Abstract

Purpose

Despite the importance of employees’ perception of organizational justice and its impact on intention to stay, various loopholes have been identified that do not justify this relationship. The purpose of this paper is to posit a model, which postulates the effect of procedural and interactional justice on distributive justice, which further impact employees’ intention to stay. Subsequently, it also investigates the mediating role of employees’ affective commitment.

Design/methodology/approach

A questionnaire was prepared and a survey was conducted on 500 junior and middle-level software professionals. Structural equation modeling was employed to examine the proposed model.

Findings

The study concludes the positive effect of distributive, procedural and interactional justice on employees’ intention to stay. Moreover, the addition of affective commitment as a mediator, displayed an indirect influence of organizational justice on intention to stay.

Research limitations/implications

This study proposes a model to boost organizational justice to encourage employees’ intention to stay in an organization. Furthermore, considering the role of organizational commitment in enhancing intention to stay would be fruitful to the stakeholders in the IT industry.

Originality/value

No study has been reported in the context of the role of organizational justice on intention to stay while testing the contribution of affective commitment as a mediator, within a single framework. This study elucidates the influence of distributive, procedural and interactional justice on employees’ intention to stay in IT organizations.

Propósito

A pesar de la importancia de la percepción de los empleados sobre la justicia organizacional y su impacto en la intención de quedarse, se han identificado varias lagunas que no justifican esta relación. El estudio postula un modelo que postula el efecto de la justicia procesal e interactiva en la justicia distributiva, que impacta aún más la intención de los empleados de permanecer. Posteriormente, también investiga el papel mediador del compromiso afectivo de los empleados.

Diseño/metodología/enfoque

Se preparó un cuestionario y se llevó a cabo una encuesta a 500 profesionales de software de mediano y menor nivel. el modelado de ecuaciones estructurales se usó para examinar el modelo propuesto.

Resultados

El estudio concluye el efecto positivo de la justicia distributiva, procesal e interaccional sobre la intención de los empleados de permanecer. Además, la adición del compromiso afectivo como mediador, mostró una influencia indirecta de la justicia organizacional sobre la intención de permanecer.

Limitaciones de la investigación/implicaciones

este estudio propone un modelo para impulsar la justicia organizacional para alentar la intención de los empleados de permanecer en una organización. Además, considerar el papel del compromiso de la organización para mejorar la intención de permanecer sería fructífero para las partes interesadas en la industria de TI.

Originalidad/valor

no se informó ningún estudio en el contexto del papel de la justicia organizacional en la intención de permanecer mientras se prueba la contribución del compromiso afectivo como mediador, dentro de un marco único. Este estudio dilucida la influencia de la justicia distributiva, procesal e interactiva en la intención de los empleados de permanecer en las organizaciones de TI.

Abstract

In a country where judicial institutions are known to be inefficient and where activists have traditionally not engaged in legal mobilization, what explains the emergence of NGO strategic litigation? The author argues that a change in the legal opportunity structure impacts how activists interact with the legal system. Comparing two states in Mexico, the author demonstrates that the introduction of private prosecution rights opened the door for activists to litigate femicide cases. The emergence of strategic litigation has helped improve compliance with international human rights law and has had a demonstration effect on how to use the law to press for accountability.

Abstract

Purpose

Este artículo tiene por objeto analizar uno de los casos más importantes en los últimos años en los que se han declarado nulas ciertas cláusulas abusivas incluidas por las aerolíneas en los contratos de transporte aéreo con los consumidores, en concreto, se trata de la Sentencia de la Audiencia Provincial de Madrid, sección 28, de 26 de julio de 2017 y, especialmente, se estudiará la cláusula de cargo por remisión de la tarjeta de embarque.

Design/methodology/approach

A través del estudio de la mencionada sentencia, este trabajo mostrará cómo el contrato de transporte aéreo de personas siendo uno de los contratos más importantes actualmente, presenta una situación de especial desequilibrio y desprotección de los consumidores frente a las aerolíneas.

Findings

La falta de poder de negociación de los consumidores, las escasas alternativas que tienen en muchos casos y los precios generalmente altos de este contrato de transporte, hacen imprescindibles dispensar una protección adecuada a los consumidores en este contexto. Esto se puede lograr a través de leyes tuitivas que protejan sus intereses económicos y, especialmente como se analiza en el artículo, mediante la prohibición de cláusulas abusivas en los contratos de transporte aéreo.

Originality/value

El artículo hace un recorrido por algunas de las cláusulas abusivas incluidas en los contratos de transporte aéreo de pasajeros en los últimos años y muestra cómo debe evitarse que las aerolíneas impongan estas cláusulas que perjudican a la parte más débil del contrato y advierte que estamos aún lejos de conseguir una efectiva protección del consumidor en este ámbito como se explica con algún ejemplo final.

Abstract

Purpose

This paper attempts to examine new technologies, typologies, FATF recommendations and the last Spanish penal reform on money laundering.

Design/methodology/approach

The paper describes the potential provided via internet and electronic transfers, prepaid cards and payment services with mobile phones for executing money laundering, and comments on the Spanish penal reform on this crime.

Findings

The study finds that the new payment systems facilitate money launderers’ criminal activity. However, the development of technologies, including the internet, has unquestionable advantages involved, and even provides verification of identity or other duty of surveillance for the prevention of money laundering. Also, this paper analyzes the amendments made recently in the Spanish Criminal Code regarding money laundering.

Originality/value

This paper would be beneficial to the legislature. Future development of measures for the prevention of money laundering should take into account all potential threats that arise from the use of new technologies. Moreover, the long list of modifications on laundering undermines the legal certainty and the consideration of criminal law as ultima ratio, within the framework of a globalized crime policy.

Abstract

In this chapter, we analyse the role of women in armed Basque nationalist and separatist terrorist group Euskadi Ta Askatasuna (ETA) from a gender perspective. ETA women were essential agents in the armed conflict, but their image in the mass media and society has been very different from that of their male colleagues (Rodríguez Lara, 2017). Also, their role in the terrorist gang has described a sexually based functional specialisation. In addition, this chapter seeks to contribute to the area of feminist studies on women and political violence. Women's role in one of the most important armed nationalist groups in Europe, ETA, stands as a suitable case study to understand how the mass media (press, journalism), audiovisual content, and social representations of ETA have portrayed these women. The final conclusion of this chapter is that women were not portrayed in the same way as their male colleagues. Women of ETA were doubly penalised because they were women and because they were terrorists.

Abstract

Purpose

The object of this research is the reconstruction of the existing legal response by European Union states to the phenomenon of immigration. It seeks to analyse the process of conferral of protection.

Design/methodology/approach

One main dimension is selected and discussed: the case law of the national courts. The study focuses on the legal status of immigrants resulting from the intervention of these national courts.

Findings

The research shows that although the courts have conferred an increasing protection on immigrants, this has not challenged the fundamental principle of the sovereignty of the states to decide, according to their discretionary prerogatives, which immigrants are allowed to enter and stay in their territories. Notwithstanding the differences in the general constitutional and legal structures, the research also shows that the courts of the three countries considered – France, Germany and Spain – have progressively moved towards converging solutions in protecting immigrants.

Originality/value

The research contributes to a better understanding of the different legal orders analysed.

Abstract

This chapter demonstrates how Argentine law court sentences have constructed a “legal truth” regarding the unlawfully appropriated children of people “disappeared” during the last military dictatorship (1976–1983). There are two discursive processes involved in the construction of that truth. On one hand, the courts reinterpret the crime of “abduction of minors” to emphasize the damage done to families in the exercise of their rights, and on the other hand, they link illegal appropriation to the military government’s counterinsurgency policies. Lastly, in the construction of this “legal truth,” the sentences employ other discourses, particularly those of genealogy, psychoanalysis, and human rights.
