Abstract

The question of health and safety at work is a central issue for trade unions. In Britain it is an area of concern where there were important legislative initiatives in the 1970s and 1980s, although surprisingly this has received relatively little attention in the debates about trade unionism. This neglect results in an aspect of union activity about which little is known. Explores through a detailed longitudinal study of a middle‐range engineering firm, from the late 1970s into the 1990s, the ways in which trade unions organize and act on health and safety questions. Argues that it is almost “routine” that workers face dangers and hazards at work, a central feature of the work and employment experience of most workers. However, this is often difficult to deal with as individual issues, or as matters which are subject to collective consideration. On the one hand, workers often appear to accept the dangers and hazards they face. On the other hand, managements are preoccupied with questions relating to production and finance, rather than the day‐to‐day problems faced by workers. This tension suggests that the future wellbeing of workers in unionized workplaces lies not so much with legislative provisions and rights at work, but in education and the organizing ability of workplace unions, raising and addressing what often seem like individualistic problems in collective ways.

Abstract

A distinction must be drawn between a dismissal on the one hand, and on the other a repudiation of a contract of employment as a result of a breach of a fundamental term of that contract. When such a repudiation has been accepted by the innocent party then a termination of employment takes place. Such termination does not constitute dismissal (see London v. James Laidlaw & Sons Ltd (1974) IRLR 136 and Gannon v. J. C. Firth (1976) IRLR 415 EAT).

Abstract

Paint and dust samples were collected from a children′s nursery in a London school. After chemical digestion using an available lead extraction method, lead concentrations were determined by atomic absorption spectrophotometry. Most samples analysed were considered to pose no hazard to the children. However, a few samples contained available concentrations in excess of 2,500ppm and were considered potentially hazardous. Such high concentrations were thought to be due to remnants of old paint applied prior to the introduction of regulations to limit the content of lead in paint. Although the lead‐in‐paint hazard has diminished in recent years, the possibility of old lead paint still being a hazard should not be ignored.

Abstract

This study proposes targeted modernization of the Department of Defense (DoD's) Joint Forces Ammunition Logistics information system by implementing the optimized innovative information technology open architecture design and integrating Radio Frequency Identification Device data technologies and real-time optimization and control mechanisms as the critical technology components of the solution. The innovative information technology, which pursues the focused logistics, will be deployed in 36 months at the estimated cost of $568 million in constant dollars. We estimate that the Systems, Applications, Products (SAP)-based enterprise integration solution that the Army currently pursues will cost another $1.5 billion through the year 2014; however, it is unlikely to deliver the intended technical capabilities.

Outlines the major guidelines introduced by the Environmental Protection Act 1990, the Control of Substances Hazardous to Health Regulations and the Construction (Design & Management) Regulations to help paint manufacturers to rise to the challenge of manufacturing products that are safer, both to the user and to the environment and which at the same time complement industry initiatives.

In order to succeed in an action under the Equal Pay Act 1970, should the woman and the man be employed by the same employer on like work at the same time or would the woman still be covered by the Act if she were employed on like work in succession to the man? This is the question which had to be solved in Macarthys Ltd v. Smith. Unfortunately it was not. Their Lordships interpreted the relevant section in different ways and since Article 119 of the Treaty of Rome was also subject to different interpretations, the case has been referred to the European Court of Justice.

Abstract

Improved safety, health and environment outcomes through better design are about eliminating or minimising risks in the preliminary planning stages of a product. Better design provides a foundation for improved outcomes in the development, use and maintenance of a product like plant and equipment or a building. Improved outcomes in design require the many stakeholders who contribute to the design process to critically review its safety, health and environment implications. Therefore, the client, or end user, must be actively involved in the review to ensure that operational requirements and maintenance issues, intrinsically known to the client, are considered by other design stakeholders. For example, safety, health and environment implications inherent in the design of a building project may exist in its construction, use, maintenance and demolition, i.e. its complete lifecycle. Similar implications exist for the design of other products such as plant or equipment, e.g. its manufacture through to decommissioning.
