencies increased in a statistically significant way following the advent of the fiscal session. The legislative survey finds that the change in budget period is viewed positively by Arkansas legislators. Most legislators indicated that they prefer annual budget review to biennial budget review.

Research limitations/implications

Because of the exploratory approach, the research results may lack generalizability.

Originality/value

This paper surveys legislators on the efficacy of annual budget review which has seldom been done in previous research.

Abstract

This article addresses the problems and opportunities of on-site cost estimation of state mandates on the law enforcement and justice system in five Arizona counties. On-site cost estimation was time consuming and costly, involving a great deal of travel with numerous return visits to conduct hundreds of interviews with county staff throughout 68 departments. Estimates are based on qualitative as well as quantitative data and thus limited to conveying a general sense of the costs of carrying out a mandate in a given year. On-site data collection also provided opportunities to gain new perspectives on the workings of the law-justice system, on state-county funding arrangements, on the need to view the law-justice system as an interrelated whole, and on the utility of considering community value along with costs of the law-justice system.

Abstract

Purpose

The purpose of this study is to examine the perceived needs of local law enforcement investigating crimes characterized by a cyber component.

Design/methodology/approach

A total of 263 surveys were mailed to local law enforcement from across the state of North Carolina. Responses were received from 127 agencies – municipal police departments and county sheriffs' offices – comprising 71 of 100 North Carolina counties being represented.

Findings

Results indicate that local law enforcement continues to lack adequate training, personnel, and equipment to investigate crimes with a cyber component. Additionally, perceived levels of preparation and police agency size are positively related. Data also confirm a significant association between an agency's jurisdiction population size and the number of investigations for these crimes.

Research limitations/implications

In a snapshot manner, this study solely examines the perceived investigative needs of law enforcement in the state of North Carolina. Additional data is needed to determine not only the prevalence of computer‐related crimes in other jurisdictions, but levels of preparedness. The lack of a universal definition of computer crime has implications on the data within as they are often estimated or perceived by respondents.

Practical implications

With numerous issues in need of attention, leadership from both government and law enforcement must begin to recognize the problems associated with computers and crime to effectively implement strategies that will enhance computer crime control.

Originality/value

This study is valuable as prior studies have largely been conducted at the national level and have predominantly discounted smaller agencies from their research. This research adds empirical evidence to the issue of law enforcement preparedness in investigating crimes with a cyber component.

Abstract

Much of the budgeting literature has focused on the questions of “how” budgets are prepared and “how” budget decisions are made. Minimal attention has been directed to “how” budgets are executed. This paper focuses on this issue with special emphasis on state government budget execution processes. The paper provides an overview of the similarities and differences of state and federal budget execution follows by an assessment of how state balanced budget requirements place special responsibilities on state budget offices to monitor “within” budget execution year expenditures and revenues. Actions which may be taken to insure that state budgets are balanced are discussed. These actions are enumerated and analyzed in terms of legislative and executive branch authority and responsibility shifts.

The death penalty has existed in a state of steady decline for the last two decades, during which state legislatures have been at the center of abolition efforts. Successful abolition is, however, very rare in contrast to how often death penalty repeal bills are introduced across state legislatures, year after year. Indeed, abolition is not a sudden event, but may be many years in the making. Research on the early phases of this process, where the groundwork for enacted legislation is laid, is nevertheless limited. This chapter explores patterns of death penalty bill introductions across all active death penalty states from 1999 to 2018, providing not only an overview of legislative activity at state level but also an analysis of potential factors fueling the activity. It argues that individual legislators play a significant role in the current trend of increased legislative support for a restricted, if not entirely abolished, death penalty, evident both in terms of persistency over time and cooperation across party lines. It also problematizes partisan aspects of legislative activity in the context of legislation on capital punishment.

Abstract

This paper develops a new theory arguing that party change results from ruptures in political parties’ ties to civil society organizations. I demonstrate the utility of this approach by using it to explain why the Rhode Island Democratic Party (RIDP) changed from a hierarchical machine to a porous political field occupied by multiple interlegislator cliques and brokered by extra-party political organizations and professionals. While others attribute party change to bureaucratization, electoral demand, or system-level changes, I analyze historical, observational, and interview data to find that a severance in the RIDP’s relationship with organized labor prompted party change by causing power to diffuse outward as leadership lost control over nominations and the careers of elected office holders. In the spaces that remained, interest groups and political professionals came to occupy central positions within the party field, serving as brokers of the information and relationships necessary to coordinate legislative activity. This analysis refines existing theories of party change and provides a historically-grounded explanation for the institutionalization of interest groups and political professionals in American party politics.

Abstract

Costa Rica is recognized as one of the two countries with the longest continuous democracy in Latin America. After a short civil war, the country dissolved its armed forces and adopted a new constitution that established the basis of a Welfare State and a meritocratic public administration. The aim of this chapter is to analyze the characteristics of the Costa Rican public administration since the end of the 1990s. We discuss the dilemmas presented by its high level of fragmentation and the actions that have been taken—based mainly on the neo-Weberian paradigm—to modernize the traditional public apparatus so that it becomes more efficient, transparent, and responsive to citizens.

Abstract

Purpose

The imposition of term limits in bicameral (two‐chamber) state legislatures could produce unforeseen consequences in the policymaking process. Supporters of term limit rules have not considered that their imposition could fundamentally shift the sequence of policymaking in legislatures. This is important given that research on sequential bicameral policymaking suggests qualities of the lower chamber allow it to cultivate policy expertise such that the upper chamber will defer to the lower chamber in policymaking. This project aims to explore whether this proposed policymaking sequence exists in term‐limited states.

Design/methodology/approach

A comparison of policy adoptions in states with and without term limits is performed using an original data set on bill adoptions for all US bicameral legislatures that had a regular session between the years 2000 and 2006. Least‐squares regression models evaluate whether basic characteristics of legislatures are as relevant as term limit characteristics in explaining the level of outputs from the lower chamber in term‐limited states.

Findings

In states with term limits, the level of policy adoptions initiated by the lower chamber is lower than levels seen in states without term limits. This finding holds when controlling for other relevant variables that can potentially explain lower chamber productivity.

Research limitations/implications

The study analyzes aggregate state‐level data and does not interview individual legislators in states with and without term limits on whether term limits can alter future legislative behavior.

Originality/value

This study is the first to examine whether the policymaking sequence differs between states that possess and do not possess term limit rules.

Abstract

Purpose

This study aims to deal with the evaluation of institutional development and effectiveness of regional parliaments; it provides a scientific contribution to the development of the field of parliamentary studies by developing a set of indicators to present a parameter for evaluating regional parliaments with application to the Arab Parliament. The study concluded with the development of a parameter of 35 indicators to measure institutionally, efficiency and effectiveness of the institution, with application to the Arab Parliament, as well as developing an integrated assessment of the strengths and weaknesses in the institutional aspects and organizational efficiency.

Design/methodology/approach

The study is predicated on the principle of institutional approach and the systems analysis. The curriculum is applied to the Arab Parliament as an institution to quantify efficiency and efficacy according to the implementation of a set of proposed practical indicators. The study additionally applies both Huntington’s institutional standards such as Adaptability, Involution, Autonomy and Coherence, as well as the indicators of institutions efficiency according to PrePanti such as Openness, Reception (R), Autonomy (A), Balance (B), Congruence (C), Internal Efficacy (I), Reformulation (R) and Roles (R), which refer to the first seven Latin letters “First RABCIRR”.

Findings

The researcher endeavored to answer the main questions; How to quantify the degree of institutionalization, its impact on the efficiency and efficacy of regional parliaments. The researcher’s approaches and the standards of efficiency and efficacy figured a comprehensive set of indicators that composed an integrated parliamentary standard to assess the degree of institutionalization, efficacy and efficiency of regional parliaments as a scientific contribution based on the Arab Parliament that can be applied to all regional parliaments.

Originality/value

This research is an attempt to create a Parliamentary Index to complement the previous scientific initiatives and efforts in developing such an index, which consists of 35 indicators and its application to the Arab Parliament. This research uses the principles of institutional approach, system analysis methodology and efficiency. The approach is applied to the Arab Parliament as a regional parliament to measure efficiency and effectiveness by applying a set of the proposed indicators.
