Abstract

Purpose

The object of this research is the reconstruction of the existing legal response by European Union states to the phenomenon of immigration. It seeks to analyse the process of conferral of protection.

Design/methodology/approach

One main dimension is selected and discussed: the case law of the national courts. The study focuses on the legal status of immigrants resulting from the intervention of these national courts.

Findings

The research shows that although the courts have conferred an increasing protection on immigrants, this has not challenged the fundamental principle of the sovereignty of the states to decide, according to their discretionary prerogatives, which immigrants are allowed to enter and stay in their territories. Notwithstanding the differences in the general constitutional and legal structures, the research also shows that the courts of the three countries considered – France, Germany and Spain – have progressively moved towards converging solutions in protecting immigrants.

Originality/value

The research contributes to a better understanding of the different legal orders analysed.

Abstract

This chapter focuses on dispute resolution in French labor courts. We empirically investigate the forces that shape decision-making in the pretrial conciliation phase. For that purpose, we compiled a new database from legal documents. The results are twofold. First, conciliation is less likely when plaintiffs are assisted by a lawyer. Although this result might be interpreted in various ways, further analysis shows that the lawyers’ remuneration scheme is the most likely cause of this effect. Second, we find that the likelihood of settlement decreases as the amount at stake increases. These results contribute to the ongoing debate about French labor court reform.

Abstract

This study employs Stein Rokkan's methodological approach to analyse state formation in the Greater Middle East. It develops a conceptual framework distinguishing colonial, populist and democratic pacts, suitable for analysis of state formation and nation-building through to the present period. The framework relies on historical institutionalism. The methodology, however, is Rokkan's. The initial conceptual analysis also specifies differences between European and the Middle Eastern state formation processes. It is followed by a brief and selective discussion of historical preconditions. Next, the method of plotting singular cases into conceptual-typological maps is applied to 20 cases in the Greater Middle East (including Afghanistan, Iran and Turkey). For reasons of space, the empirical analysis is limited to the colonial period (1870s to the end of World War 1). Three typologies are combined into one conceptual-typological map of this period. The vertical left-hand axis provides a composite typology that clarifies cultural-territorial preconditions. The horizontal axis specifies transformations of the region's agrarian class structures since the mid-19th century reforms. The right-hand vertical axis provides a four-layered typology of processes of external intervention. A final section presents selected comparative case reconstructions. To the authors' knowledge, this is the first time such a Rokkan-style conceptual-typological map has been constructed for a non-European region.

Purpose

This paper aims to demonstrate that state shareholders are confronted with contradictory logics leading to institutional contradictions that activist shareholders can exploit. The competing logics of the state as shareholder and their impact on corporate governance and shareholder activism offer fertile grounds for research advances in Coordinated Market Economies (CMEs).

Design/methodology/approach

Through an extensive literature review of state ownership, institutional contradictions and shareholder activism, this paper analyzes two case studies involving the French State as shareholder.

Findings

In the French context, these two cases illustrate how institutional contradictions result in opportunities for shareholder activism. By focusing on the institutional contradictions of the state shareholder, this investigation suggests a need for experimental research to observe how shareholder activists adapt to each institutional change in CMEs. This experimentation can help policymakers to avoid creating additional conditions that shareholder activists can exploit.

Research limitations/implications

This focuses only on France and its state shareholdings. To generalize results, studies of other CMEs and state shareholders are needed.

Practical implications

Policymakers should consider all legislative proposals for their potential to deviate from corporate governance practice by experimenting with them in a laboratory setting. Shareholder activists can compare state shareholders’ actions against the state’s legislation to emphasize institutional contradictions that counter minority shareholders’ rights.

Originality/value

This research is the first to analyze how the state as shareholder can exploit its competing logics to resist against shareholder activism and support management or to become itself a shareholder activist.

Abstract

Purpose

This paper aims to introduce how sociological traditions can provide a complementary, conceptual lens needed to better understand a country’s orientation in its digital transformation policies. While historically sociology has been used to study technological effects, introducing a sociological lens that considers broader macro digital policies can better complement a country’s national innovation system framework by highlighting where forms of acceleration and inertia in digital diffusion may or may not occur.

Design/methodology/approach

To formulate this lens, iterative literature reviews were conducted and four major sociological traditions (i.e. Durkheim, Functional-Utilitarian, Marxist and Micro-interactionist) were identified and integrated into one structure. The integrated structure was then applied to the French case of Minitel as a sample application. The French Minitel was selected because it is well-known and due to one of the author’s familiarity with the French culture. The description was based upon secondary data.

Findings

Through the use and application of this lens, the findings reveal that understanding a country’s specific orientation within a sociological tradition can help academics and practitioners determine what accelerates or provides inertia in the diffusion of new digital technologies within a country’s sociological frame. For the French Minitel, two dominant views seem to exist in France, the Durkheim and the Functional-Utilitarian view, which both affected the country’s path dependency in continued investments in Minitel.

Research limitations/implications

While policymakers are tasked with the development and implementation of digital transformation policies, a key consideration for both scholars and practitioners on digital policy and governance is to understand the broader macro ramifications of sociological frameworks on the evolving effects of digital transformation. While the authors provide a sample illustration, future research is needed to operationalize this lens and to apply it across various regions and countries in the development of new digital transformation policies.

Practical implications

As countries face considerable pressure to digitize their economies, policymakers require a better framework to advance the sociological aspects of digitization and its effects upon local institutions and actors in society. The paper provides a complementary lens that can better help them in this regard.

Originality/value

To date, policymakers and governments lack an integrated framework to understand the sociological effects of digital technologies and their diffusions along with their implications on societies such as on the framework of national innovation. The authors provide a sample integrated structure and sample application.

Today, there is no academic or sociocultural context in which Austrian Economics (AE) is described as being dominant. AE is and remains, for better or for worse, a heterodox current. In the United States, however, but probably nowhere else in the world, AE is heterodox without being invisible or inconsequential. American scholars for whom AE is their preferred paradigm have been able to participate actively in the sort of “discussions” that Arjo Klamer (2007, p. 4) wishes to encourage. They are taken seriously by fellow economists. The vitality of American AE has no equivalent in the rest of the world.1 Obvious constraints of time and space prevent us from offering supporting evidence for this sweeping statement, but in this paper we propose to take a close look at the French case. AE has made few inroads in France. There was a brief period in the 1980s when it was the object of some short-lived enthusiasm; since then interest has waned, although there are indications that the tide might yet again be turning, and in fact, as compared to many other western European countries, France may turn out to be, all things being relative, a less infertile ground than might a priori be thought.

Abstract

Purpose

The purpose of this paper is to argue that national history plays an important role in formulations of workplace religious diversity strategies and practices. It builds on a discussion of the organization of religion in the workplace in two countries, namely, France and Lebanon.

Design/methodology/approach

This is a conceptual paper that provides an analysis into how national history plays an important role in formulations of workplace diversity strategies and practices.

Findings

The paper shows how religion has historically been organized and deployed in contemporary France and Lebanon by the same colonial power, albeit in different ways. While the workplace in France remains religiously neutral in the context of its national labor market, the colonial power has largely contributed to organized religion in contemporary organizations in Lebanon. In analyzing the Lebanese and French cases, it is argued that the use of religious diversity has weakened the process of adopting equal, diverse, and inclusive managerial strategies.

Practical implications

Experiences in both countries suggest a failure of “blind neutrality” in the case of France, and another failure of a form of positive discrimination in the case of Lebanon. The authors draw lessons from those two experiences and propose future directions of how policy makers/legislators and organizations can advance and capture more equal, diverse, and inclusive diversity strategies.

Originality/value

The above two cases offer rich lessons for religious diversity scholarship and practice. The paper contributes to the literature on diversity in the workplace by questioning the organization of religious diversity in two countries that are under researched in management and organization studies.

Abstract

Purpose

The purpose of this paper is to examine the trajectory of cultural stereotypes on Uncertainty Avoidance emergent from two French multinational corporations. The exploration of respondents' comparisons of their own culture with other cultures illustrates that cultural stereotypes are derived from structural conditions that had developed over time, but came to be (mis)attributed to innate and prevalent cultural habits.

Design/methodology/approach

Data were collected from both primary and secondary sources, characterized by qualitative methodologies. Primary data respondents were predominantly ethnic Chinese Singaporeans, and secondary data respondents were predominantly French. In‐depth interviews were introduced in three phases.

Findings

The stereotype of the “uncertainty avoidant” Chinese Singaporean employees was employed by the top manager in one of the case studies (ECI) to lend legitimacy to the employees' exclusion from top management positions. The converse argument was made that “uncertainty avoidance” is absent among the French, who are hence more qualified as ECI top managers. Both claims were unfounded in this inquiry. Further evidence points to structural factors mediating employee behavior.

Research limitations/implications

Structural factors were found to lend greater credibility in accounting for employee behaviors outlined in this study, more so than cultural ones. Future research surfacing complementary statistical insights will provide more concrete and representative evidence to this exploratory inquiry.

Originality/value

An alternative view of Uncertainty Avoidance through a structural account is proposed, based on evidence from qualitative inquiries.

Abstract

Purpose

The purpose of this paper is to study the case of one French multinational company which has undergone a process of radical restructuring and “internationalization” because of acquisitions of Anglo‐Saxon multinational companies. It examines how the organizational changes influenced the company's approach to the international human resource management (IHRM).

Design/methodology/approach

The methodology of this research is the single case study. Sources of evidences are direct participation and observation, interviews with top managers, and documentation.

Findings

The results show that the ethnocentric model, when French managers were placed on the top of the foreign subsidiaries, becomes non‐efficient in the company which doubled its size and the geographical spread of its activities. It is argued that the forces of globalization constrained this multinational company to change from an ethnocentric approach to a geocentric approach to its IHRM.

Originality/value

The case demonstrates that national and organizational cultures are important contextual factors which influence the company's approach to its IHRM. The paper outlines the interconnectedness of globalization and the geocentric approach to the IHRM.

Abstract

Purpose

The purpose of this paper is to look at congruence effects between region and origin of producer on wine evaluations, and review if and how these two features are evaluated together, to determine authenticity, quality and price perceptions. Is a French wine better because it is made in France, because it is made by a Frenchman, or because a Frenchman made it in France?

Design/methodology/approach

A 2×2 factorial design was devised and 206 Americans were surveyed using empirical methods and online survey data.

Findings

The results show that region and producer are important considerations when consumers evaluate wine. Old world wines are perceived as more authentic regardless of who makes them, but it is also demonstrated that when origin features are incongruent, consumers associate similar quality to wines, but at different prices. Wine dogmatism is shown not to impact wine evaluations.

Practical implications

Marketing the origin of the winemaker rather than just the origin of the wine signals more information to consumers. Incongruence signals higher price points but congruency influences authenticity perceptions. Quality and price perceptions are not moderated by wine dogmatism.

Originality/value

Whereas previous research focused on general wine origin, this paper offers a relevant contribution to the place of origin literature in that it clarifies the relationship between the where and who for wines and how these two features together influence consumer perceptions. For the first time, the concept of wine dogmatism is discussed and a preliminary measurement of the trait is devised.
